A RESOLUTION OF THE CITY COUNCIL OF THE CITY
or ANAHEIM FINALLY ACCEPTING THE COMPLETION
AND THE FURNISHING OF ALL PLANT, LABOR, SER-
VICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES
AND TRANSPORTATION INCLUDING POWER, FUEL AND
WATER, AND PERFORMING ALL WORK NECESSARY TO
CONSTRUCT AND COMPLETE THE FOLLOWING PUBLIC
IMPROVEMENT t THE BURTON STREET SEvIER INPROVE1-iENT,
FROM ACACIA STREET TO A POINT 900 FEET WESTERLY,
JOB NO. 1081.
WHEREAS, the City Council of the City of Anaheim did oause to
be published in a newspaper of general ci~culation, printed, pUblished and
circulated in the Oity of Anaheim, to wit: The Anaheim Bulletin, on the
24th and 10th davs of November , 19~6 ,a notice inviting
sealed proposals for furnishing the following:
All plant, labor, services, materhds and equip-
ment, anct all utili ties and transportation, in-
cludin~ pOlier, fuel and ,<Jater, and performing
all "ork necessary to construct and complete in
a :~ood and workme,nlike mHnner, in strict accord-
ance with the specifications, plans and drawings
therefor on file in the office of the City Clerk
of the City of Anaheim, the following public im-
provement, to wit: The Burton Street Sewer Im-
provement, from Acacia Street to a point 900 feet
vlesterly, consistinf of the construction of an
8-inch V.C.P. se,"ler lateral, construction of
standaro, manholes, installation of wyes, resur-
facing end aDpurtenant vwrk, as incl1cated on the
plans, Job No. 1081,
in accordanoe with the designs, plans, profiles and specifications pre-
pared by George E. Holvoke. City En~ineer and the notice inviting
sealed proposals, which said notioe speoified that sealed proposals as
speoified in said notioe would be reoeived up until 7:00 o'olook P.M.
of the ],1 th day of December , 19 ~6 , and which said not ice
did state and deolare that, pursuant to the provisions of Section 1770 of
the Labor Code, the City Council of the City of Anaheim had asoertained
the prevailing rate of wages for eaoh type of labor needed to execute
said contraot and did set forth the prevailing hourly wage scale so asoer-

WHEREAS, at a regular meeting of the City Counoil held on the
lJ. th day of December , 19 56 , at the hour of 7: 00
o'olook P.M. of said date, said City Council did hold a publio hearing
for the purpose of opening sealed proposals reoeived up to that time, for
furnishing of all plant, labor, servioes, materials ,and equipment, and all
utilities and transportation, inoluding power, fuel and water, and per-

torming all work neoessary to oonstruot and oomplete, in a good and
workmanlike manner, in striot aooordanoe with the speoifioations,
plans and drawings theretor on file in the off10e ot the Oity Olerk
ot the Oity of Anaheim, of the publio improvement hereinabove more
partioularly desoribed and set forth; and
WHEREAS, the Oity Council did thereupon refer said bids to
the CityEngineer tor examination
tabulation and report to the Oity Oounoil, and said City Engineer
~did thereupon examine and tabulate said sealed
propo.al. and report the result ot his tabulation to the Oity Oounoil}

award a contraot to said PLUMBING CO~TRACTOR~, INC. SANITARY DIVISION
tor furnishing all plant, labor, servioes, materials and equipment
and all utilities and transportation, inoluding power, fuel and watir,
and performing all work neoessary to oonstruct and oomplete, in a good
and workmanlike manner, in striot aooordanoe with the ,peoifioations,
plans, and drawings, the said pUblic improvement as speolfied in said
notioe inviting sealed proposals, and did authorize the Mayor and the
Oity Clerk of the Oity ot Anaheim to exeoute a oontraot for and on
behalf of the 01ty of Anaheim with PLUHBING CONTRACTORS, INC. SANITARY
DIVISION , whioh said ciontraot was duly
made and entered into on the 14th day ot December

WHEREAS, the said PLUMBING COW!.'RL\.OTORS, IHC. SANITARY DIVISION
has turnished all plant, labor, servioes, materials and equ1pment and
all utilities and transportation, and pertormed all work neoessary
tor the oonstruotion and oompletion, in a good and workmanlIke manner,
in striot aooordanoe with the speoifioations, plans, drawings, ot sald
publio 1mprovement as speoified in the notioe inviting sealed proposals
and 1n the detail, design, plans, prof1le., drawings and speoltloat1ons

made and entered into with it by the 01ty at Anaheim; and
WHEREAS, the City Engineer
ha, duly oertified to the construotion and oompletion ot said publio
improvement hereinabove mentioned and desoribed 1n aooordanoe w1th
the plans and speoifioations and the oontraot doouments duly ~_and
entered into with said PLUNBING CONTRACTORS, INC. SANITARY DIVI!JI"ihcl
WHERltA.S, the Oity Oonno11 tlnds that said oontraotor has com-
pleted said pUblio improvement hereinabove more particularly described
,~ in aooordanoe with the prov1s1ons ot the oontract and the oantrao1
doonaente, and that notioe of oompletion should be filed and payment
of the balanoe due said oontraotor a.thorized in aooordanoe with the
oontraot doouments.

Olerk of the City of Anaheim, together with the appurtenanoes
thereto of said pUblic improvement hereinabove more partioularly
desoribed and set forth, in the City of ~aheim, .by said con-
tractor, be, and the same is hereby, acoepted, subJeot, neverthe-
less, to all the terms, oonditions and provisions of the contraot
doouments, and that the balanoe due sald oontractor for said work
be paid to it thirty-five (35) days from and after final
aooeptance of said work as evidenoed by the adoption of this
resolution, but not sooner than thirty (30) days after the date
of the filing of notice of completion, exoepting only such sum
or sums as may lawfully be withheld in acoordance with the pro-
visions of said contract and contraot documents. That acoeptanoe
by the oontraotor of said payments made in aocordance with said
final estimate shall operate and shall be a release to the Oity of
Anaheim, its officers, agents and employees from all claims and
liabilities due the contractor for anything done or furnished or
withheld or for anything relating to the work or any aot or neg-
leot of the City, its officers, agents and employees, excepting
only claims ag~inst the Oity for any amounts withheld by the City
at the time of such payment.
AND BE IT FURTHER RESOLVED that the Mayor and the Oity
Clerk of the City of Anaheim be, and they are hereby, authorized
to execute and file a notice of completion of said work as required
by law.
THE FOREGOING RESOLUTION was signed and approved by me
this l,th day of February , 19 57 .
