ORDINANCE NO. 4380
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
TITLE 6, CHAPTER 6.40, SECTIONS 6.40.050 AND
6.40.055 OF THE ANAHEIM MUNICIPAL CODE BY
REPEALING SECTIONS 6.40.050 AND 6.40.055, AND
ADDING NEW SECTIONS 6.40.050 AND 6.40.055 IN
THEIR PLACE RELATING TO PUBLIC DISPLAYS.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1:
That Title 6, Chapter 6.40, Sections 6.40.050 and
6.40.055 of the Anaheim Municipal Code be, and the same are
hereby, amended by repealing Sections 6.40.050 and 6.40.055 and
adding new Sections 6.40.050 and 6.40.055 in their place to read
as follows:
"6.40.050 PERMIT FOR PUBLIC DISPLAYS.
Notwithstanding any other provisions of this
Chapter, the Fire Chief of the City of Anaheim may
grant permits for public displays of fireworks.
Applications for such permits shall be filed with
the Fire Chief not less than ten (10) days before
the public display and shall be accompanied by a
detailed statement of the items of the proposed
display. If the permit is granted, no items shall
be displayed except as are contained in the
statement and the Fire Chief may in granting the
permit eliminate from the statement such items as he
deems hazardous and it shall be unlawful for the
grantee of the permit to exhibit or display the
eliminated items. The public display shall be under
the supervision of the Fire Chief and such persons
as he shall designate and authorize. The fee for
the permit shall be twenty-five dollars for each
display. The display shall be held at the place and
time designated in the permit and under no
circumstances shall the display be held in Fire Zone
No. 1 of the City."
"6.40.055 TIMES PERMITTED.
It is unlawful for any holder of a public display
permit to discharge any fireworks in the City of
Anaheim from the hours of 10:00 P.M. to 8:00 A.M.
unless permitted by the Fire Chief as an exception
to this time limit."
SECTION 2: SEVERABILITY.
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
chapter of the Code, hereby adopted, be declared for any reason to
be invalid, it is the intent of the Council that it would have
passed all other portions of this chapter independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 3:
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption in the Anaheim Bulletin, a
newspaper of general circulation, printed, published and
circulated in said City, and thirty (30) days from and after its
final passage, it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 14th day of December, 1982.
