RESULUTION NO. 4012
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING VAR[ANCES NOS.
765, 766 AND 768, AND DENYING VARIANCE
NO. 767.
WHEREAS, the City Planning Cpmmission or the City of
Anaheim did receive petitions rrom the property owner and/or
Lessee or certain real property situated in the City of Ana-
heim, County or Orange, State of California, described as
rollows: .
Variance No. 765 - Northeast corner or Lincoln
Avenue and Highway No. 39;
Variance No. 766 - North side or Lincoln Avenue,
520 feet East or Magnolia Avenue;
Variance No. 767 - North side of Lincoln Avenue,
664 f'eet West of' Dale Avenue;
Variance No. 768 - Northeast corner of Dale and
Lincoln Avenues.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City or Anaheim upon
said petitions on July 1, 1957, notices of' which said public
hearing were duly given as required by law and the provisions
of' Section 9200.17 of' the Anaheim Municipal Code; and
WHEREAS, said Commission, af'ter due inspection, investi-
gation and studies made by itself' and in its behalf' and after
due consideration of' all evidence and reports orrered at said
hearing, did adopt its Resolution No. 261, recommending to the
City Council of' the City of' Anaheim that Variances Nos. 765, 766,
767 and 768 be granted upon the conditions stated in said reso-
lution; and
WHEREAS, therearter, within twenty (20) days f'rom the
date of' the adoption or said resolution, the City Council did
elect, upon its own motion, to review the action taken by the
City Planning Commission in granting said variances and did set
a public hearing thereon to be held on the 30th day or July,
1957, at 7:00 o'clock P.M. in the City Hall in the City of Ana-
heim, and notice of such public hea~ing was duly' given as re-
quired by law and the provisions of' Section 9200.17 of the Ana-
heim Municipal Code; and
WHEREAS, arter due investigation and studies made by
itself' and in its behalf, and arter due consideration of all
the evidence and reports of'f'ered at said hearing, the City
Council does find, as to Variances Nos. 765, 766 and 768, that:

1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of' use in the same vicinity and zone.
2. That such variances are necessary for the pre-
servation and enjoyment of a substantial property

right possessed by other property in the same
vicinity &nd zone and denied to the property in
question.

That the granting of such .variances will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicini ty &;nd zone in ,,[hich the property is located.
That the granting of such varianceS will not ad-
versely affect the comprehensive general zoning
plan,

and does further find, as to Varianoe No. 767, that:
1. There is no substantial property right possessed
by other property in the s,ame vicinity and zone
and denied the SUbject property.
2. It appears that the subject property can be ade-
quately developed and used under the present zone.
NOW, THEREFORE, BE IT RESO~VED by the City Council of
the City of Anaheim that the action of the City Planning Commission
granting Variances 1\os. 765, 766 and 768, requesting permission to
erect temporary directional signs at the respective locations
hereinabove described, be and the same is, hereby sustained, and
that said Variances Nos. 765, 766 and 768 be, and the same are,
hereby granted subject to the following conditions:
1. Size of sign to be 10 ft. by 25 ft., EXCEPT that
for Variance No. 766 the size of the sign shall
be 10 ft. by 12 ft.
2. Sign to be at least 6 feet off the ground.
3. Name of company to be on sign.

Permit to be obtained from Building Department.
Ifaxifilum Deriod for installation and maintenance
of sign, six (6) monthr: from date hereof.
Minimum setback of 10 feet from right-of-way line
required.
Sign to be set back 25 feet from corner.
No sign variance shall be allowed for tracts outside
the City Limits.
Permit fee $25.00 per sign.
The City Council hereby reserves the right to revoke
such variance Dermits for good cause or failure of said Lessee,
its successors or assigns, to comply with the Anaheim Municipal
Code and regulations and the conditi~ns herein. Said Variances
Nos. 765, 766 and 768 are grantecl for the term of six (6) months
from date hereof.
