1967-008 RESOLUTION NO. 67R-8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PEro~IT NO. 900. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from JAPANESE AMERICAN DEVELOPMENT ENTERPRISES, INC., 5511 East Lincoln Avenue, Cypress, California, to permit on-sale beer and wine in conjunction with an existing Japanese Restaurant on the following described property situated in the City of Anaheim, County of Orange, state of California, to wit: PARCEL 1: The South 303.00 feet of the West 3 acres of the East half of the South half of the Southwest quarter of the Southwest quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as said section is shown on a map recorded in Book 51, page 11 of Miscellaneous Maps, in the office of the County Recorder of said County. EXCEPT the Southerly 53.00 feet thereof. PARCEL 2: The South 303.00 feet of the East 3 acres of the Southwest quarter of the Southwest quarter of the Southwest quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, in the City of Anaheim, County of Orange, State of California, as said section is shown on a map recorded in Book 51, page 11 of Miscellaneous Maps, in the office of the County Recorder of said County. EXCEPT THEREFROM the South 180.00 feet of the West 50.00 feet thereof. ALSO EXCEPT the Southerly 53.00 feet thereof. PARCEL 3: The South 180 feet of the West 50 feet of the East 3 acres of the Southwest quarter of the Southwest quarter of the Southwest quarter of Section 13, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, County of Orange, State of California, as per map recorded in Book 51, page 7 et seq., of Miscellaneous Maps, in the office of the County Recorder of said County. AND WHEREAS, the City Planning commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on November 21, 1966, notices of which said public hear- ing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC66-l52 denying Conditional Use Permit No. 900; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denying said Conditional Use Permit and -1- said appeal was set for public hearing on January 3, 1967, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did dulY)10ld and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful con- sideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 900 should be denied. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission denying Conditional Use Permit No. 900 be, and the same is hereby sustained, and that the request of Japanese American Development Enterprises, Inc. for a conditional use permit to allow on-sale beer and wine in conjunction with an existing Japanese Restaurant, on the property hereinbefore described, be, and the same is hereby denied.
