ORDINANCE NO. 4127
AN ORDINANCE OF THE CITY OF ANAHEIM ADDING
SECTION 18.02.060 TO CHAPTER 18.02 OF TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING
TO ZONING.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That new Section 18.02.060 be, and the same is hereby,
added to Chapter 18.02 of Title 18 of the Anaheim Municipal Code,
to read as follows:
"18.02.060 JUDICIAL REVIEW
.010 Any court action or proceeding to
attack, review, set aside, void or annul any decision
concerning any zoning ordinance, amendment, reclassi-
fication, general plan amendment, conditional use
permit, variance or other decision made pursuant to
any provision of Title 18 of the Anaheim Municipal
Code, or concerning any of the proceedings, acts or
determinations taken, done or made prior to such de-
cision, or to determine the reasonableness, legality
or validity of any condition attached thereto, shall
not be maintained by any person unless such action or
proceeding is commenced within ninety (90) days after
the date of such decision. Thereafter all persons are
barred from any such action or proceeding or any de-
fense of invalidity or unreasonableness of any such
decision or of such proceedings, acts or determina-
tions.
.020 Notwithstanding the provisions of
Subsection .010 above, any court action or proceeding
to attack, review, set aside, void or annul any deci-
sion made prior to the effective date of this ordinance
concerning any matter specified in Section 1 hereof
shall not be maintained by any person unless such ac-
tion or proceeding is commenced within ninety (90) days
after the effective date of this ordinance; provided,
however, nothing contained herein shall be deemed to
extend the time within which any such action or pro-
ceeding must otherwise be brought as prescribed by any
other applicable provision of law."

SECTION 2. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this ordi-
nance be declared for any reason to be invalid, it is the intent
of the Council that it would have passed all other portions of
this ordinance independent of the elimination herefrom of any
such portion as may be declared invalid.
SECTION 3.
The City Clerk shall certify to the passage of this or-
dinance and shall cause the same to be printed once within fifteen
(15) days after its adoption in the Anaheim Bulletin, a newspaper
of general circulation, printed, published and circulated in said
City, and thirty (30) days from and after its final passage, it
shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 13th day of May, 1980.
