AN ORDINANCE OF THE CITY OF ANAHEIM AMEND-
ING SUBSECTION .0518 OF SECTION 18.31.020,
SUBSECTIONS .012 AND .020 OF SECTION
18.31.061, SUBSECTIONS .011, .012 AND .032
OF SECTION 18.31.062, AND SUBSECTION .010 OF
SECTION 18.31.066, AND ADDING NEW SUBSECTION
.060 TO SECTION 18.31.050, AND NEW SUBSEC-
TION .013 TO SECTION 18.31.062, OF CHAPTER
18.31 OF TITLE 18 OF THE ANAHEIM MUNICIPAL
CODE RELATING TO ZONING.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That Subsection .0518 of Section 18.31.020 of Chapter 18.31
of Title 18 of the Anaheim Municipal Code be, and the same is hereby,
amended to read as follows:
11.0518 Conversion of Existent Apartments or Structures.
Any person, firm, partnership, corporation or
other entity proposing to convert an existing apartment
or like structure to a condominium, community apartment
or stock cooperative shall first apply for and obtain a
Condominium Conversion Permit from the Zoning Division of
the Planning Department. Such permit shall be issued
only after it has been determined that the existing
structure conforms to the site development standards for
Residential Planned Unit Developments and the provisions
of this chapter, and is in compliance with the Uniform
Building Code as adopted by the City of Anaheim."
SECTION 2.
That Subsections .012 and .020 of Section 18.31.061 of
Chapter 18.31 of Title 18 of the Anaheim Municipal Code be, and the
same are hereby, amended to read as follows:
".012 Attached or semi -attached one -family dwellings,
two-family or multiple -family dwelling units: three
thousand (3000) square feet for each dwelling unit ex-
cluding any public streets or alleys."

".020 Where there are existing buildings and structures
on a site for which more intensive development is proposed
under the provision of this zone, no building permit shall
be issued until the Chief Building Inspector and the Fire
Chief have certified that the existing buildings and struc-
tures are safe for occupancy and for human habitation.
Further, no dwelling unit originally designed or intended
as an apartment unit or other structure shall be sold as
a separate living unit, either as a condominium or com-
munity apartment, except in compliance with the site develop-
ment standards of this chapter as verified by the issuance of
a Condominium Conversion Permit by the Zoning Division of the
Planning Department."
SECTION 3.
That Subsections .011 and .012 of Section 18.31.062 of
Chapter 18.31 of Title 18 of the Anaheim Municipal Code be, and the
same are hereby, amended, and new Subsection .013 be, and the same
is hereby, added to Section 18.31.062 of Chapter 18.31 of Title 18
of the Anaheim Municipal Code, all to read as follows:
11.011 The maximum height of any building shall not
exceed thirty-five (35) feet, exclusive of roof structure;
provided, however, that buildings exceeding thirty-five
(35) feet in height may be permitted by conditional use
permit."
".012 Within 150 feet of any agricultural or single-
family residential zone (other than a public site or
RS -A-43,000 zoned property which has been developed or
approved for development of uses other than those listed
as permitted primary uses in said zone), the maximum height
of any building other than detached one -family dwellings
shall not exceed one (1) story, exclusive of roof struc-
ture, unless detailed drawings are submitted to, and ap-
proved by, the Building and Zoning Divisions showing that
no proposed buildings greater than one-story in height
visually intrude on any abutting or adjacent single-family
dwelling; in no event, however, shall any such building be
located less than fifty (50) feet from any such residential
zone. Required proof that there will be no visual intrusion
shall consist of a physical screening of vision from the
proposed building including, but not necessarily limited to:
terrain differentials; garages or single -story structures
-' located in a manner to preclude visual intrusion; blank
building walls without windows; and orientation of windows
and balconies in a way which will not overlook single-family
dwellings or visually intrude on the privacy of such
dwellings."

".013 Under no circumstances shall the height of any
habitable building or structure (other than detached
single-family dwellings) exceed one-half (1/2) the dis-
tance from said building or structure to the adjacent
agricultural or single-family zone boundary, excepting as
otherwise provided in Section 18.31.063 'Structural Set-
back and Yard Requirements.'"
SECTION 4.
That Subsection .032 of Section 18.31.062 of Chapter 18.31
of Title 18 of the Anaheim Municipal Code be, and the same is hereby,
amended to read as follows:
".032 Attached or semi -attached one -family dwellings,
two-family and multiple -family dwellings:
.0321 Bachelor units: 550 square feet. Provided,
however, that the number of bachelor units shall not ex-
ceed twenty percent (20%) of the entire project.
.0322 One -bedroom units: 750 square feet.
.0323 Two-bedroom units: 950 square feet.
.0324 Three-bedroom units: 1150 square feet.
.0325 Four-bedroom units: 1350 square feet.
For purposes of this section, all rooms other
than a living room, dining room, kitchen, bathroom or
closet shall be considered a bedroom."
SECTION 5.
That Subsection .010 of Section 18.31.066 of Chapter 18.31
of Title 18 of the Anaheim Municipal Code be, and the same is hereby,
amended to read as follows:
11.010 Minimum Number and Type of Parking Spaces.
Not less than two (2) parking spaces shall be
provided for each bachelor unit and not less than two
and one-half (2.5) parking spaces shall be provided for
each one -bedroom or larger unit; provided, however,
that not less than three and one-half (3.5) parking
spaces shall be provided for each unit in excess of
1225 square feet in area and located adjacent to a
private street. At least two (2) spaces per dwelling
unit shall be enclosed in a garage. In computing
total parking spaces, fractional requirements shall be
rounded off to the next higher whole number."

SECTION 6.
That new Subsection .060 be, and the same is hereby, added
to Section 18.31.050 of Chapter 18.31 of Title 18 of the Anaheim
Municipal Code to read as follows:
".060 Buildings and structures exceeding thirty-five
(35) feet in height."
SECTION 7. SEVERABILITY.
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this ordi-
nance of the Code, hereby adopted, be declared for any reason to be
invalid by a court of competent jurisdiction, it is the intent of
the Council that it would have passed all other portions of this
ordinance independent of the elimination herefrom of any such por-
tion as may be declared invalid.
SECTION 8. SAVINGS CLAUSE.
Neither the adoption of this ordinance nor the repeal
hereby of any other ordinance of this City shall in any manner
affect the prosecution for violations of ordinances, which viola-
tions were committed prior to the effective date hereof, nor be
construed as a waiver of any license or penalty or the penal pro-
visions applicable to any violation thereof. The provisions of
this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
SECTION 9.
The City Clerk shall certify to the passage of this or-
dinance and shall cause the same to be printed once within fifteen
(15) days after its adoption in the Anaheim Bulletin, a newspaper
of general circulation, printed, published and circulated in said
City, and thirty (30) days from and after its final passage, it
shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted by the
