RESOLUTION NO. 3972

A RESOLUTION OF THE CIT~ COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE EXECUTION
AND DELIVERY OF A GRANT DEED TO JAY W.
DE DAPPER AND MARGUERITE W. DE DAPPER.
WHEREAS, the City of Anaheim did enter into a Lease
with REDEL INCORPORATED, a corporation, of certain real property
owned by the City of Anaheim, which property is situated in the
City of Anaheim, County of Orange, State of Oalifornia, and
more particularly described as follows:
The westerly 1}0 feet of the southerly 191 feet of
that Darcel of land located in the City of Anaheim,
County of Orange, State of California and being a
portion of the Southeast quarter (SEi) of Section },
Township 4 South, Range 10 West, S.B.B .&M., describ-
ed as follows:
Beginning at the Northeast corner of the Schaffer
Oswald Subdivision as shown on a map thereof in Book
7, page 41 of Miscellaneous Maps of said Orange County,
California; thence westerly along the north line of
said subdivision, 785 feet, more or less, to a point,
said point being 30 feet easterly of the monumented
center line of No~th Olive Street; t~ence northerly
667.15 feet, more or les8, to the south line of the
land conveyed to Cal-Juices, Inc. by deed recorded
January 26, 1938 ane. filed in Book 922, page 262 of
Official Records of said Orange County; thence east-
erly 742.05 feet, more or less, to the westerly line
of the right of way of the main line of the Los
Angeles and Salt Lake Railroad Company (now known as
the Atchison, Topeka and Santa Fe Railroad) in the
Southeast quarter (SEt) of said Section 3; thence
southerly 251.91 feet, more or less, along said right
of way line which forms a curve, concave easterly with
a radius of 576.65 feet to its intersection with the
east line of the west half (Wi) of the Southeast
quarter (SEt) of said Section 3; thence southerly
along said east line 419.10 feet, more or less, to the
point of beginning,
which Lease was authorized by Resolution No. 3450; and
WHEREAS, by the terms of said Lease, the Lessee, by
Paragraph 24 of said Lease, was granted the option to purchase
said before described property for the sum of Eight Thousand
Five Hundred Frfty anc1 30/100 DoJlars ($8,550.30); and
WHEREAS, the Lessee was granted permission by Para-
graph 25 of said Lease to assign the Lease with the option to
purchase to Jay \'1. De DaDper; and

WHEREAS, the Lessee, Redel Incorporated, did assign
the Le~se and Option to Purchase the before described property
to Jay W. De Dapper on the 20th d&:1 of May, 1957; and
WHEREAS, Jay 'd. De Dapper, aE assignee, did notify

the City of Anaheim of his interest as assignee and did notify
the City of Anaheim of his intention to exercise the option; and
WHEREAS, the sum of $8,550.)0 was deposited with the
Bank of America National Trust and S~vings Association, Anaheim
Branch, 150 East Center Street, Anaheim, California, as Escrow
Holder to be paid to the City of Anaheim upon execution and
delivery of a Grant Deed; and
WHEREAS, the City Council of the City of Anaheim did,
by motion, authorize the City Administrator to enter into the
before mentioned escrow on behalf of the City of Anaheim; and
WHEREAS, the Title Insurance and Trust Company did
recommend that the proper legal description to be inserted in
the Grant Deed be as-follows: '
The Westerly 130.00 feet of the Southerly 191.00 feet
of that portion of the Southeast quarter of Section ),
Township 4 South, Ranse 10 West, in the Rancho San
Juan Cajon de Santa Ana, city of Ana.heim, county of
Orange, st~te of California, as oer map recorded in
book 51 page 10 of HiscelJ.aneous Maps, in the office
of the county recopder of said county, bounded as
follows:
On the south by the north line of the Schaffer-Oswald
Subdivision, as per map recorded in book 7, page 41
OI~ Eiscellaneou.s Haps of said cou.nty.
On the weot by the east line of North Olive Street as
described in deed to the city of Anaheim, reoorded
May 27, 1938 in book 943, oage 122 of Official Records.
AND WHEREAS, such legal description is the same
property as that covered in the Lease description.
NOW THEREFORE, the City Council of the City of Anaheim
does hereby direct and authorize the Mayor and the City Clerk
of the City of Anaheim for and on behalf of the City of Anaheim
to exeoute a corporation Grant Deed to the property as described
by the Title Insurance and Trust Company, subject to all General
and Special Taxes for the fiscal year 1957-1958 and also subject
to covenants, conditions, restrictions, reservations, rights,
rights of way and easements of record, and does further authorize
the City Clerk to deliver such Grant Deed for and in behalf of
the City of Anaheim to the Bank of America National Trust and
Savings Association as escrow holder to be delivered to Jay W.
De Dapper and Marguerite W. De Dapper, husband and wife, when
said escrow holder can pay to the City of Anaheim the sum of
$8,550.)0 less seller's normal escrow and title charges.
