57R-3857 - RESOLUTION NO. 3857 r- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM INITIATING PROCEEDINGS FOR THE ANI~XATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF ANAHEIM, ON ITS OWN MOTION; DESIGNATING THE TE&~ITORY AS THE BROOKHURST AVENUE ANNEXATION; DESCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE \mERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR HEFORE THE CITY COUNCIL AND SHOW CAUSE \iHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM. WHEREAS, the City Council of the City of Anaheim has investigated certain uninhabited territory as hereinafter set forth and does find that such territory is so situated as to require facilities of the City of Anaheim to pass through such territory, B.nd does find that such territory can be easily served with the facilities of the City of Anaheim and does further find that service of other areas in the City of Anaheim will be facilitated by annexation of such uninhabited territory, and that annexation of such territory will be in the best interest of the City of Anaheim and the best interest of the &rea to be annexed; and \ffiEREAS, the City Council does hereby determine that proceedings for the annexation of the hereinafter described uninhabited territory should be initiated by the City Council on its own initiative; and WHEREAS, the proposal for the annexation of the territory hereinafter described to the City of Anaheim was submitted to the Boundary Commission of the County of Orange, State of California, and reported upon by said Boundary Commission with respect to the definiteness and certainty of the proposed boundaries; and IffiEREAS, said territory proposed to be annexed to saie City of Anaheim is situated in the County of Orange, State of California and is contiguous to the City of Anaheim and is uninhabited territory; and \fflEREAS, the City Council finds from evidence and reports received that said new territory proposed to be annexed to said City of Anaheim does not form a part of any municipal corporation and that said territory is uninhabited and is contiguous to the City of Anaheim; and ,,-. WHEREAS, the City Council finds that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: A parcel of land, being the South half (S!) of the Northeast quarter rNE~) of the Northeast quarter (NEt) of the Southeast quarter (SEt) of Section 18, Township 4 South, Range 10 West, S.B.B.&M., more particularly described as follows: -1- - r- Beginning at a point in the existing Anaheim City Limits line as established by the Orange Avenue Annexation to the City of Anaheim, passed by Ordin- ance No. 914 on August 10, 1954, and filed with the Secretary of State on October 18, 1954, said point being in the North line of the South half (S!) of the Northeast quarter (NEt) of the, Northeast quarter (NEt) of tne Southeast quarter (SE:t) of said Section 18; thence 1. Westerly along said North line 6)0 feet, more or less, to a point, said point being in the West line of said Northeast quarter (NEt) of the Northeast quarter (NEt) of the Southeast quarter (SEt) of said Section 18; thence 2. Southerly along said West line, 330.23 feet, more or less, to a point, said point being in the South line of said Northeast quarter (NEt) of the Northeast quarter (NEt) of the Southeast qUarter (SEt) of said Section 18; thence ). Easterly along said South line 6)0 feet, more or less, to a point, said point being in the exist- ing City Limits line as established by said Orange Avenue Annexation; thence 4. Northerly along said existing City Limits line 330.2) feet, more or less, to the point of beginning. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM: That the proposed annexation be and it is hereby initiated on the motion of the City Council of the City of Anaheim and that such proposed annexation be designated as uBROOKHURST AVENUE ANNEXATIONlI and th.at notice of such pro- posed annexation be hereby given as hereinafter provided. BE IT FURTHER RESOLVED that a public hearing shall be had upon the date set, not less than forty (40) nor more than sixty (60) days after the passage of this Resolution, unless the owner or owners of all of the territory to be annexed have filed their consents to such annexation, in writing, with the City Council, in which event the hearing shall be set not less than fifteen (15) days nor more than sixty (60) days after the passage of this Resolution. r AND BE IT FURTHER RESOLVED that the City Council does find that the owner or owners of all of the territory proposed to be annexed have filed their consents to such annexation, in writing, with the City Council. BE IT FURTHER RESOLVED that the 11th day of ,1957 ,at the hour of 7:00 o'clock at the City Council Chambers in the City Hall of of Anaheim be, and the same is hereby, fixed as June P. Iii., the City -2- .- -. r' the day, hour and place when and where the City Council will hear protests made by any owner or owners of real property within the territory proposed to be annexed; and that at any time before the hour set for hearing objections, any owner of property within said t~rritory may file with the City Clerk a written protest against the annexation. Said protest shall be in writing an~ shall state the name of the owner of the property affected and the description and area of the property in general terms. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once a week, in a newspaper of general circula- tion, published in the City, to wit: The Anaheim Bulletin of Anaheim, Orange County, California, and also in a newspaper of general circulation, published outside of the City, but in the County of Orange, in which is located the territory hereinabove proposed to be annexed to the City of Anaheim, to wit: The Placentia Courier of Placentia, Orange County, California; and that such publication shall be completed at least twenty (20) days prior to the date of hearing herein- above specified. A.ND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed, in the last equalized county assessment roll available, on the date the proceedings were initiated, at the address shown on said assessment roll or as kno~~ to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said Clerk; and in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, the City Clerk of the City of Anaheim shall also cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County. The foregoing notices shall be given not less than twenty (20) days before the first public hearing on the proposed annexation.
