AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING AND
ADDING VARIOUS SUBSECTIONS, SECTIONS AND CHAPTERS
�... OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING
TO BED AND BREAKFAST INNS
FOLLOWS:
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That a new definition of "Bed and Breakfast Inn" be,
and the same is hereby added to Section 18.01.030 of Chapter
18.01 of Title 18 of the Anaheim Municipal Code, to be placed
in proper alphabetical sequence and to read as follows:
"Bed and Breakfast Inn. A building of resi-
dential design wherein lodging is provided to tourists
and wherein breakfast may also be provided to said
tourists. For purposes of this definition, the term
"tourist" shall mean persons renting such accom-
modations for a total period of time not to exceed
fourteen (14) days during any consecutive ninety (90)
day period."
SECTION 2.
That new Section 18.04.130 be, and the same is hereby,
added to Chapter 18.01 of Title 18 of the Anaheim Municipal
Code, to read as follows:
"18.04.130 BED AND BREAKFAST INN SITE DEVELOPMENT
STANDARDS. Where otherwise permitted or conditionally per-
mitted by any applicable provision of this Code, any Bed and
Breakfast Inn shall also comply with all of the following
provisions:
.010 Minimum Size of Structure. Said use shall be
located in a building of residential design having a minimum of
2,000 square feet of residential floor area.
.020 Owner or Manager in Residence. An owner,
manager, proprietor or caretaker of the property must reside on
the subject premises at all times.
.030 Signs. On -premises advertising for any Bed and
Breakfast Inn located in any zone shall be limited to either
one wall sign not more than two (2) square feet in area or one
single or double-faced freestanding sign not more than two (2)
square feet in area per sign face. The content of any such
sign shall be limited to identifying not more than the name and
address of the facility. No sign shall be internally
illuminated.
.040 Cooking Facilities. No cooking facilities shall
be permitted in any guest rooms.
.050 Meals. No meals shall be served to guests other
than breakfast. Said breakfast meal, if served, shall be
served only to registered overnight guests.
.060 Length of Occupancy. No guest shall be per-
mitted to rent accommodations or remain in occupancy for a
period in excess of fourteen (14) days during any consecutive
ninety (90) day period.
.070 Notwithstanding any other provision of Title 18
of this Code to the contrary with the exception of Section
18.04.130.080 hereof, Bed and Breakfast Inns may be located in
any single-family residences deemed by the City to be of
architectural and/or historical significance in any zone
provided a conditional use permit is obtained therefor and said
residence complies with all provisions of the Uniform Building
Codes as adopted by the City of Anaheim."
.080 Expiration of Permit. Any conditional use
permit issued by the City for any Bed and Breakfast Inn shall
be subject to an express condition that said permit shall
expire, and said use shall terminate (unless a new conditional
use permit is approved therefor), upon any transfer of
ownership of said property. Prior to the exercise of any
conditional use permit for any such use, the owner of the
property shall record a covenant against the property in a form
approved by the City Attorney providing for the expiration of
said permit and termination of said use as hereinabove set
forth which covenant shall be binding upon any successors in
interest to said owner.
SECTION 3.
That subsection .024 of Section 18.06.050 be, and the
same is hereby, amended to read as follows:
".024 Lodging Accommodations:
.0241 Hotels/Motels: For the purpose of this
paragraph, no distinction is made between motels and hotels.
The following minimum number of parking spaces shall be pro-
vided: Four-fifths (0.8) of a space per guest room, plus
fifteen (15.0) spaces per 1000 square feet of GFA of
eating/drinking areas, plus ten (10.0) spaces per 1000 square
feet of banquet/meeting room areas, plus the following employee
spaces: One-quarter (0.25) space per each employee working in
guest room areas; four and three-fifths (4.6) employee spaces
per 1000 square feet of GFA for eating/drinking areas; one
(1.0) employee space per 1000 square feet of GFA for retail
areas; five (5.0) employee spaces per 1000 square feet of GFA
for banquet/meeting rooms.

.0242 Bed and Breakfast Inns: One (1) parking
space for each bedroom in the residence, plus one (1) parking
space for each nonresident employee, plus one (1) additional
parking space for visitors. For purposes of this subsection
only, the term "bedroom" shall mean any room designed, intended
or primarily used for sleeping purposes.
SECTION 4.
That new Subsection .065 be, and the same is hereby,
added to Section 18.21.050 of Chapter 18.21, that new Sub-
section .005 be, and the same is hereby, added to Section
18.31.050 of Chapter 18.31, that new Subsection .005 be, and
the same is hereby, added to Section 18.32.050 of Chapter
18.32, that new Subsection .015 be, and the same is hereby,
added to Section 18.34.050 of Chapter 18.34 and that new Sub-
section .025 be, and the same is hereby, added to Section
18.41.050 of Chapter 18.41, all of Title 18 of the Anaheim
Municipal Code, to read as follows:
"Bed and Breakfast Inns, subject to compliance with
the site development standards set forth in Section
18.04.130 of this Code."
SECTION 5.
That new Subsection .055 be, and the same is hereby,
added to Section 18.44.020 of Chapter 18.44, that new Sub-
section .055 be, and the same is hereby, added to Section
18.45.020 of Chapter 18.45, and that new Subsection .085 be,
and the same is hereby, added to Section 18.46.020 of Chapter
18.46, all of Title 18 of the Anaheim Municipal Code, to read
as follows:
"Bed and Breakfast Inns converted from residential
structures in compliance with all applicable pro-
visions of this Chapter and the site development
standards set forth in Section 18.04.130 of this Code."
SECTION 6.
That new Subsection .018 be, and the same is hereby,
added to Section 18.44.035 of Chapter 18.44, that new Sub-
section .018 be, and the same is hereby, added to Section
18.45.035, and that new Subsection .018 be, and the same is
hereby, added to Section 18.46.035 of Chapter 18.46, all of
Title 18 of the Anaheim Municipal Code, to read as follows:
".018 Bed and Breakfast Inns."

SECTION 7.
That new Subsection .005 be, and the same is hereby,
added to Section 18.84.041, that new Subsection .005 be, and
the same is hereby, added to Section 18.84.051, and that new
subsection .025 be, and the same is hereby, added to Section
18.84.061, all of Chapter 18.84 of Title 18 of the Anaheim
Municipal Code, to read as follows:
"Bed and Breakfast Inns."
SECTION 8. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the
repeal hereby of any other ordinance of this City shall in any
manner affect the prosecution for violations of ordinances,
which violations were committed prior to the effective date
hereof, nor be construed as a waiver of any license or penalty
or the penal provisions applicable to any violation thereof.
The provisions of this ordinance, insofar as they are sub-
stantially the same as ordinance provisions previously adopted
by the City relating to the same subject matter, shall be con-
strued as restatements and continuations, and not as new enact-
ments.
SECTION 9. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 10. CERTIFICATION
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption in the Anaheim Bulletin, a
newspaper of general circulation, printed, published and cir-
culated in said City, and thirty (30) days from and after its
final passage, it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 25th day of October, 1983.
