,iHEREAS, the City Council of the City of Anaheim did
cause to be published in a ne;vspaper of general circulation,
9rintea, published and circulated in the City of Anaheim, to wit:

furnishing the lrollowing:
All plant, labor, services, materials and
equipment, and all utilities and transporta-
tion, including power, fuel and water, and
performing all work necessary to construct
and complete, in a good and workmanlike
manner, in strict accordance with the plans
and specifications on file in the Office of
the City Clerk or the City Engineer of the
City of Anaheim, the following public im-
provement: The construction of a storm drain
at the intersection of Los An~eles and South
streets, in the City of Anaheim, including
all equipment, castings, structures, excava-
tion and appurtenant ;;,ork as indicated on the
plans, Job No. IJJ
In accordance with the designs, plans, profiles and specifications
of said public improvement on file in the Offj ;e of the City Clerk
of the City of Anaheim; and
.illiRLAS, said notice inviting sealed'roposals for said
)~blic improvement did provide that sealed pro. osals would be re-
ceived by the City Council of the City of Anah :1.m at the Office of
the City Clerk of the City of Anaheim up to th~ hour of 7:00 o'clock

of all plant,~, services, materials and equipment, all utili-
eies and transportation, incluQing power, fuel and water, and per-
forming all work necessary to construct and complete, in a good and
"orkmanlike manner, the public improvement hereinabove more particu-
larly mentioned and described and which notice did state and declare
th~t ~ursuant to the provisions of Section 1770 of the Labor Code,
the City Council of the City of Anaheim had ascertained the prevailing
rate of 1rrages in the locality in which this type of labor is to be pel-
formed for each craft or ty~)e of Horkman or mechanic needed to execute
the coatract and cUd set forth the prevailing hourly ..rage scale so
ascertained; and

is the lowest responsible proposal submitted for the furnishing of all
plant, labor, servioes, materials and equipment, all utilities and
transportation, inoluding power, fuel and water and performlng all work
neo..sary to oonstruot and complete in a good and workmanlike manner
ln striot acoordance with the specifications, plans and drawings
theretor on :fHe in the office of the City Olerk of the Oity ot Ana-
heim of the public improvement hereinabove mentioned and desor1bed,
together with the appurtenanoes thereto, and as speoified in the
notioe inviting sealed proposals, and tt~t said proposal of said
above named bidder should be accepted and a contraot awarded to sald
bidder ln aooordanoe therewith; and
WHEREAS, the Oity Council finds that the above mentioned
sealed proposal is the lowest responsible proposal received and that
the person, firm or corporation submitting said proposal is a
responsible person, firm or oorporation and that the proposal sub-
mitted is the best suited and fitted for the public improvement to
be oonstruoted..
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OOUNCIL OF THE
CITY OF ANAHEIM, that the sealed proposal submitted by

sealed proposals, the publio works and improvements hereinabove more
partioularly mentioned and desoribed, together with the appurtenanoes
thereto, be, and the same is hereby, accepted, and that a contract
for the construotion and completion of said public improvement be,
and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the suooessful bidder or
bidders upon eaoh contract awarded as hereinabove set forth shall
be, and they are hereby reqUired to exeoute a contraot in the required

form with the City of Anaheim upon the terms and conditions speci:t'ied
in the notice inviting sealed proposals and the proposal submitted
by said success:t'ul bidder or bidders and in accordance with the plans
and specifioations for said public improvement hereinabove described
and in accordance with the terms, conditio~s and provisions of this
resolution, and that said successful bidder or bidders to whom each
contract is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (100%) of the oontract price for
all labor, materials and equipment to be furnished and per:t'ormed as
set forth in the sealed proposals submitted by said bidder for the
construction of said pUblic improvement together with the appurtenanoes
thereto or such portion thereof as is covered by said contraot as
security for the faithful performanoe of said contraot and a separate
surety bond in an amount equal to one hundred per cent (100%) of the
construct.1on cost of said public improvement covered by said oontraot
as security for the payment of all persons performing labor and furn-
ishing material for'saia project. -
AND BE IT FURTHER RESOLVED thB.t said successful bidder or
bidders be, and they are hereby required to furnish to the City of
Anaheim in oompanies satisfactory to the Oity of'Anaheim public
liability, property damage, compensation, and other insurance in
the amounts and for the purposes as set forth and speoified in the
notioe inviting sealed proposals and subJeot to the approval of the
Oity Attorney as ~o form and sufficienoy,
AND BE IT FURTHER RESOLVED that the Mayor and the City Olerk
of the City of Anaheim be, and they are hereby, authorized and direoted
to make, exeoute and enter into for and on behalf of the City of Ana-
heim a written contract with said successful bidder or bidders for the
furnishing of all plant, labor, materials, and equipment and performing
all work as hereinabove more particularly described tor the construc-
tion, installation and completion of said pUblio improvement herein-
above described upon the terms and conditions as speoified in the
notioe inviting sealed proposals, the detailed design, plans, profiles,
drawings and general specifications and detailed speoifioations and
drawings and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the offioe
of the Oity Clerk of the City of Anaheim and in striot acoordanoe with
the terms, conditions and provisions of this Resolution, and in accord-
ance with all the contract documents herein specified.
THE FOREGOING RESOLUTION is signed and approved by me this
