RESOLUTION NO. )890 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2, OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim did fix a time and place for the holding of a pUblic hearing to consider a proposed change in the boundaries of the zone or zones hereinafter mentioned and described, in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hear- ing, and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts, but made no recom- mendation as to the proposed changes in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of the report of the City Planning Commission, the City Council did thereupon fix the 2)rd day of April, 1957, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports from persona interested therein and did continue said hearing to May 21, 1957; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to different zones as hereinafter set forth, is more suitable for the zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, state or Calirornia, described as follows, to wit: .c- Lot 19 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map of survey made by William Hamel and filed in the office of the County Recorder of Los Angeles County, California. (Said property is located at the Northeast corner of Ball Road and East Street and comprises approximately 55 acres.) -1- ';;;'. !>-'" - :--~-- - -- ,--" be changed from R-A. ~SIDIN~IAL-AGRICUL~URALZONE, to the followi~ zones, upon the 'conditions hereinafter set forth: That that portion of subject property measuring 1435 feet, more or less, in width from the cent~r line of Ball Road be reclassified M-l, LIGHT MANUFACTURING ZONE; and that the remainder of the property be changed to R-l, SINGLE FAMILY RESIDENTIAL ZONE, the dividing line between the two zones to be parallel with Ball ROadj and that said change in zones be made subject to the following conditions: 1. That the owners of subject property place of record appropriate ~l Deed Restrictions as required by the City of Anaheim and approved by the City Attorney. 2. That all engineering requirements of the City of Anaheim be complied with as required by the City Engineer. 3. That the owners of subject property deed to the City of Anaheim a strip of land 50 feet in width measuring from the center line of the street, along Ball Road for street widening purposes. 4. Said change of Zone shall not become effective unless within sixty days, or such further time as the Council may grant, the restrictions herein required to be im- posed upon the property shall have been executed by the owners of the property, submitted to the City for approval and filed of record, nor until deeds for Street widening or utility purposes, when required, have been executed and delivered to the City.
