RESOLUTION NO. 3700 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CONSENTING TO THE ANNEXATION TO THE CITY OF FULLERTON OF CERTAIN PROPERTY LYING BETWEEN EAST AND ACACIA STREETS, NORTHERLY OF THE PROPOSED HOUSTON FREEWAY; AND CONSENTING TO AN ADJUSTMENT OF THE COM- IDN BOUNDARY L IN! BETWEEN THE CITY OF ANAHE 1M AND THE CITY OF FULLERTON. WHEREAS, there has been filed with the City Council of the City of Anaheim a written petition requesting consent of the City Council of the City of Anaheim to the annexation to the City of Fillerton of certain property within the City of Anaheim lying between East and Acacia Streets, northerly of the proposed Houston Freeway, and hereinafter more particu- larly described; and WHEREAS, said petition is signed by at least two- thirds of the freeholders, holding at least two-thirds in value of the property in said territory now within the corporate limits of the City of Anaheim; and WHEREAS, said petition contains the written consent of the,parties to the annexation of said territory to the City of Fullerton; and WHEREAS, the agreement heretofore made and entered into by and between the City of Fullerton and the City of Anaheim establishing a common boundary between said cities provides for the alteration and adjustment of said boundary when necessary for the proper development of the areas ad- jacent to said boundary line as established, by mutual con- sent of said cities; and ,- WHEREAS, the City Council finds that the Division of Highways of the State of California contemplates the establishment of a freeway extending in an easterly and westerly direction adjoining the south boundary line of Houston Street as now established, and that the property lying between East and Acacia Streets, northerly of the pro- posed Houston Freeway, hereinafter more particularly de- scribed, is separated from the City of Anaheim by the proposed Houston Freeway and Carbon Canyon Creek, and adjoins the com- mon boundary line between the Cities of Anaheim and Fullerton on the north, and that the owners of said property own addi- tional and adjoining property situated north of the common boundary line established between the two cities, and that, therefore, it would be for the best interest of the owners of said property and the development of said area that the City Council consent to the annexation by the City of Fullerton of said property now situated within the city limits of the City of Anaheim, hereinafter more particularly described, and that it consent to an alteration and adjust- ment of the common boundary line between the two cities as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that consent be, and it is hereby, given to the City of Fullerton to annex the following de- scribed territory, which is now within the city limits of the City of Anaheim, to wit: -1- 1 J - ,.,-...,. All those portions of Section 2 and Section 3, Township 4 South, Range 10 West, San Bernardino Base and Meridian, in Rancho San Juan Cajon de Santa Ana, per map recorded in Book 51 at Page 10, Miscellaneous Maps of Orange County, in the City of Anaheim, County of Orange, State of California, more particularly de- scribed as follows, to wit: ~ Beginning at a point in the common boundary line of the City of Fullerton and the City of Anaheim, as same existed November 1, 1956, said point being also the Southwest corner of South Cypress Annexation No. 3 to tha City of Fullerton as same was certified by the Secretary of State on A~gust 31, 1955; thence, along said common boundary line of the City of Fullerton and the City of Anaheim, and the northerly right of way line of Burton Street, 40 feet wide, as same is de- scribed by instrument recorded in Book 815 at Page 437, Official Records of Orange County, and the westerly prolongation thereof; South 890 59' 45" East, 1352.08 feet, more or less, to a point in the westerly line of that certain parcel of land described as the South 5.42 acres of the West 18 acres of the South 36 acres of the East half (E!) of the Fractional Northwest quarter (NW!) of said Section 2; thence, leaving said northerly right of way line of Burton Street, along said westerly line of said 5.42 acre parcel, Northerly, to the north- west corner thereof; thence, along the northerly line of said 5.42 acre parcel, Easterly 663 feet, more or less, to a point in a westerly line of the Acacia Street Annexation to the City of Anaheim as same was certified by the Secretary of State on May 18, 1953; thence, along said westerly line of said Acacia Street Annexation, Northerly to a northwest corner thereof; thence, Easterly 20.00 feet to the Northwest corner of Tract No. 1517 as same is shown on a map recorded in Book 80 at Page 40, Miscellaneous Maps of said Orange County; thence, leaving the aforementioned common boundary lIne of the City of Fullerton and the City of Anaheim, along the westerly boundary of said Tract No. 1517, South 00 49' 10" East, 44.99 feet to the westerly corner of Lot "An of said Tract No. 1517, said point being the beginning of a curve, concave southeasterly, having a radius of 467.50 feet and a central angle of 470 491 59", a radial through last said point bearing North 110 551 44" West; thence, along the arc of said curve, Southwesterly 390.29 feet to the beginning of a reversing curve, concave northwesterly, having a radius of 532.50 feet and a central angle of 590 451 58", thence, along the arc of last said curve, Southwesterly 555.46 feet, more or less, to a point in a line parallel with and dis- tant southerly 145.00 feet, measured at right angles, from the centerline of aforementioned Burton Street; thence, tangent to said curve, along said parallel line, and the westerly prolongation thereof, North 890 591 45" West, 1261 feet, more or less, to a point in the westerly right of way line of East Street, 60 feet wide, said right of way line being parallel with and distant westerly 30.00 feet, measured at right angles, from the east line of said Section 3; thence, along said westerly right of way line of East Street, Northerly 165 feet, more or less, to the point of beginning, containing an area of 9.3 acres, more or less. -2- u .- - ,..... AND BE IT FURTHER RESOLVED that the common boundary line between the Clties of Anaheim and Fullerton, from the west boundary line of East Street to the Northwest corner of Tract No. 1517, as shown on a map recorded in Book 80 at Page 40, Miscellaneous Maps of Orange County, California, be established along the following line: Beginning at the Northwest corner of Tract No. 1517, as same is shown on.a map recorded in Book 80 at Page 40, Miscellaneous Maps of Orange County, California, ."thence along the westerly boundary of said Tract No. 1517, South 00 49' 10" East, 44.99 feet to the westerly corner of Lot "A" of said Tract No. 1517, said point being the beginning of a curve, concave southeasterly, having a radius of 467.50 feet and a central angle of 470 49' 59", a radial through last said point bearing North 110 551 44~ West; thence, along the arc of said curve, Southwesterly, 390.29 feet to the beginning of a reversing curve, concave northwesterly, having a radius of 532.50 feet and a central angle of 590 451 58", thence, along the arc of last said curve, Southwesterly 555.46 feet, more or less, to a point in a line parallel with and distant southerly 145.00 feet, measured at right angles, from the centerline of Burton Street; thence, tangent to said curve, along said par~llel line, and the westerly prolongation thereof, North 89~ 591 45" West, 1261 feet, more or less, to a point in the westerly right of way line of East Street, 60 feet wide, said right of way line being parallel with and distant westerly 30.00 feet, measured at right angles, from the east line of Section 3, Township 4 South, Range 10 West, S.B.B. & M.; thence, along saidwesterly right of way line of East Street, northerly 165 feet to a point, said point being the Southwest corner of South Cypress Annexation No.3 to the City of Fullerton as same was certified by the Secretary of State on August 31, 1955. me this THE FOREGOING RESOLUTION is signed and approved by 13th day of February, 1957. ~~ ATTEST: 12 ht~. ct~tllli ':oF .
