4383 (2)t ORDINANCE NO. 4383 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING CHAPTER 18.06 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "CHAPTER 18.06 VEHICLE PARKING AND LOADING REQUIREMENTS 18.06.010 LOCATION OF REQUIRED PARKING SPACES. .010 Residential Uses. Required off-street parking spaces for ail residential uses of property shall be located on the same lot as the dwelling unit for which such parking is required. Said parking spaces and accessways shall at all times be maintained in a manner capable of normal vehicular ingress and egress. .020 Nonresidential Uses. For uses other than residential, required off-street parking spaces shall be located on the same lot as the main building for which such parking is required, or on property immediately contiguous to said lot provided said parking is located thereon within reasonable walking_ distance from such building. Where the Planning Director finds that there are exceptional or extra- ordinary circumstances applicable to the site of the use to be served which would render strict conform- ance with the provisions of this subsection unreason- able, said required off-street parking may be provided adjacent to, or within close proximity to, said site as provided hereinafter. All property used for such off-site parking shall be under joint owner- ship, or under agreement approved as to form by the City Attorney. Said agreement shall be recorded in the office of the county recorder and a recorded copy t thereof filed with the Planning Department prior to the issuance of any building permits. Said agreement shall specify the number and location of the off-site parking spaces and shall assure that said spaces shall be accessible and available at all times for parking in conjunction with the use for which said parking spaces are required. Termination of said agreement without providing said required off-street parking in an alternate manner otherwise permitted hereunder shall constitute a violation of this subsection of the Code. 18.06.020 LAYOUT AND DESIGN OF PARKING AREAS. All references in this Chapter to "Standard Plans" or "Engineering Details" shall refer to documents on file in the Department of Public Works of the City of Anaheim including amendments to such documents as from time to time approved by resolution of the City Council. .010 Layout and Design. All off-street parking areas shall be designed and improved in compliance with the provisions of Standard Plans No. 601 and 602 entitled "Minimum Off -Street Parking Dimensions"; provided, however, that where it can be shown that unusual site conditions or topography require modification in the off-street parking area standards to permit reasonable development of such property, such modifications may be approved by the Planning Director. Such modifications shall be limited to matters of layout and design of the park- ing area and in no case shall result in a reduction of the minimum number of off-street parking spaces required by this Code. .020 Parking Structures. All parking facilities shall be designed and improved in compli- ance with the provisions of Standard Plan No. 135 entitled "Driveway Standard Detail" and Standard Plan No. 402 entitled "Parking Structure Standard Detail." .030 Handicapped Parking. Provision shall be made for handicapped parking as otherwise required by law and in compliance with Standard Plan No. 436 entitled "Handicapped Parking Standard Detail." .040 Tandem Parking. Tandem parking for required off-street parking spaces shall be prohib- ited except as otherwise expressly authorized herein. -2- 18.06.030 REQUIRED IMPROVEMENT OF PARKING AREAS. All vehicle parking and outdoor storage areas shall be fully paved and surfaced so as �---- to eliminate dust and shall be further improved as follows: .010 Adjacent to Residential Zones. A solid fence or wall six (6) feet in height shall be provided adjacent to any nonresidential parking area that abuts any residentially zoned lot. Within the front portion of such parking area, said fence or wall shall be reduced to thirty-six (36) inches in height to a depth equal to the required front yard depth of the adjoining residential property with the exception of Area E, "Line of Sight for Pedestrians," as shown on Standard Plan No. 135 entitled "Driveway Standard Detail." Bumper guards shall be installed and main- tained to protect the fence or wall. Placement shall be a minimum of thirty (30) inches from the wall. .020 Adjacent to Street Frontages. In instances where fences or walls are not required, a suitable concrete curb not less than six (6) inches in height shall be securely installed and maintained adja- cent to the boundary of any parking area abutting a street in a manner such that vehicles may not encroach or intrude into the public right-of-way, required land- scaped setback or pedestrian walkway as shown on Standard Plan No. 602 entitled "Minimum Off -Street Parking Dimensions - Sheet 2." .030 Lighting of Parking Areas Adjoining Residential Premises. Any lights provided to illumin- ate such parking areas shall be so arranged and direc- ted as to reflect the light away from adjoining resi- dential premises and shall not exceed a height of twelve (12) feet. 18.06.040 PARKING SPACE AND ACCESS DESIGN. Except as otherwise provided herein, the following minimum standards shall apply: .010 Minimum Dimensions of Vehicle -Accessways. The minimum turning radius of any vehicle accessway shall be not less than twenty-five (25) feet except as provided for angle parking in accordance with Standard Plans No. 601 and 602 entitled "Minimum Off - Street Parking Dimensions"; provided, further, that all covered or enclosed residential parking spaces shall have a minimum clear horizontal access width of not less than nine (9) feet. -3- .020 Minimum Dimensions of Parking Spaces. Except for parallel parking spaces which in any zone shall have minimum dimensions of at least eight (8) feet in width by twenty-two (22) feet in length, the minimum dimensions of any parking spaces shall be as follows: ZONE Residential Residential Nonresidential TYPE OF SPACE coveredl or private garage open covered or open STANDARD CAR SMALL CAR 10' x 20' 8 1/2' x 19' or 9' x 18' 8 1/2' x 19' or 9' x 18' not applicable 7 1/2' x 15' 7 1/2' x 15' 111inimum dimensions of covered residential spaces may be reduced to 8 1/2' x 20' provided said space is not adjacent to any wall, column, pole or other structural element. The minimum span between structural elements shall be 28 1/2' and shall be subject to the approval of the Building Department. .025 Any required covered parking spaces shall be visually screened by solid components amounting to not less than 50% of each wall. Such screening may consist of solid walls, wood lattice work, or other architectural devices. .030 Small Car Stalls. All required parking spaces shall comply with the standard car dimensions specified in Subparagraph .020 above except as follows: .031 A maximum of twenty-five percent (25%) of the total number of required off-street parking spaces other than covered residential spaces may be provided in small car stalls of minimum dimensions as set forth in Subsection .020 above. -4- .032 Additional small car spaces in lieu of required standard car spaces shall be subject to the ap- proval of the Planning Director upon a finding that such modification would not be detrimental to the public wel- fare and interest and based upon information contained in a parking demand study prepared by an independent traffic engineer licensed by the State of California, or such other study as approved by the City Traffic Engineer, and provided to the City by the developer at such party's sole expense. In no case, other than covered residential spaces, shall the number of small car spaces approved hereunder exceed thirty-five percent (35%) of the total number of required parking spaces. .033 Designations. All small car spaces shall be clearly and distinctively marked as small car spaces by signs or other markings approved by the Planning Director as shown on Standard Plan No. 602 entitled, "Minimum Off -Street Parking Dimensions - Sheet 2." 18.06.050 MINIMUM NUMBER, TYPE AND DESIGN OF OFF-STREET PARKING SPACES AND AREAS. The minimum number of off-street parking spaces provided for any land use shall not be less than the following numbers given for subject use(s); provided, however, that any use not listed below shall provide a minimum of nine tenths (0.9) of one space per each em- ployee on the largest work shift, plus such additional parking as is determined to be reasonably necessary by the Planning Director to meet the parking demand for such use. Where a combination of uses is proposed, the mini- mum number of spaces provided shall be not less than the sum total of the requirements for each individual type of use to be established. For purposes of interpretation of this section, all rooms other than a living room, dining room, bathroom, hall lobby, closet or pantry shall be consi- dered as a bedroom. Further, in computing parking requirements, fractional requirements shall be rounded off to the nearest whole number, fractions of one-half (0.5) or more being counted as one full space. .010 Residential Uses: .011 Single -Family Dwellings. A total of not less than four (4) off-street parking spaces shall be provided on-site for any single-family detached dwelling, not less than two (2) of which shall be provided in a garage. Any remaining required spaces not provided in a garage shall be provided on a paved driveway or other suitable on-site location as approved by the Planning Department having minimum dimensions of 16 feet wide and 25 feet long measured from the garage door to the nearest edge of the pedestrian walkway or property line, which- ever is the lesser distance. -5- .012 Multiple -Family Dwellings including attached or semi -attached condominiums, stock coopera- tives, townhomes, rowhouses, rental apartments or other forms of clustered dwellings: .0121 Not less than two (2) off-street parking spaces for each bachelor unit; and not less than two and one-half (2.5) parking spaces for each one - bedroom or larger unit; provided, however, that not less than three and one-half (3.5) parking spaces shall be provided for each unit in excess of 1225 square feet in area and having vehicular access from a private street. At least two (2) parking spaces per dwelling unit shall be covered, except that only one (1) required space for each bachelor unit need be covered. One quarter (.25) space per dwelling unit shall be reserved for guest parking and shall be clearly indicated for guest parking only and shall be readily accessible to motorists from contiguous streets and/or accessways. .0122 All covered spaces shall be located within 100 feet of, and be readily accessible to, the dwelling unit served. Required open spaces shall be located within 200 feet of the unit served. .0123 Tandem parking of not more than two (2) vehicles deep shall be permitted for required covered parking when the two (2) spaces are assigned to the same dwelling unit. Required open spaces shall be permitted in tandem to covered spaces and shall be provided in a driveway having minimum dimensions of 16 feet wide and 25 feet long. Tandem open spaces shall be assigned to the same dwelling unit. Tandem parking shall be permitted on only one side of any driving aisle. .0124 Any open small car spaces shall be equally distributed between resident and guest parking areas. .0125 Required open spaces for residents and tenants shall be unassigned, except as provided in Section 18.06.050.0123 and no fee shall be assessed for their use. .0126 Parking areas shall be screened by means of plant landscaping or architectural devices from adjacent streets and properties and from living or recreational -leisure areas to a height of 36 inches with the exception of Area E, "Line of Sight for Pedestrians," as shown on Standard Plan No. 135 entitled "Driveway Standard Detail." .0127 Any interior walls of covered parking areas shall be finished with exterior finish material. General storage cabinets of not less than one hundred (100) cubic feet capacity shall be provided for each dwelling unit and shall be located within the covered parking area or conveniently located thereto. Adequate bumper guards shall be provided to protect any interior walls from damage. .013 Retirement Dwellings: Active senior citizen facilities con- taining apartments with or without cooking facilities: Four-fifths (0.8) of a covered parking space shall be provided for each living unit, located so as to minimize walking distances from the living area to the parking facility. Spaces shall be unassigned and equally avail- able to all residents, guests or employees. Inactive senior citizen facilities containing on-site medical facilities shall comply with the provisions of Section 18.06.050.0269. .014 Mobilehomes: Two (2) parking spaces (which may be tandem) on-site adjacent to the mobilehome, plus one (1) guest space for every four (4) mobilehomes. Guest parking shall be located within 200 feet of each mobilehome served and may be provided along any private street (designed and improved in com- pliance with Standard Detail No. 122 entitled "Private Street") and serving the interior circulation of a mobilehome park. .020 Commercial Uses: For purposes of interpretation of this section, "GFA" shall mean gross floor area of buildings as measured from exterior wall to exterior wall. If the GFA upon which the number of parking spaces is based is less than 1000 square feet (or other unit of measurement as designated herein), the minimum number of required spaces shall be prorated in direct proportion to the minimum number of spaces required for each 1000 square feet (or other unit of measurement designated herein). Such proration shall also apply in instances where a division of such applicable unit of measurement into the GFA produces a quotient of other than a whole number. Unless otherwise expressly provided herein, any employee parking space requirements shall be based upon the maxi- mum number of employees present at any given time. -7- .021 Office Uses: .0211 Medical and/or Dental Offices: Six (6.0) spaces per 1000 square feet of GFA. .0212 Professional and General Business Offices and Research and Development: Four (4.0) spaces per 1000 square feet of GFA for buildings of three stories or less; three and one-half (3.5) spaces per 1000 square feet of GFA for buildings of more than three but less than ten stories; and three (3.0) spaces per 1000 square feet of GFA for buildings of ten stories or more. .022 General: square feet of GFA; five (5.0) 100,000 square Retail Stores and Service Businesses - Five and one-half (5.5) spaces per 1000 GFA for the first 100,000 square feet of spaces per 1000 square feet of GFA over feet. .0221 Financial Institutions: Five (5.0) spaces per 1000 square feet of GFA for facilities without drive -up windows; six (6.0) spaces per 1000 square feet of GFA for facilities with drive -up windows. .0222 Automotive Repair Facilities: Five and one-half (5.5) spaces per 1000 square feet of GFA. .0223 Automotive Sales Facilities: One (1.0) space per each ten (10) display cars which parking spaces shall be provided in a designated customer parking area or street parking bay (as shown on Standard Plan No. 115-D entitled "Parking Bays," plus five and one-half (5.5) spaces per 1000 square feet of GFA. .0224 Kiosk Facilities (such as keys, film, etc.): One (1.0) space per twenty-five (25) square feet of GFA or five (5) spaces per facility whichever results in the greater number of spaces. .023 Eating and/or Drinking Establishments: .0231 Restaurants - Enclosed with or without bar or entertainment facilities and integrated in a planned development complex such as a shopping center, industrial complex, etc.: Eight (8.0) spaces per 1000 square feet of GFA. .0232 Restaurants - Enclosed with or without bar or entertainment facilities and not inte- grated in a planned development complex such as a shop- ping center, industrial complex, etc.: Seventeen (17.0) spaces per 1000 square feet of GFA. .0233 Restaurants - Walk up, Drive-in, Drive-through, Fast Food: Eighteen (18.0) spaces per 1000 square feet of GFA. -8- .024 Hotels/Motels: For the purpose of this section, no distinction is made between motels and hotels. The following minimum number of parking spaces shall be provided: Four-fifths (0.8) of a space per guest room, plus fifteen (15.0) spaces per 1000 square feet of GFA of eating/drinking areas, plus ten (10.0) spaces per 1000 square feet of banquet/meeting room areas, plus the fol- lowing employee spaces: One-quarter (0.25) space per each employee working in guest room areas; four and three-fifths (4.6) employee spaces per 1000 square feet of GFA for eating/drinking areas; one (1.0) employee space per 1000 square feet of GFA for retail areas; five (5.0) employee spaces per 1000 square feet of GFA for banquet/meeting rooms. .025 Amusement and Recreational Facilities: .0251 Theme Amusement or Recreation Type Facilities: Due to the unique nature of these types of uses, parking requirements shall be determined by the Planning Director and/or City Council based upon the nature and extent of the intended use and upon informa- tion contained in a parking demand study prepared by an independent traffic engineer licensed by the State of California, or such other study as approved by the City Traffic Engineer and provided to the City by the devel- oper at such developer's sole expense at the time of application for such use. .0252 Bowling Alleys: Three (3) spaces per bowling lane plus one space per each thirty-five (35) square feet of GFA used for public assembly, plus five and one-half (5.5) spaces per 1000 square feet of GFA used for other commercial purposes. .0253 Golf Course - General: Ten (10) spaces per hole plus one (1) space per each thirty-five (35) square feet of GFA used for public assembly, plus five and one-half (5.5) spaces per 1000 square feet of GFA used for other commercial purposes. .0254 Golf Course - Miniature: Twenty (20) spaces per course, plus one space per each employee. .0255 Golf Driving Range: One (1) space per driving tee. .0256 Skating Pinks - Ice or Roller: Two and four -tenths (2.4) spaces per 1000 square feet of GFA. 19%Z .0257 Racquetball Facilities: Six and three -tenths (6.3) spaces per court. .0258 Tennis Facilities: Five and three -tenths (5.3) spaces per court. .0259 Theaters: Live Performance: Four -tenths (0.4) space per seat plus nine -tenths (0.9) space per employee, including performers. Single -Screen Motion Picture Theater: Six -tenths (0.6) space per seat plus five (5) employee spaces. Multi -Screen Movie Theater: Three -tenths (0.3) space per seat plus seven (7) employee spaces. .026 Educational and Institutional Uses: .0261 Business Schools. Trade Schools and Training Centers: One (1) space per each ten (10) square feet of GFA or per each fixed seat in places of instruction or assembly, whichever results in the higher number of parking spaces, and one (1) space per each 333 square feet of GFA in areas where heavy equipment is used in conjunction with training or instruction. .0263 Auditoriums - Elementary, Jr. and Senior High Schools, Colleges and Universities, and other places of occasional assembly: One (1) space per each seventy (70) square feet or per each ten (10) fixed seats in the main assembly area, whichever results in the greater number of parking spaces. .0264 Auditoriums (other than school auditoriums), Convention Halls, Clubs, Lodges, and Other Places of General Assembly: One (1) space per each thirty-five (35) square feet of seating or viewing area in the main assembly area, or one (1) space per each five (5) fixed seats, whichever results in the greater number of parking spaces, plus one (1) space per each employee. .0265 Art Galleries with accessory retail sales, Exhibition Halls, and Museums: Three and three -tenths spaces per 1000 square feet of GFA. .0266 Churches, Synagogues and Other Places of Religious Worship: Three -tenths space per fixed seat in the sanctuary and fifteen (15) spaces per 1000 square feet of GFA in places of instruction or main assembly without fixed seats. -10- .0267 Hospitals and Other In-patient Care Facilities: Four (4) spaces per hospital bed. .0268 Child Day Care Centers, Preschools and Nurseries: One (1) space per each employee plus an on-site vehicle loading and unloading area for children. .0269 Convalescent Homes: One-half (0.5) space per living unit or each bed in a dormatory residence. .027 Transportation Terminals and Heliports: Due to the unique nature of these uses, parking requirements shall be determined by the Planning Commission and/or City Council based upon the nature and extent of the intended use and upon information contained in a parking demand study prepared by an independent traffic engineer licensed by the State of California or such other study as approved by the City Traffic Engineer and provided to the City by the developer at such developer's sole expense for such use. .030 Industrial Uses: .031 General Industrial and Warehousing Uses: Two and one-fourth (2.25) spaces per 1000 square feet of GFA plus one (1) truck loading space for each 25,000 square feet of GFA as specified in Section 18.06.060.010. .032 Industrial Training Facilities: One (1) space per each ten (10) square feet of GFA or per each fixed seat in places of instruction or assembly, whichever results in the greater number of parking spaces, and three (3) spaces per each one thousand (1,000) square feet of gross building floor area in areas where heavy equipment is used in conjunction with instruction or training. .033 Outdoor Uses: One (1) space per each twenty-five hundred (2500) square feet of lot area devoted to outdoor uses, excluding parking areas and vehicular accessways, or one (1) space per each two (2) of the maximum contemplated number of employees to be engaged in the outdoor operation, whichever results in the greater number of parking spaces. .034 Truck Parking Requirements: In addi- tion to the above parking requirements, truck parking spaces, of a number and size adequate to accommodate the maximum number and types of trucks to be stored on the site at one time, shall be provided on each industrial site. -11- 18.06.060 TRUCK LOADING REQUIREMENTS. .010 Required Number and Size of Loading Spaces. Every commercial or industrial site located contiguous to a public alley shall be provided with at _least one (1) off-street or off -alley loading space having minimum dimensions of at least twelve (12) feet in width, twenty-five (25) feet in length, and fourteen (14) feet in height, per each twenty-five thousand (25,000) square feet of GFA or fraction thereof excluding residences located on such site. .020 Bays and Doors. Truck loading bays or overhead doors shall be located in a manner that would preclude any possibility for trucks to back into bays from arterial streets as designated on the Circulation Element of the Anaheim General Plan. 18.06.070 DRIVE-THROUGH AND DRIVE -UP LANE REQUIREMENTS. Any lane, route or path to which vehicles are directed expressly for the purpose of receiving goods or services without the customer leav- ing the vehicle, shall comply with the provisions hereinafter specified: .010 Design. Each drive-through lane shall be a separate lane from the circulation routes and lanes necessary for ingress to, or egress from, the property or access to any off-street parking spaces. Each such lane shall be striped, marked or otherwise distinctively delineated. .020 Lanes with Separate Ordering Devices. Each drive-through lane which utilizes a separately located ordering device shall have a mini- mum distance of 60 feet between the start of said lane and such ordering device and an additional minimum distance of 100 feet between such ordering device and the service window or area. Said distances shall be measured along the centerline of the prescribed vehi- cular path. .030 Lanes without Separate Ordering Devices. Each drive-through lane which does not utilize a separately located ordering device shall have a minimum distance of 100 feet between the start of said lane and the service window or area. Said distance shall be measured along the centerline of the prescribed vehicular path. -12- .040 Design of Multiple Lanes. The design of all drive-through lanes for any facility utilizing two (2) or more such lanes shall be subject to the approval of the Planning Director; design and approval shall be based upon information contained in a traffic engineering study prepared by an independent traffic engineer licensed by the State of California or such other study as approved by the City Traffic Engineer and provided to the City by the developer at such developer's sole expense at the time of application for such use. .041 Said study required by the provisions of this subsection shall contain and address the fol- lowing factors: .0411 Nature of the product or service being offered, including peaking characteristics for the 20 highest periods of the year. .0412 Method by which the order, request, sale, or service is processed. customer. .0413 Time required to serve typical .0414 Arrival rate of customers. .0415 Time period over which customers will arrive at stated rate. .0416 Anticipated length of queue. .0417 Discussion of ambient circula- tion and parking, either proposed or existing. .0418 Location of storage areas with respect to parking spaces or circulation aisles. .0419 Discussion of potential block- ages due to queue. .0420 Mitigation measures. .042 Said study shall include a scale drawing delineating all parking spaces, circulation facilities, driveways and the nearest public street. .043 Each such lane shall be designed to prevent circulation congestion, both on-site and on public and private streets and accessways. -13- 18.06.080 VARIANCES FROM PROVISIONS OF CHAPTER. Except as otherwise expressly provided herein, variances from any of the requirements of this Chapter shall be processed in accordance with the pro- cedures set forth in Chapter 18.03 of this Code appli- cable to zone variances provided, however, that any petition for such variance shall be accompanied by a parking demand study prepared by an independent traffic engineer licensed by the State of California, or such other study as approved by the City Traffic Engineer and provided to the City by the petitioner at peti- tioner's sole expense. Notwithstanding the require- ments of Section 18.03.040 of this Code to the con- trary, said variance shall be granted upon a finding by the Planning Commission or City Council that the evi- dence presented shows that all of the following conditions exist: .010 That the variance will not cause an increase in traffic congestion in the immediate vicin- ity nor adversely affect any adjoining land uses; and .020 That the granting of the variance under the conditions imposed, if any, will not be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim." SECTION 2. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chapter of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 3. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enact- ments. -14- SECTION 4. The provisions of this ordinance shall not apply to any development constructed pursuant to any zone reclassification, conditional use permit, zone variance or building permit approved by the City of Anaheim on or before the effective date of this ordinance including any extensions of time heretofore or hereinafter granted for any such zone reclassification, conditional use permit, zone variance or building permit. SECTION 5. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
