RESOLUTION NO. 3923

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING VARIANCE NO. 752.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive a petition from the owners of certain
real property situated in the City of Anaheim, County of
Orange, state of California, described as follows:
The North 2 acres of the South 9 acres of
the West half of the Southwest quarter of
the Northeast quarter of Section 7, Town-
ship 4 South, Range 10 West, S.B.B.&M.
AND WHEREAS, the City Planning Commission did hold
a pUblic hearing at the City Hall in the City of Anaheim upon
said petition on May 20, 1957, notices of which said public
hearing were duly given as required by law and the provisions
of Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf
and after due consideration of all evidence and reports
offered at said hearing, did adopt its Resolution No. 236
Series 1956-57, hereinabove referred to, recommending to
the City Council of the City of Anaheim that Variance No. 752
be granted; and
WHEREAS, thereafter, within twenty (20) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council of the City of Anaheim pro-
testinG the action of the City Planning Commission granting
said variance, and said appeal was set for public hearing on
the 11th day of June, 1957, at 7:00 o'clock P.M., in the City
Hall in the City of Anaheim, and notice of such public hearing
was duly given as required by law and the provisions of
Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said publiC
hearing, the City Council did duly hold and conduct such public
hearing and did give all persons interested therein an opportun-
ity to be heard and did receive evidence and reports,. and did
thereupon consider the recommendations of the City Planning
Commission; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
doe s find tha t :

1. There is no substantial property right possessed
by other property in the same vicinity and zone
and denied the Bubject property.
2. It appears that the subject property can be
adequately developed and used under the
present zone.

NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission granting Variance No. 752, requesting permission
to erect a modern building on the property hereinabove
described to be used for a rest home, be, and the same is
hereby disapproved, and that Variance No. 752 be, and the
same is hereby, denied.
THE FOREGOING RESOLUTION is approved and signed by
me this 11th day of June, 1957.
