57R-4092 .-'-. - ,,-. RESOLUTION NO. 4092 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE. (801). WHEREAS, the City Pl~nning Commission of the City ot Ana- heim did receive a petition from the property owner___ ~~~ of certain real propert:' si tua ted in the City ot Amaheim, County of Orange, State of ~alifornia, described as follows: The West 150 feet of the East 748 feet of the North one-half of the Northeast quarter of the Northeast quarter of Section I), in Township 4 South, Range 11 West, San Bernardino Base and Meridian, in the County of Orange, State of California. AND WHEREAS, the City Planning Commission did hold a pub- lic hearing at the City Hall in the City of Anaheim upon said peti- tion on August 5. 1957 , notices of which said public hearings were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 31 , recommending to the City Coun- cil of the City of Anaheim that Variance No. 801 be granted ..pea ~a.-.e.Q*.~eae-e~e~&6-ift-eftie-~ee~nt~~; and WHEREAS, the City Council does find that: 1. There are exceptional or extraordinar: circum- stances or conditions app11cable to the property involved or to the intendeo use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of R substantial property right possessed by other propertJ in the same vicinity and zone and denied to the property in question. ,,--. 3. That the granting of such ~rAriance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the g~anting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the. City of Anaheim that a conditional zonjng variance be, and the same is hereby granted to GRACE LOSTY, 8852 Lincoln Boulevard, Anaheim, California, to build a duplex on the property hereina~~~ desoribed. ~0 ~. , -1- _. - --,~ The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner or their heirs, successors or ass1gns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Oode unless otherwise specified herein.
