A RESOLUTION OF THi OITY OOUNaIL OF THE
OITY OF ANAHEIM AOCEPTING A 8lALED PROPOSAL
AND AWARDING A CONTRACT TO THl; LOWEST RES-
PONSIBLE BIDDER FOR THE FURNI$HING OF ALL
PLANT, LABOR, SERVICES, MATERllAL8 AND EQUIP-
MENT AND ALL UTILITIES AND TR4NSPORTATION,
INCLUDING POWER, FUEL AND WATER, AND PER-
FORMING ALL WORK NECESSARY TO CONSTRUCT AND
OOMPLETE THE FOLLOWING PUBLIC IMPROVEMENT:

WHEREAS, the Oity Oounoil of the Oity of Anaheim did
oaus. to be pUblished in a newspaper of general oiroulation,
printed, published and oiroulated in the Oity of Anaheim, to
wit: The Anaheim Bulletin, on the 2nd day of Mav and 8th"day of ..,.
19 57 ,a notioe inviting sealed proposals for furnishing
the following:
All plant, labor, services, materials and equipment, and all
utilities and transportation, including power, fuel and water,
and performing all work necessary to construct and complete in
a good and workmanlike manner, in strict accordance with the
9pecifications, plans and drawings therefor on file in the
office of Ghe City Clerk or the City Engineer of the City of
Anaheim, the followinG public improvement, to l,it: The Improve-
ment of Citron Street, from La Palma Avenue to North Street,
consisting of exce.vation, Davin2' with 4- inches of plant-mix
paving, adjustinG existing manholes to grade and appurtenant
work, as indicated on the plans, Job No. 145,
in aooordance with the designs, plans, prOfiles and speoifications
of said public improvement on file in the Office of the City Olerk
of the Oity of Anaheim; and
WHEREAS, said notice inviting sealed proposals for said
pUblio improvement did provide that sealed proposals would be reoeived
by the City Council of the City of Anaheim at the Office of the Oity
Olerk of the City of Anaheim up to the hour of 7:00 o'olook P.M. on
the l4th day of May , 195-2-for the furnishing of all
plant, labor, servioes, materials and equipment, all utilities and
transportation, inoluding power, fuel and water, and performing all
work necessary to construot and complete, in a good and workmanlike
manner, the pUblic improvement hereinabove more partioularly mentioned
and desoribed and which notice did state and declare that pursuant
to the provisions of Seotion 1770 of the Labor Code, the Oity Counoil
of the City of Anaheim had ascertained the prevailing rate of wages
in the locality in which this type of labor is to be performed for
each craft or type of workman or mechanic needed to execute the oon-
tract and did set forth the prevailing hourly wage seale so asoertained;
and
~, WHEREAS, the City Council of the City of Anaheim did receive
the following eealed proposals prior to 7:00 olclock P. M. on the
14th day of May , 195-2--, in response to the notice
aforesaid inviting sealed proposals, to wit:

WHERIAS, the Clty Counol1 did thereupon reteI' said blds to

did examine and tabulate said sealed proposals and did report to the
Oounei1 the re.ult of his examination and tabulatlon; and
WHEREAS, the C1ty Counol1 tlnds that the sealed propo.a1 sub-

is the lowest responsible proposal submitted tor the furnish1ng ot all
plant, labor, servioes, materials and equipment, all utilities and
transportation, inoluding power, fuel and water and performing all work
neeeasary to oonstruot and complete in a good and workmanlike manner
in striot acoordance with the specifications, plans and drawing.
therefor on tile in the office of the Oity Clerk of the C1ty of Ana-
heim of the publiC improvement hereinabove mentioned and desorlbed,
together with the appurtenanoes thereto, and as speoified in the
notioe inviting sealed proposals, and that said proposal of sald
above named bidder should be accepted and a contraot awarded to sald
bidder in aocordanoe therewith; and
WHERIAS, the City Council finds that the above mentioned
sealed proposal is the lowest responsible proposal received and that
the person, firm or corporation submitting said proposal is a
responsible person, firm or oorporation and that the proposal sub-
mitted is the best suited and fitted for the public improvement to
be oonstruoted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM, that the sealed proposal submitted by

for the furnishing of all plant, labor, services, materials and
equlpment, all utilities and transportation, inoludlng power, fuel
and water and performing all work necessary to oonstruot and oomplete
in a good and workmanlike manner, in striot accordanoe with the
speclfioations, plans, and drawings therefor on file in the ortlce
at the Oity Olerk of the City of Anaheim and the notice inviting
sealed proposals, the public works and improvements hereinabove more
partioularly mentioned and desoribed, together with the appurtenanoes
thereto, be, and the same is hereby, accepted, and that a oontraot
for the construotion and completion of said pUblic improvement be,
and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the suooessful bidder or
bidders upon each oontract awarded as hereinabove set forth shall
be, and they are hereby required to exeoute a contraot in the required

form with the City of Anaheim upon the terms and oonditions speoified
in the notice inviting sealed proposals and the proposal submitted
by said sucoessful bidder or bidders and in accordance with the plans
and specifioations for said public improvement hereinabove described
and in accordance with the terms, conditions and provisions of this
resolution, and that said successful bidder or bidders to whom each
contraot is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (100%) of the contract price for
all labor, materials and equipment to be fv.rnishe,d and performed as
set forth in the sealed proposals submitted by said bidder for the
construction of said pUblic improvement together with the appurtenances
thereto or such portion thereof as is covered by said contract as
security for the faithful performance of said contract and a separate
surety bond in an amount equal to one hundred per cent (100%) of the
conatruct.1on coat of said public improvement covered by said oontraot
as secUrity for the payment of all persons performing labor and furn-
ishing material for said project.
AND BE IT FURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby required to furnish to the City of
Anaheim in companies satisfactory to the City of Anaheim public
liability, property damage, compensation, and other insuranoe in
the amounts and for the purposes as set forth and specified in the
notioe inviting sealed proposals and subjeot to the approval of the
City Attorney as to form and sufficienoy.
AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk
of the City of Anaheim be, and they' are hereby, authorized and direoted
to make, exeoute and enter into for and on behalf of the City of Ana-
heim a written contract with said successful bidder or bidders for the
furnishing of all plant, labor, materials, and equipment and performing
all work as hereinabove more particularly described for the construc-
tion, installation and completion of said public improvement herein-
above described upon the terms and conditions as specified in the
notice inviting sealed proposals, the detailed design, plans, profiles,
draw1ngsand general specifications and detailed specifications and
drawings and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the office
of the Oity Olerk of the City of Anaheim and in striot accordanoe with
the terms, conditions and provisions of this Resolution, and in accord-
anoe with all the contract documents herein specified.
THE FOREGOING RESOLUTION is signed and approved by me this
