57R-3886 - -",.-.. RESOLUTION NO. 3886 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 734. WHEREAS, the City Planning Commission or the City or Anaheim did receive a petition from the owner or certain real property situated in the City or Anaheim, County of Orange, State of Calirornia, more particularly described and set forth in said Petition ror Zoning Variance, Application No. 734, and in Resolution No. 211--Series 1956-57 of the City Planning Com- mission; and WHEREAS, the City Planning Commission did hold a pub- lic hearing at the City Hall in the City of Anaheim upon said petition on April 22, 1957, notices of which said public hear- ing were duly given as required by law and the provisions or Section 9200,17 or the Anaheim Municipal Code; and WtlEREAS, said Commission, arter due inspection, in- vestigation and studies made by itselr and in its behalr and after due consideration of all evidence and reports orfered at said hearing, did adopt its Resolution No. 211-Series 1956-57, hereinabove referred to, recommending to the City Council of the City of Anaheim that Variance No. 734 be granted; and WHEREAS, therearter, within twenty (20) days rrom the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 1st day of May, 1957, at 7:00 o'clock P.M. in the City Hall in the City or Anaheim, and notice or such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Munici- pal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did there- upon consider the recommendations of the City Planning Commission and did close said hearing and declare that further action would be taken at a later date; and ~IEREAS, arter due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does rind that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be ade- quately developed and used under the present zone. ~. ..........." NOW, THEREFORE, BE IT RESOL\~ by the City Councilor the City of Anaheim that the action of the City Planning Commis- sion granting Variance No, 734, requesting a waiver from 70 feet to 60 feet of the lot frontage requirements in Tract No. 3160, as set forth in Application for Zoning Variance No. 734, be and the -1- - same is hereby, disapproved, and that Variance No. 734 be, and the same is hereby, denied. .".-.
