1967-011 RESOLUTION NO. 67R-1l A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 896 WHEREAS, the City Planning Commission of "the City of Anaheim did receive a request for a conditional use permit from JOPAR, INC., 5681 Deborah Street, Long Beach, California, and PAUL VON ESSEN, 5723 West 75th street, Los Angeles, California, to establish a service station within 75 feet of a residential structure in an R-A, Agricultural Zone (Section l8.40.060(c)), on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The North 165.00 feet of the East 142.00 feet of the northeast quarter of the southwest quarter of section 12, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as said southwest quarter of said Section 12 is shown on a map of survey recorded in Book 16, page 11, Record of Surveys, in the office of the County Recorder of said County. ALSO the East 53.00 feet of the North 165.00 feet of the West 122.00 feet of the East 264.00 feet of the northeast quarter of the southwest quarter of Section 12, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as the southwest quarter of said Section 12 is shown on a map filed in Book 16, page 11 of Record of Surveys, in the office of the County Recorder of said County. J denvipa Conditional Use Permit No. 896 ; and WHEREAS, thereafter, wi thin twenty- two days from., the date of, the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Plannins Commission in . said'conditional use permit and did thereupon x t e ~ day of ~J 1967 , as the time and the Coun~r in the~~- -1- of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required- by law and the provisions of Title 18, Chapter 18.76 of the Anaheim MUnicipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ingand did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City'Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 896 should be denied. , NOW . 'tHEREFORE, BE IT RESOLVED by the City Council of 'the City of Anaheim that the action of the City Planning Commis- sion denvinq Conditional ,Use, Permit No. 896 be, and the s.me is hereby sustained , ~ and that the request of JOPAR, INC. and PAUL VON ESSEN to establish a service station within 75 feet of a residential structure in an R-A, Agricultural Zone (Section l8.40.060(c) of the Anaheim Municipal Code), on the property here- inbefore described, be, and the same is hereby denied.
