AND THE FURNISHING OF ALL PLANlr, LABOR, SER-

WHEREAS, the Oity Counoil of the City of Anaheim did cause to
be pUDlished in a newspaper of general oiroulation, printed, published
and oirculated in the City of Anaheim, to wit: The Anaheim Bulletin,

All plant, labor, services, materials and equipment
and all utilities and transportation, including power,
fuel and water, and performing all work necessary to
construct and complete in a good and workmanlike manner,
in strict accordance with the specifications, plans and
drawings therefor on file in the Office of the City Clerk
of the City of Anaheim, the following public improvement,
to. wit: The co.nstructio.n, installatio.n and co.mpletion of
an eighteen (18) inch steel cylinder cancrete water line,
with valves, fittings and all appurtenances, in Ball Road,
620 feet West of Placentia Avenue, to. Placentia Avenue,
co.ntinuing then in Placentia Avenue from Ball Road to.

Labor Cede, the C1ty Oounoil of the Oity of Anaheim had a80ertained
prevailing rate of wages for each type of labor needed to exeoute
onotraot and did eet forth the prevailing hourly wage soale so a8oer-

WHEREAS, at a regular meeting of the Oity Council held on the
9th dAIly of ~tQber ,1956, at the hour of ~:oo o'olook
P.M. of said e, 8aid City Coun~id hold a publio earing for the
. purpo.. of opening sealed proposals reoeived up to. that time, for the
furnishing of all plant, labor, serviees, materials, and equipment, and
all utilities and transportation, inoluding power, fuel and water, and per-

forming all work necessary to construot and oomplete, in a good and
workmanlike manner, in strict accordance with the specifications,
plans and drawings therefor on file in the office of the City Clerk
of the City of Anaheim, of the public improvement hereinabove more

WHEREAS, the City Council did thereupon refer said bids to
the City Engineer for examination,
tabulation and report to the City Council, and said City En\ineer
did thereupon examine and tabulate sai sealed
proposals and report the result of his tabulation to the City Council;
and
WHEREAS, the City Council did meet in regular
session on the ~th day of October , 19 .56 ,at the hour
of (:00 O'clock P.M. to consider the sealed proposals submitted
for furnishing materials and performing the work hereinabove more
particularly described and set forth, and the Cit~ Engineer
of the City of Anaheim did t ereupon make his
report and submit his tabulation of said sealed proposals, and the
City Counoil did thereupon find and determine that the sealed proposal
submitted by LEDFORD BROS., 2718 Gaviota, Long Beach 4, California
for the construction, installation and oompletion of said IBn Water
Line in Ball Road and Placentia Avenue, Work Order No. 143B
hereinabove mentioned and described was the lowest responsible pro-
posal submitted therefor, and thereupon accepted said bid and did
award a contract to aaid LEDFORD BROS., 2718 Gaviota, Lon Beach 4,
California for furnish ng a p an , la or, serv ces, ma er als and
equipment and all utilities and transportation, including power, fuel
and water, and performing all work necessary to construot and complete,
in a good and workmanlike manner, in strict accordanoe with the speci-
fications, plans, and drawings, the said public improvement as specified
in said notice inviting sealed proposals, and did authorize the Mayor
and the City Clerk of the City of Anaheim to exeoute a contract for and
on behalf of the City of Anaheim with LEDFORD BROS.

and entered into on the 11th day of Ootober , 19..,,2L; and
WHEREAS, the said LEDFORD BROS.
h~furnished all plant, labor, services, materials
ancr equipment and all utilities and transportation, and performed all
work necessary for the construction and completion, in a good and work-
manlike manner, in strict accordance with the specifioations, plans,
drawings, of said public improvement as specified in the notioe inviting
sealed proposals and in the detail, design, plans, profiles, drawings
and speoifications prepared by George E. Holyoke, City En~ineer

WHEREAS, the City Engineer

WHEREAS, the City Council finds that said contractor has com-
pleted said public improvement hereinabove more partiCUlarly described
in accordanoe with the provisions of the contract and the contract
documents, and that notice of completion should be filed and payment
of the balance due said contractor authorized in accordance with the
contract documents.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the Oity
of Anaheim that all plant, labor, services, materials and 'equipment

and all utilities and transportation, and the performanoe of all
work neoe8sary to oonstruct, install and cqmplete, in a good and
workmanlike manner, in striot aooordance with the specifications,
plans and drawings therefor on file in theoffioe of the Oity
Clerk of the City of Anaheim, together wltij the appurtenanoes
thereto of said pub1io improvement hereinaqove more partioular1y
described and set forth, in the City of An~eim, by said oon-
tractor, be, and the same are hereby, accepted, subJeot, neverthe-
less, to all the ierms, oonditions ~nd provisions ~f the oontraot
documents, and that the balanoe due said oontraotor for said work
be paid to it thirty-five (35) days ,from and after final
aoceptance of said work as evidenoed by the adoption of this
resolution, but not sooner than thirty (30) days after the date
of the filing of notioe of completion, exoepting only suoh sum or
sums as may lawfully be withhe~d in,aooor~nce ~lth the provisions
of said contract and oontract doouments. That acoeptanoe by the
contraotor of said payments made in acoordanoe with s~id final
estimate shall operate and shall be a release to the City of
Anahel~, its offioers., agents and e~ployees1 fro~ all olaims and
liabilities due the oontraotor for anything done or furnished or
withheld or for anything relating t9 the wo~k or; any aot or neg-
leot of the Oity, its offioers, agents and employees, exoepting
only olaims against the Oity for a.ny amount,s withheld by the Oity
at the time of suoh payment.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they ar, hereby authorized
to exeoute and tile a notioe of oomp1etion of said work as required
by law.
