RESOLUTION NO. .3990
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DErITING VARIANCE NO. 762
W~;AS, the City Planning Commission of the City
of Anaheim did receive a petition from the owner of certain
real property situated in the City of Anaheim, County of
Orange, State of California, described as follows:
The North 75 feet of the following:
Beginning at a point in the West line
of the Southeast quarter of Section
22, Township 4 South, Range 10 West,
S. B. B. & M., said point being lo-
cated 639.26 feet South 00 14' 30"
East, from the center of said Section
22, said center point being the in-
tersection of the center line of Cer-
ritos Avenue from the Hewt with the
North and South quarter Section line
of said Section 22, running thence
North 890 55' 30" east, 660.75 feet
to a 1 inch iron pipe as shown on a
ma~) filed in Book. 15, page 4, Record
of Surveys, in the office of the County
Recorder of Orange County; thence
South 00 14' 45" East 165 feet along
the Southerly extension of and the East
line of the Northwest quarter of the
Northwest quarter of the Southeast
quarter of said Section 22; thence
South 890 55' 30" West, 660.77 feet
to a point in the West line of the
Southeast quarter of Section 22;
thence North 00 14' 30" West 165 feet
to the point of beginning.
AND .dHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anahe~m on
June 17, 1957, notices of which se.id ;Jublic hearing were
duly given, as required by 1 a.,,, and the provisions of Section
9200.17 of the Anaheim Municipal Code; and
w~REAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in
its behalf, and c.fter due consideration of all evidence and
reports offered at said hearing, did adopt Resolution No.253--
Series 1956-57, recommending that Variance No. 762 be granted
upon the conditions therein set forth; and

'dHEH:AS, thereafter, vlithin twenty (20) days from
the date of the ado'Jtion of said re solution a written appeal
was filed with the City Council of the City of Anaheim protest-
ing the action of the City Planning Commission granting said
variance, and said a\))eal "'as set for oublic hearing on the
16th day of July, 1957, at 7:00 o'clock P. M" in the City
Hall in the City of Anaheim, and notice of such public hearing
was duly ,';iven a.s required by la" a.nd the provisions of Section
9200.1(' of the Anaheim 1.1unic.ipal Code; a.nd

vv'HERF:AS, after due investigation and studies made
by itself and in its behalf, anQ after due consideration of
all the evidence and reports offered at said hearing, the
City Council does find that:
1. There is no substantial uroperty
right possessed by other property
in the same vicinity and zone and
denied the sUbject property.
2. It appears that the subject property
can be adequately developed and used
under the present zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission granting Variance No. 762 requesting permission to
construct swimming displays, a sales office and a commercial
swimming pool on the property hereinabove described, be, and
the same is hereby disapproved, and that Variance No~ 762 be,
and the same is hereby, denied.
THE FOREGOING RESOLUTION is approved and signed by
me this 16th de,y of July, 1957.
