A RESOLUTION OF THE CITY COUNOIL OF TIm CITY
or ANAHEIM FINALLY ACCEPTING THE COMPLETION
AND THE FURNISHING OF ALL PLANT, LABOR, SER-
VICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES
AND TRANSPORTATION INCLUDING POWER, FUEL AND
WATER, AND PERFORMING ALL WO:RK NEOESSARY TO

WHEREAS, the City Council of the City of Anaheim did oause to
be published in a nevspaper of general oi~oulation, printed, pUblished and
oirculated in the Oity of Anaheim, to wit: The Anaheim Bulletin, on the
19th aM 26th daYIlI 01' .TUB' , 19 '50 , a notioe inviting
sealed proposals for furnishing the following:
All plant, labor, services, materials and
equipment, and all utilities and tran.portation,
inoluding power, fuel and water, and pertorming all
work neoes.ary to construot and oomplete, ina good
and workmanlike manner, in strict aooordanoe vita the
plans and .pecifications on file in the offioe et tne
Oity Clerk of the City of Anaheim, the improvement ot
Vermont Avenue from Los Angeles Street to Lemon Street
by excavation, construotion of plant-mix paving, con-
orete ourb. and gutters, plant-mix berm, construotion
of storm drains, inoluding all equipment, oasting.,
structures and exoavation, removal of concrete weir
box, and appurtenant work as indioated on the plans,

in aooordanoe with the designs, plans, prOfiles and speoifications pre-
pared by Geer2e ~. Holyoke. Oi~y En~1n..r and the notice inviting
sealed proposals, which said notioe speoified that sealed proposals as
speoified in said notice would be received up until 7:00 o'clook P.M.
of the lO~ day of Julv , 19 56 ,and whioh said notioe
did state and deolare that, pursuant to the provisions of Seotion 1770 of
the Labor Oode, the City Council of the City of Anaheim had asoertained
the prevailing rate of wages for eaoh type of labor needed to exeoute
said contraot and did set forth the prevailing hourly wage scale so ascer-

WHEREAS, at a regular meeting of the City Oounoil held on the
lOt.Q. day of .Tulv , 19 '5' ,at the hour of 7H~f)
o'clook P.X. of said date, said City Council did hold a pUblio hearing
for the purpose of opening sealed proposals reoeived up to that time, for
furnishing of all plant, labor, servioes, materials,and equipment, and all
utilities and transportation, ino1uding power, fuel and water, and per-

forming all work neoessary to oonstruot and complete, in a good and
workmanlike manner, in striot aooordanoe with the speoifioations,
plans and drawings therefor on file in the offioe of the City Olerk
of the City of Anaheim, of the public improvement hereinabove more
partioularly desoribed and set forth; and
WHEREAS, the City Council did thereupon refer said bids to
the City Engimeer for examination
tabulation and report to the Oity Counoil, and said Oity En~in..r
did thereupon examine and tabulate said sealed
proposals and report the result of his tabulation to the Oity Oounoil}

WHEREAS, the City Counoil did meet in regular
seuion on the lOth day of Jll1y , 19.56 ,at the hour
Of?IBO o'olook P.K. to oonsider the sealed proposals submitted
for furnishing materials and performing the work hereinabove more
partioularly desoribed and set forth, and the City E~in..r
of the Oity of Anaheim did thereupon make his
report and submit his tabulation of said sealed proposals, and the
City Oounoil did thereupon find and determine that the sealed proposal
submi t ted by R. J. NOBLI: COMPANY, P.O. lOX 620. ORANGE, OALIFORNIA
for the oonstruotion, installation and oompletion of said imnrov..ent of
Ve~~nt Avenue from LoS An2eles st. to LeDen St. Job No. 118
hereinahove mentioned and desoribed was the lowest responsible pro-
posal submitted therefor, and there~~onaoo~p~ed said bid and did
award a oontract to said R. J, NOBLE COKPANY
for furnishing all plant, labor, servioes, materials and equipment
and all utilities and transportation, including power, fuel and water,
and performing all work neoessary to construot and oomplete, in a good
and workmanlike manner, in strict aooordance with the speoifioations,
plans, and drawings, the said public improvement as speoified in said
notioe inviting sealed proposals, and did authorize the Mayor and the
City Olerk of the City of Anaheim to exeoute a oontraot for and on
behalf of the City of Anaheim with R. J. NOBLE COMPANY
, which said oontraot was duly
made and entered into on the ll't.b. day of Juljr
19...5.6_.; and
WHEREAS, the said R. J. NOBLE COMPANY
has furnished all plant, labor, servioes, materials and equipment and
all utilities and transportation, and performed all work neoessary
for the oonstruotion and oompletion, in a good and workmanlike manner,
in striot accordance with the specifications, plans, drawings, of said
public improvement as speoified in the notioe inviting sealed proposals
and in the detail, design, plans, prOfiles, drawings and speoifioations
prepared by Geo~ge Jl:. Holyoke, Ci t;r Engineer , and the oontraot
made and entered into with it by the City of Anaheim; and
WHEREAS, the QI!I.E)tG.lHUa
has duly oertified to the construotion and completion of said publio
improvement hereinabove mentioned and desoribed in aooordance with
the plans and specifioations and the oontraot doouments duly made and
entered into with said R. J. NOBLE COMPANY j and
WHEREAS, the City Counoil finds that said oontraotor has oom-
pleted said pUblio improvement hereinabove more partioularly desoribed
~ in aooordanoe with the provisions of the oontraot and the oontraot
doouments, and that notioe of completion should be filed and payment
of the balanoe due said oontraotor authorized in aooordanoe with the
oontraot doouments.
NOW, THEREFORE, BE IT RESOLVED by the City Counoil of the City
of Anaheim 'chat all plant, labor, servioes, materials and equipment

and all utilities and transportation, and the performance of all
work necessary to construct, install and oomplete, in a good and
workmanlike manner, in strict aocordance with the speoifioations,
plans and drawings therefor on file in the offioe of the City
Clerk of the City of Anaheim, together with the appurtenanoes
thereto of said public improvement hereinabove more partioularly
described and set forth, in the City of. Anahel~, by said con-
tractor, be, and the same .is hereby, aooepted, subjeot, neverthe-
less, to all the terms, conditions and provisions of the contraot
doouments, and that the balance due said oontractor for said work
be paid to it thirtY-five ('5) days from and after final
aooeptance of said work as evidenoed by the adoption of this
resolution, but not sooner than thirty ('0) days after the date
of the filing of notice of oompletion, exoepting only suoh sum
or sums as may lawfully be withheld in aooordance with the pro-
visions of said oontraot and oontraot doouments. That aooeptanoe
by the oontraotor of said payments made in aooordanoe with said
final estimate shall operate and shall be a release to the City of
Anaheim, its officers, agents and employees from all olaims and
liabilities due the oontractor for anything done or furnished or
withheld or for anything relating to the work or any aot or neg-
lect of the City, its officers, agents and employees, excepting
only claims against the City for any amounts withheld by the City
at the time of such payment.
AND BIl IT FURTHJ:R RIlSOLVED that the :Mayor and the City
Clerk of the Oity of Anaheim be, and they are hereby, authorized
to exeoute and file a notioe of oompletion of said work as required
by law.
THE FORIlGOING RIlSOLUTION was signed and approved by me
this 26tkday of Februar:r , 19 57 .
