57R-3848 ..- .- RESOLUTION NO. 3848 r-- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF Al~AHEIM ORDERING THE V~CATION AND ABANDON- MENT OF A PORTION OF CHES~NUT STREET AND AN EASE1vIENT FOR STREiT PURPOSES UPON, OVER, ACROSS AND ALONG THE HEREINAFTER DESCRIBED REAL PROPERTY. WHEREAS, the City Council .of the City of Anaheim, a munici-oal corporation of the State oif California, did on the 9th day of April, 1957, pass its Ordinance No. IlJ4, entitled /IAN ORDINANCE OF THE CITY OF ANAHEIM DECLARING THE INTENTION OF THE CITY COUNCIL TO VACATE AND ABANDON A PORTION OF CHESTNUT STREET AND AN EASEMENT FOR STREET PU!RPOSES UPON, OVER, ACROSS A},JD ALONG THE HEREINAFTER DESCHIBED REAL PROPERTY; FIXING A TIME ~~D PLACE FOR A HE~~ING THEREON; AND DIRECTING THE POSTING OF NO'l'ICES THEREOF AND THE PUBLICATION OF THIS ORDINANCE, II whereby it declared its intention to vacate and abandon and close to public use a nortion of Chestnut street and an easement for street Durposes upon, over, across and along the hereinafter described property under the provisions of the Street Vacation Act of 1941; and WHEREAS, the City Council in said Ordinance referred to a map on file in the Office of the Cit7 Clerk for further particulars as to the proposed vacation, abandonment and closing to public use of said portion of Chestnut Street and easement for street purposes; and WHEREAS, said City Council did by said Ordinance fix the 1st day of May, 1957 at 7:00 o'clock P. M. in the Council Chamber in the City Hall of the City of Anaheim as the time and p~ace for a public hearing on the matter of such vacation, aban- donment and closing tooubllc use of said portion of street and easement for street purposes, for all persons interested in or objecting to such proposed vacation, abandonment and closing to ,mblic use to appear and show cause, if any they had, why such portion of street and easement for street purposes should not be vaca ted., abandoned and closed to public use; and iiHEREAS, said Ordinance was published on the 16th day of April, 1957, in the Anaheim Bulletin, a newspaper of general circulEtion, printed, publisheo_ and circulated in the City Of Anaheim, Orange County, California; and i'lHEREAS, by said Ordinance said City Council direoted that notices of the passage of said Ordinance and of the time and place of the hearing on the matter of the vacation, abandon- ment and closing to public use of said portion of street and easement for street purposes be posted conspicuously along the lines of said portion of street and easement proposed to be vacated, not more than JOO feet apart, at least ten (10) days before said hearing, anct that not less than three (J) such notices should be posted; and .'-- WHEREAS, Calvin J. Bouse did on the 17th day of April, 1957, post conspicuously three (3) s~ch notices along the lines of said portion of street and easeme~t, which notices were posted less than JOO feet apart, and were p~sted at least ten (10) days before said hearing; and -1- --- .- I""""'"' WHEREAS, said City Council did on the 1st day of May, 1957, at 7:00 o'clock P. M., at said City Hall, conduct a public hearing on the matter of whether said portion of Chestnut Street and easement for street purposes, hereinafter described, should be vacated, abandoned and closed to public use, and at said hearing did hear evidence thereon; and WHEREAS, tne City Council finds from all the evidence submitted that that portion of Chestnut Street and easement for street purposes describ$d in the Ordinance of Intention and hereinafter described, are unnecessary for present or prospective street purposes, and that an order vacating such portion of street and easement for street pur- poses as described in the Ordinance of Intention should be made by the City Council. NOW, TBEP~FORE, BE IT RESOLVED by the City Council of the City of Anaheim: 1. That it finds the recitals hereinbefore set forth in this Resolution to be true; 2. That it finds from all the evidence submitted that said portion of Chestnut Street and easement for street purposes described in said Ordinance are unnecessary for present or prospective public purposes; 3. That it does hereby orter that said portion of Chestnut Street and easement for street purposes be, and they are hereby vacated, abandoned and closed to public use; ~'. That the said portion of street and easement for street purposes herein ordered vacated, abandoned and closed to public use are those described in said Ordinance No. 11.34, are situated in the City of Anaheim, County of Orange, state of California, and are more particularly described as follows: The Westerly 44 feet of that portion of Chestnut Street located between South Palm Street and The John C. Fremont School, being more particularly described as follows: ,,- Beginning at the Northwest corner of Lot 14, Block 2 of Vineyard Lot E-6 of the Enter- prise Tract, recorded in Book 4, page 89 of Miscellaneous Maps, Records of Orange County; running thence, Northerly 60 feet along the Westerly line of said Enterprise Tract to the Southwest corner of Lot lit, Block 1 of said Enterprise Tract; thence, Easterly along the Southerly line of said Lot 14 of Block 1, 44 feet to the Southeast corner; thence, Southerly 60 feet to the Northeast corner of Lot 14, Block 2 of said Enterprise Tract; thence, Westerly along the Northerly line of said Lot 14, Block 2, a distance of 44 feet to the point of beginning. AND BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified -2- ~. - I"""'" copy of this Resolution a.nd Order, attested by her under the seal of the City of Anaheim, to be recorded in the Office of the County Recorder of Orange Coupty, California.
