AND TRANSPORTATION INOLUDING POWER, FUEL AND
WATER, AND PERFORMING ALL WORK NEOESSARY TO
OONSTRUCT AND COMPLETE THE FOLLOWING PUBLIO

WHEREAS, the City Counoil of the City of Anaheim did oause to
be published in a newspaper of general oi~oulation, printed, published and
oiroulated in the Oity of Anaheim, to wit: The Anaheim Bulletin, on the
28~ of ~e~ember. 19,6 and 3rd of January, , 19 ,7 , a notioe inviting
se . ed proposals for furnishing the following:
All plant, labor, services, materials and equipment,
and all utilities and transportation, including power,
fuel and water, and performing all work necessary to
oonstruct and complete, in a good and workmanlike
manner, in strict accordance with the plans and
.pecifications on file in the Office of the City Clerk
of the City of Anaheim, the following publio improve-
ment, to wit: The Lewis Street Improvement, from Ball
Road to a point approximately 1200 feet South thereof,
oonsisting of the removal of existing material, paving
with five inches of plant-mix surfacing, construction of
a grooved cross-gutter, Type "B" curb and gutter, ad-
justing existing manholes to grade and appurtenant work,
as indicated on the plans, Job No. 131,
1n aooordance with the designs, plans, profiles and specifioations pre-
par.d by George ~. Holyoke, Oi ty Engineer and the notice inviting
sealed p~oposals, whioh said notioe speoified that sealed proposals as
specified in said notice would be received up until 7:00 o'clock P.M.
of the 8th day of January , 19 57 ,and whioh said not ice
did state and declare that, pursuant to the provisions of Section 1770 of
the Labor Oode, the City Council of the City of Anaheim had asoertained
the prevailing rate of wages for each type of labor needed to exeoute
said oontraot and did set forth the prevailing hourly wage soale so ascer-
~ tained; and
WHEREAS, at a regular meeting of the City Council held on the
8th day of January , 19 57 ,at the hour of 7:00
o'clook P.M. of said date, said City Council did hold a publio hearing
for the purpose of opening sealed proposals reoeived up to that time, for
furnishing of all plant, labor, servioes, materials,and equipment, and all
utilities and transportation, inoluding power, fuel and water, and per-

forming all work neoessary to oonstruot and oomplete, in a good and
workmanlike manner, in striot aooordanoe with the speoifioations,
plans and drawings therefor on file in the offioe of the Oity Olerk
-- of the City of Anaheim, of the public improvement hereinabove more
partioularly desoribed and set forth; and
WHEREAS, the Oity Council did thereupon refer said bids to
the C1 ty En~ineer . for examination
tabulation and report to the Oity Counoil, and said City En~ine.r
did thereupon examine and tabulate said sealed
proposals and report the result of his tabulation to the City Oounoil;
and
WHEREAS, the City Counoil did meet in regular
seslion on the 8th deN of January , 19 57 ,at the hour
of 7:00 o'olook P.M, to oonsider the sealed proposals submitted
for furnishing materials and performing the work hereinabove more
particularly desoribed and set forth, and the City En~ineer
of the City of Anaheim did thereupon make his
report and submit his tabulation of said sealed proposals, and the
City Counoil did thereupon find and determine that the sealed proposal
submitted by R,J,NOBLE COMPANY. P.O.BOX 620, ORANGE. CALIFORNIA,
for the oonstruotion, installation and oompletion of said LEWIS
STREET IMPRO~~NT. JOB NO. 1,1
hereinahove mentioned and described was the lowest responsible pro-
posal submitted therefor, and thereupon aooepted said bid and did
award a contract to said R. J. NOBLE CONPAHY
for furnishing all plant, labor, services, materials and equipment
and all utilities and transportation, inoluding power, fuel and water,
and performing all work necessary to construot and oomplete, in a good
and workmanlike manner, in strict accordanoe with the speCifications,
plans, and drawings, the said publio improvement as speoified in said
notice inviting sealed proposals, and did authorize the Mayor and the
Oity Clerk of the City of Anaheim to execute a contraot for and on
behalf of the City of Anaheim with R. J. NOBLE COMPANY
, which said oontraot was duly

WHEREAS, the said R. J. NOBLE COMPANY
has furnished all plant, labor, services, materials and equipment and
all utilities and transportation, and performed all work necessary
for the construotion and completion, in a good and workmanlike manner,
in strict accordance with the specifications, plans, drawings, of said
public improvement as speoified in the notioe inviting sealed proposals
and in the detail, design, plans, profiles, drawings and speoifioations
prepared by Geor~e E. Holyoke. City Engineer , and the oontraot
made and entered into with it by the City of Anaheim; and
WHEREAS, the City Engineer
has duly certified to the oonstruotion and oompletion of said publio
improvement hereinabove mentioned and desoribed in aooordanoe with
the plans and specifioations and the oontract documents duly made and
entered into with said R. J. Noble Company ; and
WHEREAS, the Oity Counoil finds that said oontractor has com-
pleted said public improvement hereinabove more particularly desoribed
--- in aooordance with the provisions of the oontract and the oontraot
documents, and that notice of completion should be filed and payment
of the balanoe due said oontractor authorized in aooordance with the
oontraot documents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Anaheim that all plant, labor, servioes, materials and equipment

and all utilities and transportation, and the performance of all
work necessary to construct, install and complete, in a good and
workmanlike manner, in strict accordance with the speoifioations,
plans and drawings therefor on file in the offioe of the City
Clerk of the City of Anaheim, together with the appurtenances
thereto of said pUblic improvement hereinabove more partioularly
desoribed and set forth, in the City of Anaheim, by said oon-
tractor, be, and the same is hereby, aoc'epted, subJect,' neverthe-
less, to all the terms, conditions and provisions of the contraot
doouments, and that the balance due said contraotor for said work
be paid to it thirty-five (35) days from and after final
aooeptanoe of said work as evidenoed by the adoption of this
resolution, but not sooner than thirty (30) days after the date
of the filing of notioe of oompletion, exoepting'only suoh sum
or sums as may lawfully be withheld in aooordance with the pro-
visions of said oontract and contract documents. That acoeptanoe
by the oontraotor of said payments made in accordance with said
final estimate shall operate and shall be a release to the City of
Anaheim, its officers, agents and employees from all olaims and
liabilities due the contractor for anything done or furnished or
withheld or for anything relating to the work or any aot or neg-
leot of tne City, its offioers, agents and employees, excepting
only olaims against the City for any amounts withheld by the City
at the time of such payment.
AND BE IT FURTHER RESOLVED that the Mayor and the Oity
Clerk of the City of Anaheim be, and they are herebY, authorized
to execute and file a notice of completion of said work as required
by law.
THE FOREGOING RESOLUTION was signed and approved by me
