1967-012 RESOLUTION NO. 67R-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1842 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from JOPAR., INC.. owner of certa~n real property situated in the city of Anaheim, County of Orange, State of california, described as follows: The West 69.00 feet of the North 165.00 feet of the West 122.00 feet of the East 264.00 feet of the northeast quarter of the southwest quarter of Section 12, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as the southwest quarter of said Section 12, is shown on a map filed in Book 16; page 11 of Record of Surveys, in the office of the County Recorder of said County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on November 21 , 19 66 , notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC66-l57 denvin~ Variance No. 1842 and WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in denying said variance and did set a public hearing thereon to be held on the 3rd day of January , 19 67 , at 7:00 o'clock P.M. in the city Hall in the city of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- WHEREAS, the city council does find that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the city Planning Commission denying Variance No. 1842 be, and the same is hereby sustained, and that the petition for a zoning variance permitting waivers of the minimum number of parking spaces required (Section l8.40.070(4-a-2f)), and maximum building height limitation (Section 18.40.070(3-a)), on the property hereinbefore described, be, and the same is hereby denied.
