RESOLUTION NO. 4033 ~ A RESOLUTION OF THe CITY COUNCIL OF THE CITY OF ANAHEIM DECLAR ING ITS INTENT ION TO AMEND ARTICLE IX, CHlJ,PTER 2 OF' THE ANAHEIM MUNICIPAL CODE BY ADDING THERETO A NEVI SECTION TO BE DESIGNATED NUMBER 9200.10:2. WHEREAS, the City Council does find and determine that in order to regulate and restrict the location of busi- nesses, trades and industries, and the location of buildings erected or altered for specified uses, and to regulate the uses of land, and to regulate and limit the height and bulk of buildings, the furnishing of minimum off-street parking facilities, and to regulate and determine the area of yards and other open spaces, and to promote the general welfare, public health, peace and safety, and regulate the building and development of the City according to a well-considered plan, it is necessary to establish a new zone to be known and designated as the "C-A," Commercial Amusement Zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does hereby declare its in- tention to amend Article IX, Chapter 2 of the Anaheim Munici- pal Code by adding thereto a new section to be numbered 9200.10:2, and establishing a new zone to be known and desig- nated as "C-A," Commercial Amusement Zone, reading as follows: SECTION 9200.10 :2. "C-A,1l COMMERCIAL M.AUSEMENT ZONE. There is hereby created and established a zone to be known as the "C-A,1l Commerc ial Amusement Zone. In said "C-A,1l Commerc i a 1 Amusement Zone no build ing or other structure or lot shall be used, nor shall any building or other structure be erected, altered, en- larged or maintained, which is arranged, intended or designed for use other than as hereinafter specifically designated and allowed in Subdivision C hereof. A. Prerequisites to the use of property in a "C-A" Zone; All applications for use of land and structures in a "C-A" Zone shall be accompanied by complete site and development plans. B. Prerequisites to the issuance of a Building Permit: No building permit shall be issued for any use in the "C-A" Zone until after the approval of develop- ment plans by the Planning Department. Said plans shall be in conformity with the approved site plans. C. Permitted Uses: -- In the "C-A", Commerc i al Amusemen t Zone, the fol- lowing uses shall be permitted: (1) Amusement and entertainment enterprises and concessions, including all structural devices and contrivances designed and operated for patron participation and pleasure. (2) Antique Shops. -1- (3) Art Galleries ./""",,",. (4) Art Shops (5) Camera Shops, photographic supplies. (6) Circuses (not otherwise prohibited by law or the provisions of this Code). (7) Civic Auditoriums. (8) Comfort Stations. (9) Concert Halls. (10) Confectionery Stores. (11) Curio Shops. (12) Dancing -- Teen-age, supervised. (13) Delicatessen Stores. (14) Drug Stores. (15) Educational Exhibits. (16) Embroidery Shops. (17) Exhibit Halls. (18) Fire Stations. (19) Flower or Florist Shops. (20) Gem Shops. (21) Gift and Souvenir Shops. (22) Hotels. Show or Exhibition. Snack Shop. Sport Fishing Concession. Studio (including art, dancing, design, drama, modeling, music, photography, portrait painting). (41) Theaters. (42) Tobacco Shops. (h3) Toy Shops. (44) Trains (minature) (45) Wearing Apparel Shops. ( 46 ) Zoo s . (47) Other Main Uses: Any other use or service similar to the uses above listed in this section, in type of goods or services sold, in business hours, in number of persons or cars to be attracted to the premises, which the City Council shall find and determine is compatible with and not detrimental to any of the foregoing and above mentioned uses, and which will promote the public welfare, peace, health and safety. Before any such other uses shall be made of property in a "C-A,n Commercial Amuse- ment Zone, an application therefor shall be made to the City Planning Commission and hearings shall be had and conducted thereon in the same manner and according to the same provisions as hearings upon appli- cations for variance permits for non-conform- ing uses. -3- r D. Uses expressly prohibited: The following uses are expressly prohibited in the -C-A- zoning district: 1. Industrial uses other than indicated in Section 9200.lO-C (above). 2. Residential use. (other than that for security and required maintenance personnel). 3. Commercial uses other than those listed above. E. Building height: No maximum. F. Area regulations: The following area regulations shall apply to all property in the -C-A" zoning districtl 1. Front yard: There shall be a front yard of not less than ten (10) teet extending across the full width of all property included in the zone. 2. Side 1U'd1 When abutting a residential zone there shall be a side yard of not le.8 than ten (10) feet in width, extending from the tront yard or front property line to the rear yarQ or rear property line of the property in the ft~_ Sloning district. 3. Rear 18I'd: a. When abutting a residential zone said property shall have a rear yard of not less than one hllIldred (100) feet in width extending across the full width Gf the -C-A- zone. b. Said rear yard may be used for off-street parking. All storage shall be wi thin an entirely enclosed building or below the height of the surrounding walls. .. Lot area: No IIlinilll.lllll. 5. Parking areas required: a. The provisions of Section 9200.14-A-2-a shall apply to all uses in the ftC-Aft zoning district. ~ b. The provisions of Section 9200.12-A-2-b for improve- Ment of parking areas shall apply to all uses in the "C-Aft zoning district. c. The parking requirements of this section may be satis- fied either on the lot lIi th the building served or on a lot contiguous thereto. -4- - 6. Between uses in the wC-A. zone and residential dis- tricts. Where such a boundary is a side property line, the wall shall be reduced in height to three (3) feet within the front yard setback area for the residential zone. 7. Signs. No sign or outaeor advertising shall be permitted in this zone. 8. Architectural review. Such reTiew is required for all buildings and structures to be placed on the land in the fte-Aft District. See Sec- tion '200.9-B-l. AND BE IT FURTHER RESOLVED that the City Planning Commission be, and it is hereby, requested to hold and con- duct hearings and consider the amendment of Article IX, Chapter 2 of the Anaheim Municipal Code and the establishment of a "C-A," CommercIal Amusement Zone, as herein set forth, and to make a recommendation thereon to the City Council, and that said hearings be had and conducted and said report and recommendatIon be made to the City Council as soon as possible.
