A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM OPPOSING THE RECOMMENDATIONS BY
THE ADVISORY COMMISSION ON INTERGOVERNMENTAL
RELATIONS.
WHEREAS, the Advisory Commission on Intergovernmental
Relations, in its report titled "Building Codes: A Program
for Intergovernmental Reform," has recommended a program of
federal and state activity including:
1. Development of federal and state model codes,
2. Establishment of federal and state research and
testing procedures,
3. Establishment of board of appeals at the state
level,
4. Required state licensing of inspectors, and a
creation of a state agency to establish minimum
staffing and training requirements in local
jurisdictions; and
WHEREAS, similar proposals have been evaluated and
the principals found lacking as evidenced in "Building Codes
for Community Development and Construction Progress," published
by the United States Chamber of Commerce; and
WHEREAS, the proposed program will result in the
further diminishing of the authority of local legislators to
deal effectively with local problems; and
WHEREAS, the proposed program will preempt local
adoption of model codes and amendments thereto, thereby pro-
hibiting legislative initiative to account for unusual local
conditions and to modify such regulations which have proven to
be unsafe, unsound, unclear or in conflict with other regula-
tions; and
WHEREAS, the present model code organizations research
programs, procedures for acceptance of alternate materials and
methods of construction are presently effective and continually
being improved to the benefit of local government and the con-
struction industry.
WHEREAS, the entire construction industry actively
and progressively supports adoption of a model code that is
amended annually to keep pace with new developments in the con-
struction industry.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of Anaheim recommends to the League and to its
member cities that in order to preserve local autonomy, this
body is opposed to those recommendations by the Advisory Commis-
sion on intergovernmental Relations in its report titled
"Building Code: A Program for Intergovernmental Reform" that
would include:
1. Development of federal and state model codes,
2. Establishment of federal and state research and
testing procedures,
3. Establishment of board of appeals at the state
level, and
4. Required state licensing of inspectors, and a
creation of a state agency to establish minimum
staffing and training requirements in local
jurisdictions.
BE IT FURTHER RESOLVED, that a copy of this Resolution
be sent to the League of California Cities, appropriate state
and federal legislators and all interested parties and agencies
in order to present the position of this organization with
respect to this serious move by the Federal Government to en-
croach upon local autonomy.
THE FOREGOING RESOLUTION is approved and signed by
me this 1st day of November, 1966.
