WHEREAS, the City Counoil of the City of Anaheim did

prlnted, publ1shed and oiroulated in the Oity ot Anahe1m, to

19 ~7 , a notloe inviting sealed propo$als for furnishing
the tollow1ng:
All plant, labor, services, materials and equipment, and all
utilities and transportation, including power, fuel and water,
and performing all work necessary to construct and complete
in a good and workmanlike manner, in strict accordance with
the specifications, plans and drawings therefor on file in
the office of the City Clerk of the City of Anaheim, the
following public improvement, to wit: The Center Street
Sewer Improvement, consisting of the construction of V.C.P.
sewer laterals in Center street from Placentia Avenue to
East Street, including trenching, manhole constrUction,
4-inch house connection laterals, backfill, resurfacing
and appurtenant work as indicated on the plans, Job No. 1097,
in aocordance with the designs, plans, profiles and speclfications
of said publio improvement on file in the Offioe of the City Olerk
of the City of Anaheim; and
WHEREAS, said notice inviting sealed proposals for sald
public improvement did provide that sealed proposals would be received
by the Oity Oouncil of the City of Anaheim at the Office of the 01ty
Olerk or the Oity of Amaheim up to the hour of 7:00 o'clock P.X. on
the ~1rd day of A,pril , 19.5-Lfor the furnishing of all
plant, labor, services, materials and equipment, all utilities and
tran.portation, including power, fuel and water, and performing all
work neoessary to construct and complete, in a good and workmanllke
manner, the public improvement hereinabove more partioularly ment10nea
and desoribed and which notice did state and declare that pursuant
to the provisions of Section 1770 of the Labor Code, the City Oouncil
of the City of Anaheim had ascertained the prevailing rate of wages
in the 100ality in which this type of labor is to be pertormed tor
eaoh oraft or type of workman or mechanic needed to exeoute the oon-
tract and did set forth the prevai11ng h~ur1y wage scale so asoertained;
and
r- WHEREAS, the City Council of the City of Anaheim did reoeive
the following sealed proposals prior to 7:00 o'clock P. X. on the

together with the appurtenanoes thereto, and as apeoitied in the
notloe inviting sealed proposals, and that said proposal ot sald
above named bidder should be aooepted and a oontraot awarded to said
bidder in aooordanoe therewith; and
WHEREAS, the City Council finds that the above mentioned
sealed proposal is the lowest responsible proposal received and that
the person, firm or corporation submitting said proposal is a
responsible person, firm or oorporation and that the proposal sub-
mitted is the best suited and fitted for the public improvement to
be oonstruoted.
NOW, THEREFORE. BE IT RESOLVED BY THE CITY OOUNCIL OF THE
CITY OF ANAHEIM, that the sealed proposal submitted by ELMER E. BARNETT,

thereto, be, and the same is hereby, aooepted, and that a oontraot

and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the suooessful bidder or
bidders upon each oontraot awarded as hereinabove set forth shall
be, and they are hereby required to exeoute a oontraot in the required

torm with the Oity of Anaheim upon the terms and oondit~ons specified
in the notioe inviting sealed proposals and the proposal submitted
by said suocessful bidder or bidders and in accordance with the plans
and specifioations for said public improve~ent hereinabove desoribed
and in accordanoe with the terms, conditions and provisions of this
resolution, and that said successful bidaer or bidders to whom each
contract is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (100%) of the oontraot price for
all labor, materials and equipment to be furnished'and performed as
set forth in the sealed propOsals submitted by said bidder for the
oonstruotion of said pUblio improvement together with the appurtenances
thereto or suoh portion thereof as is oovered by said contraot as
seourity for the faithful performanoe of said contraot and a separate
surety bond in an amount equal to one hundred per oent (100%) of the
construction cost of said pUblio improvement covered by said contract
as seourity for the payment of all persons performing labor and furn-
ishing material for sai~ proJeot.
AND BE IT FURTHER RESOLVED that said suocessful bidder or
bidders be, and they are hereby required to furnish to the Oity ot
Anaheim in oompanies satisfaotory to the Oity of Anaheim public
liability, property damage, compensation, and other insuranoe in
the amounts and tor the purposes as set forth and speoified in the
notice inviting sealed proposals and subJeot to the approval of the
City Attorney as to form and suffioienoy.
AND BE IT FURTHER RESOLVED that the Mayor and the City Olerk
of the Oity of Anaheim be, and they are hereby, authorized and direoted
to make, exeoute and enter into for and on behalf of the City ot Ana-
heim a. written oontraot with said sucoessful bidder or bidders tor the
furn1shing of all plant, labor, materials, and equipment and performing
all work as hereinabove more partioularly desoribed for the construo-
tion, installation and oompletion of said publio improvement herein-
above desoribed upon the terms and conditions as speoified in the
notioe inviting sealed proposals, the detailed design, plans, profiles,
drawings and general speoifications and detailed speoifications and
drawings and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the offioe
of the Oity Olerk of the City of Anaheim and in strict acoordanoe with
the terms, oonditions and provisions of this Resolution, and in accord-
ance with all the contract doouments herein speoified.
