57R-3751 _. RESOLUTION NO. 3751 /'"'" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE. (NO. 701) WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the property owners and/or Agent of certain real property situated in the City of Anaheim, County of Orange, state of California, described as follows: PARCEL 1: That certain parcel of real property in the County of Orange, State of California, described as follows: The northeast quarter of the southwest quarter of the northwest Quarter and the east 10 feet of the northwest quarter of the southwest quarter of the northwest quarter of Section 24, being a part of lot 41 in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the County of Orange, state of California, as per map recorded in book 2 pages 256 and 257 of Patents of Los Angeles County, California. .'-.i '..C.. EXCEPTING therefrom that portion beginning at a point 20 feet south and 485 feet west of the north- east corner of said land; thence south 33 feet; thence west 72 feet; thence north 33 feet; thence east 72 feet to the point of beginning. (Including all water rights appurtenant to the property as provided in an agreement dated May 29, 1934 and recorded August 4, 1934 in book 694, page 91 of Official Records, in the office of the County Recorder of Orange County). PARCEL 2: That certain narcel of real property in the County of Orange, state of California, described as follows: The south half of the southwest Quarter of the north- west quarter of Section 24, Township 4 South, Range 10 west, in the Rancho San Juan Cajon de Santa Ana, in the County of Orange, state of Oalifornia, as per map recorded in book 51, page 10 of Miscellaneous Maps, in the office of the County Recorder of said County. "'~ EXCEPT the west 10 acres thereof, (Including all water rights appurtenant to the property as provided in an agreement dated May 29, 1934 and recorded August 4, 1934 in book 694, page 91 of Official Records, in the office of the County Recorder of Orange County). (Said property is located at 2170 Winston Road, Anahe im. ) AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said -1- -, ~ petition on February 18, 1957, notices of which said public hearing were duly given as required by law and the provis.ions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 159, recommending to the City Council of the City of Anaheim that Variance No. 701 be granted upon the conditions stated in said resolution; and WHEREAS, the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such Variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning varianoe be, and the same is hereby granted to CERRITOS-KEM CO. and GEORGE A. BERLIN, c/o L. E. Wagner Realty Co., 10503 s. Los Angeles Street, Anaheim, California, for the manufacturing of synthetic resins, solvents, and generally similar chemical products by distillation, polymerization and other treatments of coke byproducts and select- ed petro-chemical fractions and distillates thereof, and the manufacturing and preparation for sale of miscellaneous chemicals on the property hereinabove described, subject to the following conditions: 1. That the catalyst unit be vented into a clay bed or into some other control so the vented gases will not escape into the atmosphere. 2. 3. ~ 4. 5. A vapor recovery device will be necessary for the polymerized oil storage tank or tanks. A vapor recovery device for the storage of light steam distillate will also be necessary. For the resin storage a vapor recovery device will also be required. For the acid storage a vent will be required and tnis will be connected to a neutralizing system. -2- - ,-.. b. For the loading and unloading of raw materials a vapor control will be necessary. 7. The buildings and layout to be in conformity with plans presented with the Petition for Zoning Variance, Application No. 701, which elevation and plot plans shall become a part of the application. 8. That the Pacific Scientific Company, owner of property adjacent to the property hereinabove described, plant and maintain ivy on its fence; and that the Neville Chemical Company plant and maintain trees along the westerly boundary of the property hereinabove described, the species and distances of planting of such trees to be under the direction of the City Park Department, in accordance with an agreement between the two companies. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners or their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Munici- pal Code unless otherwise specified herein.
