4202ORDINANCE NO. 4202
AN ORDINANCE OF THE CITY OF ANAHEIM AMEND-
ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE
RELATING TO ZONING.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT:
WHEREAS, the Planning Commission did adopt its Resolution
No. determining that a change or changes
in the zone or zones hereinafter mentioned and described should be
made as hereinafter set forth after a duly noticed hearing; and
WHEREAS, certain conditions and requirements were made as
conditions -precedent to the making of a change or changes of said
zone or zones, which conditions have been complied with.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:
SECTION 1.
That Title 18 of the Anaheim Municipal Code relating
to Zoning be, and the same is hereby, amended by changing the
boundaries of the zones set forth in said Title 18 by adopting
a sectional zoning map or maps showing such change or changes as
follows:
That all of the area situated in the City of Anaheim,
County of Orange, State of California, described as follows, to
wit:
Tract No. 10437 as shown in Book 479, Pages 37,33, and
39 of Miscellaneous Maps on File in the Office of the
Recorder of Orange County, California.
now is "RS -A-43,000 RESIDENTIAL AGP.ICULTURAL ZONE and that it be
changed to and incorporated in "RM -3000" RESIDENTIAL -MULTIPLE
FAMILY ZONE subject to the following conditions:
1. That trash storage areas shall be provided in
accordance with approved plans on file with the Office of the
Director of Public Works.
2. That fire hydrants shall be installed and charged
as required and determined to be necessary by the Chief of the
Fire Department prior to commencement of structural framing.
3. That subject property shall be served by underground.
utilities.
4. That a 6 -foot high masonry wall shall be constructed
along the north property line and that an 8 -foot high masonry
wall shall be constructed along the west property line.

5. That drainage of subject property shall be
disposed of in a manner satisfactory to the City Engineer.
6. That the owner of subject property shall pay
to the City of Anaheim the appropriate park and recreation in -lieu
fees as determined to be appropriate by the City Council, said
fees to be paid at the time the building permit is issued.
7. That a modified cul-de-sac shall be provided at
the terminus of Yale Avenue subject to the approval of the
City Engineer.
8. That the appropriate water assessment fees as
determined by the Director of Public Utilities shall be paid to
the City of Anaheim prior to the issuance of a building permit.
9. That the developer(s) of subject property provide
for emergency fire access to all units within the project as
approved by the Tire Chief, and that said adequate on-site
circulation may be provided by a suitable through access for
emergency vehicles, as stipulated to by the petitioner, or if
such an emergency access system cannot be provided, the Fire
Department has the option of requiring an eight (8) foot high
solid gate for emergency vehicle access from Yale Avenue; provided
that any modification to the interior circulation plan as
presented to the Planning Commission shall be reviewed by the
Planning Commission prior to the issuance of a building permit.
10. That a medium shall be provided in Magnolia '°venue
to control left -turn traffic movements onto subject property,
as approved by the City Traffic Engineer.
11. That the developer(s) of subject property shall
provide and maintain a bicycle trail generally paralleling
the Carbon Creek Channel as approved by the City Traffic Engineer.
12. That Condition rlos. 1, 3, 4, 5, 7, 9, 10 and 11,
above-mentioned, shall be compiled with prior to final building
and zoning inspections.
SECTION 2.
The City Zoning Map shall be, and the same is hereby,
amended and the property above-described shall be excluded from
the zone in which it is now situated and incorporated in and made
a part of the zone or zones as above set forth, and said City
Zoning Map, as amended, is hereby adopted and the City Engineer
is hereby directed to prepare a sectional zoning map to be added
to the City Zoning Map showing the changes hereby approved and
adopted.

SECTION 3.
The City Clerk shall certify to the passage of this
Ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption in the Anaheim Bulletin,
a newspaper of general circulation, printed, published and cir-
culated in said City, and thirty (30) days from and after its
final passage, it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted, by the
City Council of the City of Anaheim this 30th day of December,
1980.
