ORDINANCE NO. 4333
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
SECTION 1704 OF THE UNIFORM BUILDING CODE BY
THE ADDITION OF NEW SECTION 15.04.1704 TO
CHAPTER 15.04 OF TITLE 15 OF THE ANAHEIM
MUNICIPAL CODE RELATING TO ROOFS, DECLARING
THE URGENCY THEREOF, AND DECLARING THAT THIS
ORDINANCE SHALL TAKE. EFFECT IMMEDIATELY.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That new Section 15.04.1704 be, and the same is hereby,
added to Chapter 15.04 of Title 15 of the Anaheim Municipal Code,
to read as follows:
SECTION 15.04.1704 ROOFS.
Section 1704 of the Uniform Building Code is hereby
amended to read as follows:
Section 1704. Notwithstanding any other provision of
this Building Code and Appendix to the contrary, the
roof covering of any building hereinafter constructed
regardless of Type or Occupancy classification, including
any re -roofing of any existing building as specified in
Chapter 32 of the Appendix hereto, shall be of noncombusti-
ble or fire -retardant construction as defined in Section
3203(e) of this Code.
Skylights shall be constructed as required in Chapter 34.
_Penthouses shall be constructed as required in Chapter 36.
For use of plastics in roofs, see Chapter 52.
For Attics: Access and Area, see Section 3205. For
Roof Drainage, see Section 3207.
SECTION 2. PENALTY
It shall be unlawful for any person, firm or corporation
to violate any provision or to fail to comply with any of the re-
quirements of this ordinance. Any person, firm or corporation
violating any provision of this ordinance or failing to comply with
any of its requirements shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be punished by a fine not exceed-
ing Five Hundred Dollars ($500.00) or by imprisonment not exceeding
six (6) months or by both such fine and imprisonment. Each such
person, firm or corporation shall be deemed guilty of a separate

offense for each day during any portion of which any violation of
any of the provisions of this ordinance is committed, continued
or permitted by such person, firm or corporation, and shall be pun-
ishable therefor as provided for in this ordinance.
SECTION 3. DECLARATION OF URGENCY
The City Council of the City of Anaheim hereby declares this
ordinance to be necessary as an emergency measure for the immediate
preservation of the public health or safety. A statement of the rea-
sons for its urgency is as follows:
1. The provisions of the Uniform Building Code, 1979 Edition,
as heretofore adopted by the City of Anaheim currently permit the
use of nonfire-retardant materials in the construction of building
roofs within the City of Anaheim.
2. In the event of fire, such construction could contribute to
the spread thereof to adjacent and surrounding buildings especially
during period of high velocity winds which often occur in the City of
Anaheim.
3. On April 21, 1982, during high winds, a fire occurred in a
residential area of the City which spread to and destroyed numerous
other residential and nonresidential buildings having nonfire-retardant
roofs destroying approximately 500 dwelling units and leaving approxi-
mately 1500 people homeless. Some buildings in the path of the fire
and having fire -retardant roofs were not destroyed.
4. Other nonfire-retardant roofs will continue to be built
within the City of Anaheim unless this ordinance is given immediate
effect.
SECTION 4. DECLARATION OF IMMEDIATE EFFECT
For the reasons set forth in Section 3 above, this ordinance
shall take effect and be in full force immediately upon and after its
adoption.
SECTION 5. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent to the elimina-
tion herefrom of any such portion as may de declared invalid.

SECTION 6. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal or
amendment hereby of any other ordinance of this City shall in any
manner affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date hereof, nor
be construed as a waiver of any licenses or penalty or the penal
provisions applicable to any violation thereof. The provisions of
this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
SECTION 7.
The City Clerk shall certify to the passage of this or -
(15) days after its adoption in the Anaheim Bulletin, a newspaper
of general circulation, printed, published and circulated in said
City.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 27th day of April, 1982.
