A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO, 1828
WHEREAS, the City Planning ommission of the City of
Anaheim did receive a petition for joning variance from
HENRY WAGNER, owner
of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:
The north 173 feet of the south 203 feet of the
west 398 feet of the east 428 feet of Lot 20
of the Anaheim Extension, in the City of Anaheim,
County of Orange, State of California, as shown on
a map thereof recorded in Book 3, pages 162 to 164,
inclusive, of Miscellaneous Records in the Office of
the County Recorder of Los Angeles County, California,
said distances being measured from the center lines of
Ball Road and State College Boulevard, as shown on
the map of Tract No. 4757 recorded in Book 184, pages
47 and 48 of said Miscellaneous Maps;
EXCEPTING THEREFROM the westerly 95 feet;
ALSO EXCEPTING THEREFROM the easterly 243 feet.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim on
September 26, 19 66 notice of which said public hearing was
duly given as required by law and the provisions of .Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission after due
inspection, investigation_and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No.
Lg= PC66 -100 denying Variance No. _.828 and
WHEREAS, thereafter within twenty-two (22) days from
the date of the adoption of said resolution, the. City Council did
elect, upon its own motion, to review the action taken by the City
Planning Commission in degvi g said variance and did set a
public hearing thereon to be held on the h day of Q& obe
An 966 at 7:00 o'clock P.M. in the Cil in the City of
aheim, and notice of such public hearing was duly given as
required by law and the provisions of Title 18, _Chapter 18.76 of
the Anaheim Municipal Code; and
WHEREAS, the City Council does find that:
1. There is no substantial property right, possessed
by other property in the same vicinity and zone
and denied the subject property.
2. It appears that the subject property can be
adequately developed and used under the present
zone.
THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commission

denying Variance No. 1828 be, and the same is hereby sustained,
and that the petition of Henry Wagner for a zoning variance to
permit the establishment of retail stores on the property
hereinbefore described, be, and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by
me this 25th day of October, 1966.
