AN ORDINANCE OF THE CITY OF ANAHEIM ADDING
CHAPTER 1.24, CONSISTING OF SECTIONS 1.24.010
THROUGH 1.24.030, INCLUSIVE, TO TITLE 1 OF THE
ANAHEIM MUNICIPAL CODE RELATING TO ESTABLISHMENT
OF A CRIMINAL JUSTICE ADMINISTRATION FEE
THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS
AS FOLLOWS:
SECTION 1.
That new Chapter 1.24 be added to Title 1 of the Anaheim
Municipal Code, to read as follows:
"CHAPTER 1.24
CRIMINAL JUSTICE ADMINISTRATION FEE
SECTION 1.24.010 FEE IMPOSED
Any person who is arrested by an officer or agent
of the City of Anaheim or who is booked or processed to the
detention facility of the City of Anaheim, and who is
subsequently convicted of any offense related to the
arrest, other than an infraction, shall pay to the City a
criminal justice administration fee, for reimbursement of
administrative expenses incurred by the City in connection
with the arrest and/or booking or processing. The amount
of the fee shall be in accordance with a fee schedule
adopted from time to time by resolution of the City
Council.
SECTION 1.24.020 COLLECTION OF DEBT
If the judgment of conviction includes an order
for payment of the criminal justice administration fee owed
to the City, it may be collected by any means provided by
law for the enforcement of judgments. If the judgment of
conviction fails to includes an order for payment of the
criminal justice administration fee, the City Attorney may
either obtain amendment of the judgment or the City may
prosecute a civil action to collect the debt.
SECTION 1.24.030 USE OF FEES
All fees collected pursuant to this chapter shall
be deposited into the General Fund and may be used for any
lawful purpose."
SECTION 2. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance of the Code, hereby adopted, be declared for any reason to
be invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the elimination
herefrom of any such portion as may be declared invalid.
SECTION 3. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal of
any other ordinance of this City shall in any manner affect the
prosecution for violations of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as a
waiver of any license or penalty or the penal provisions applicable
to any violation thereof. The provisions of this ordinance, insofar
as they are substantially the same as ordinance provisions previously
adopted by the City relating to the same subject matter, shall be
construed as restatements and continuations, and not as new
enactments.
