A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINALLY ACCEPTING THE COMPLETION
AND 'I'HE FURNISHING OF ALL PLAN!, LABOR, SER-
VIOES, MA'l'ERIALS AND EQUIPMENT AND ALL UTIL-
ITIES AND TRANSPOR'I'ATION INOLUDING POWER,
FUlL AND YATER, AND PERFORKING ALL WORK

WHEREAS, the City Council of the Oity of Anaheim did cause to
be pub~ished in a newspaper of general ciroulation, printed, pub~iahed
and ciroulated in the City of Anaheim, to wit: The Anaheim Bul~etin,

All plant, labor, services, materials and equipment,
and all utilities and transportation, including
power, fuel and water, and performing all work neces-
sary to construct and complete, in a good and work-
manlike manner, in strict accordance with the snecifi-
cations, plans and drawings therefor on file in~the
Office of the City Clerk or the City Engineer, the
following public improvement: The construction and
completion of Fire Station No.3, on South Manchester
Avenue between Midway Drive and Katella Avenue con-
sisting of 3300 sq. ft. in area, single story, 'wood
frame, concrete slab floor, laminated wood beams,
metal flashing, exterior and interior plaster finish,
metal sashes, power operated overhead door, asphalt
tile, wood cabinets, ceramic tile, forced air heat-
ing system, toilet partitions, plumbing, electrical
and all appurtenant work, as indicated on the plans,

did state and declare that, pursuant to the provisions of Section 1770 ot
the Labor Code, the City Oounoil of the Oity ot Anaheim had asoertained
the prevailing rate of wages for eaoh type of ~abor needed to exeoute
sa1d oontract and did set forth the prevailing hourly wag. soale so asoer-
tained; and
WHEREAS, at a regular meeting of the Oity Oounoil held on the
9th day of ictober , 19~L, at the hour of ~ololook
P.M. of said da e, sa1d Oity Oounorr-aid hold a publio ~tor the
purpose of opening sealed proposals received up to that time, tor the
furnishing of all plant, labor, servioes, materials, and equipment, and
all utilities and transportation, inc~ding power, fu.~ and water, and per-

forming all work necessary to construct and oomplete, in a good and
workmanlike manner, in strict accordance with the speoifioations,
plans and drawings therefor on file in the office of the City Clerk
of the City of Anaheim, of the public improvement hereinabove more
particularly desoribed and set forth; and
WHEREAS, the City Counoil did thereupon refer said bids to
the City Engineer for examination,
tabulation and report to the City Council, and said City Engineer
did thereupon examine and tabulate said sealed
proposals and report the result of his tabulation to the City Counoil;
and
WHEREAS, the City Council did meet in regular
session on the 9th day of October , 19 56 ,at the hour
of 7: 00 0 I clock P. M. to consider the sealed proposals submitted
for furnishing materials and performing the work hereinabove more
particularly described and set forth, and the Ci~ En~ineer
of the City of Anaheim did t ereupon make his
report and submit his tabulation of said sealed proposals, and the
City Council did thereupon find and determine that the sealed proposal
submitted by R. L. STEINMETZ, 1415 West Eighth Street. Santa Ana.
California
for the construction, installation and completion of said

hereinabove mentioned and described was the lowest responsible pro-
posal submitted therefor, and thereupon aocepted said bid and did
award a contract to said R. L. STEINMETZ
for furnishing all plant, labor, services, materials and
equipment and all utilities and transportation, including power, fuel
and water, and performing all work necessary to construot and complete,
in a good and workmanlike manner, in strict acoordance with the speoi-
fications, plans, and drawings, the said public improvement as specified
in said notice inviting sealed proposals, and did authorize the Mayor
and the City Clerk of the City of Anaheim to execute a contract for and
on behalf of the City of Anaheim with R. L. STEINMETZ
, which said contract was duly made
and entered in to on the 11th day of October , 19..2,L; and
WHEREAS, the said R. L. STEINMETZ
has furnished all plant, labor, services, materials
and equipment and all utilities and transportation, and performed all
work necessary for the construotion and completion, in a good and work-
manlike manner, in strict accordance with the specifications, plans,
drawings, of said public improvement as specified in the notioe inviting
sealed proposals and in the detail, design, plans, profiles, drawings
and specifications prepared by Rowland & Johnston, Fred V. Johnston,
Architect , and the contract made and entered into with him
by the City of Anaheim; and

WHEREAS, the City Engineer

WHEREAS, the City Council finds that said contractor has com-
pleted said public improvement hereinabove more partioularly described
in accordance with the provisions of the contract and the contract
~. documents, and that notioe of completion should be filed and payment
of the balance due said contractor authorized in accordance with the
contract doouments.
NOW, THEREFORE, BE IT RESOLVED by the City Counoil of the Oity
of Anaheim that all plant, labor, services, materials and equipment

and al1 uti1ities and transportation, and the performance of a11
work necessary to construct, insta11 and comp1ete, in a good and
workman1ike manner, in strict accordance with the specifications,
plans and drawings therefor on file in the office of the City
Clerk of the City of Anaheim, together with the appurtenances
thereto of said public improvement hereinabove more particularly
described and set forth, in the City of Anaheim, by said con-
tractor, be, and the same are hereby, accepted, subject, neverthe-
less, to all the terms, conditions and provfsions Of the contraot
doouments, and that the balance due said contractor for said work
be paid to him thirty-flve (JS) days from and after final
acceptance of said work as evidenced by the adoption of this
resolution, but not sooner than thirty (JO) days after the date
of the filing of notioe of completion, excepting only such sum or
sums as may lawfully be withheld in accordance with the provisions
of said contract and contract documents. That acceptance by the
contractor of said payments made in accordance with saia final
estimate shall operate and shall be a release to the Oity of
Anaheim, its officers, a.€;end and employees from all claims and
liabilities due the contractor for anything done or furnished or
withheld or for anything relating to the work or any act or neg-
lect of the City, its officers, agents and employees, exoepting
only claims against the City for any amounts withheld by the City
at the time of such payment.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the 01 ty of Amtheim be, and they are hereby authorized
to ex.cute and file a notice of completion of said work as required
by law. ' ,
