A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE RENEWAL, FOR A TERM OF ONE YEAR, OF A CERTAIN CONTRACT MADE AND ENTERED INTO BY AND BETWEEN THE CITY OF ANAHEIM AND WARREN W. JAYCOX ON APRIL 1, 1956, FOR THE COLLECT ION AND DISPOSAL OF GARBAGE IN THE CITY OF ANAHEIM. WHEREAS, Warren W. Jaycox did heretofore submit a proposal to the City of Anaheim for the collection and disposal of garbage in the City of Anaheim for a period of one year from April 1, 1956 to March 31, 1957, in all that portion of the City included in the City Limits of Anaheim as shown on an official map of the City of Anaheim dated April 1, 1956, as filed in the Office of the City Engineer of the City of Anaheim, and all territory thereafter annexed to the City during the period of time above mentioned; and WHEREAS, the City of Anaheim did enter into a con- tract with Warren W. Jaycox on April 1, 1956 for the collec- tion and disposal of garbage in the City of Anaheim in the area above mentioned, for the period April 1, 1956 to March 31, 1957, for the flat sum of $1500.00 per month; and WHEREAS, said agreement provided that upon the expiration of the term thereof, the City of Anaheim should have the option to renew the agreement for an additional period of one year by giving written notice of its intention so to do not later than March 1, 1957, and in the event the City elected to renew said agreement, the contractor would receive for such renewal period the following compensation: The sum of $1500.00 per month, plus 5i per month for each service required as of April 1, 1957 in excess of the number of services required as of April 1, 1956, the number of services to be presumed to equal the water services in use within the City; AND WHEREAS, the City Council does find and de- termine that it would be to the advantage and for the best interest of the City of Anaheim to renew said contract for a further term of one year upon the same terms and condi- tions, except that the compensation to be paid said con- tractor shall be as hereinabove set forth and as provided in said agreement dated April 1, 1956. ,.,- NOW, THEREfORE, BE IT RESOLVED by the City Council of the City of Anaheim that a notice of intention to renew said contract be forwarded to said Contractor; and that the contract heretofore made and entered into by and between the City of Anaheim and Warren W. Jaycox on the 1st day of April, 1956, be, and the same is hereby, renewed for a term of one year, commencing on the 1st day of April, 1957 and ending on the 31st day of March, 1958, upon the same terms and con- ditions, except that the compensation to be paid said con- tractor during the period of the renewal agreement shall be as follows: -1- - ~. The sum of $1500.00 per month, plus 5i per month for each service required as of April 1, 1957 in excess of the number of services required as of April 1, 1956, the number of services to be presumed to equal the water services in use within the City, and in the event the City exercises the option to be granted it in the renewal agreement and extends the period for the collection and disposal of garbage an additional year, the compensation to be paid the contractor shall be: The sum of $1500.00 per month, plus 5i per month for each service required as of April 1, 1958 in eccess of the number of services required as of AprIl 1, 1956, the number of services to be presumed to equal the water servIces In use withIn the City. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorIzed and empowered to enter into a contract for and on behalf of the City of Anaheim with said contractor for the collection and dIsposal of garbage in the City of Anaheim, upon the terms and condI- tIons as herein provided.
