WHEREAS, the 01ty Oouncil of the City of Anaheim did

All plant, labor, services, materials and equipment, and all
utilities and transportation, including power, fuel and water,
and performing all work necessary to construct and complete in
a good and workmanlike manner, in strict accordance with the
specifications, plans and drawings therefQr on file in the
office of the City Clerk of the City of Anaheim, the following
public improvement, to wit: The Har~or Boulevard Sewer Improve-
ment, consisting of the construction of a vitrified cl&7 pipe
and a cast iron pipe in Harbor Boulevard from Katella A~enue to
1840 feet South of Katella Avenue, including trenching, manhole
construction, backfill, resurfacing and appurtenant work, as
indicated on the plans, Job No. 1096,
in aooordanoe with the designs, plans, priotiles and speoifioations
of said publio improvement on file in the Office of the Oit7 Olerk
of 1;he Oity of Anaheim; and
WHEREAS, said notice inviting se~led proposals for sald
public improvement did provide that sealed proposals would be reoeived
07 the Oit7 Oouncil of the Oity of Anahei. at the Office of the 01ty
Olerk of the Oity of Anaheim up to the hour of 7:00 o'olook P.X. on

plant, labor, services, materials and equipment, all utilities and
transportation, inoluding power, fuel and water, and performing all
work neoessary to oonstruot and complete, in a good and workmanlike

and desoribed and wh1ch notice did state and declare that pursuant
to the provisions of Seotion 1770 of the Labor Code, the Oity Counoil
ot the City ot Anahe1m had asoertained the preva1l1ng rate ot Wagl'
in the 10081i1;y in whioh this type of labor is to be performed tor
eaoh oraft or type of workman or mechanic needed to exeoute the oon-
tract and did set forth the prevailing hourly wage soale so asoertained}

and report to the City Counoil, and sald City Engineer
did examine and tabulate said sealed proposals and did report to the
Couneil the result of his examination ant tabulation; and
WHEREAS, the 01ty Oounol1 rinds that the sealed proposal sub-
mitted by J. P. S. CONTRACTING CO., INC~ 12084 Westminster Blvd.
Santa Ana. California
is the lowest responsible proposal submitted for the furnishing of all
plant, labor, servioes, materials and equipment, all utilities and
transportation, including power, fuel and water an4 performing all work
neo.ssary to construct and complete in a good and workmanlike manner
in strict acoordance with the specifications, plans and drawings
thereror on rile in the office of the Oity Clerk of the City of Ana-
heim of the public improvement hereinabove mentioned and desoribed,
together with the appurtenances thereto, and as apeoified in the
notice inviting sealed proposals, and that said proposal of said
above named bidder should be accepted and a contraot awarded to said
bidder in aooordanoe therewith. and
WHERIAS, the City Council finds that the above mentioned
sealed proposal is the lowest responsible proposal received and that
the person, firm or corporation submitting said proposal is a
responsible person, firm or oorporation and that the proposal sub-
mitted is the best suited and fitted for the public improvement to
be oonstruoted..

ROW, THJCREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THJl:
CITY OF ANARlIM, that the sealed proposal submitted by
J. P. S. CONTRACTING CO,. INC. 12084 Westminster Blvd.. Santa

for the furnishing of all plant, labor, servioes, materials and
equipment, all utilities and transportation, including power, fuel
and water and performing all work necessary to oonstruot and oomplete
in a good and workmanlike manner, in striot aooordanoe with the
speoifioations, plans, and drawings therefor on file in the offioe
ot the Oity Clerk of the City of Anaheim and the notioe inviting
sealed proposals, the pUblio works and improvements hereinabove more
partioularly mentioned and desoribed, together with the appurtenanoes
thereto, be, and the same is hereby, aocepted, and that a oontraot
for the oonstruotion and oompletion of said public improvement be,
and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the suocessful bldder or
bidders upon eaoh oontraot awarded as hereinabove set forth shall
be, and they are hereby reqUired to exeoute a oontract in the required

form with the City of Anaheim upon the terms and oonditions specified
in the notice inviting sealed proposals and the proposal submitted
by said successful bidder or bidders and in accordance with the plans
and specifications for said public improvement hereinabove described
and in accordance with the terms, condit~ons and provisions of this
resolution, and that said successful bidder or bidders to whom each
contract is awarded shall be required to furnish a surety bond in an
amount equa.l to one hundred per cen,t (100.!C) ^ of the, contraot price for
all labor, materials and equipment to be furnished and performed as
set forth in the sealed proposals submitted by said bidder for the
construction of said pUblic improvement tqgether with the appurtenances
thereto or such portion thereof as is covered by said contract as
security for the .faithful performanQe of said contract and a separate
surety bond in an amount equal to one hundred per cent (100%) or the
construction cost of said public improvement covered by said contract
as security for the payment of all persons performing labor and furn-
ishing material for said project.
AND BE rr FURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby required to furnish to the City of
Anaheim in companies satisfactory to the City ot Anaheim public
liability, property damage, compensation, and other insuranoe ia
the amounts and for the purposes asset forth and specified in the
notice inviting sealed proposals and subject to the apprOVal of the
City Attorney as to form and suffiCiency.
AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk
of the Oity of Anaheim be, and they are hereby, authorized and direoted
to make, exeoute and enter into for and on behalf of the City of Ana-
heim a written contract with said successful bidder or bidders tor the
furn1shing of all plant, labor, materials, and equipment an~ performing
all work as hereinabove more particularly described for theconstruc-
tion, installation and completion of said pUblic improvement herein-
above desoribed upon the terms and oonditions as specified in the
notioe inviting sealed proposals, the detailed design, plans, profiles.
drawings and general specifications and detailed specifications and
drawings and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the office
of the Oity Clerk of the City of Anaheim and in strict accordance with
the terms, conditions and prOVisions of this Resolution, and in accord-
ance with all the contract documents herein specified.
