3586ORDINANCE NO. 3586 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MU14ICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 67R-310 and 75R-655 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF A14AHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Parcel 1: That portion of the Northeast one- quarter of Section 22, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, Page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a 4" x 4" post standing at a point 20 chains South of the Quarter Section corner on the North boundary of said Section 22; thence South, parallel with the East and West boundary lines of said Section, 10 chains 30-1/2 links; thence East, parallel with the South boundary of said Section 10 chains; thence North (at 3.535 chains intersect the center line of the tract of the S.P.R.R. CO.) 10 chains 30-1/2 links; thence West, parallel with said North boundary of said Section (at 5.82 chains intersect center of said Railroad Company) 10 chains to the point of begin- ning, in the office of the Registrar of Titles of Orange County, California. -1- ATTY-28 66-67-61(72) Excepting therefrom that portion lying Northeast- erly of the Northeasterly line of the strip of land, 30.00 feet in width, described in Certifi- cate of Title No. 10336. Also excepting therefrom that portion described as follows: Beginning at the Northwesterly corner of said land; thence along the Northerly line thereof North 890 56' 40" East, 54.80 feet; thence South 50 30' West 246.54 feet to the Easterly line of Harbor Boulevard, 60 feet wide; thence along said Easterly line South 00 16' 25" East, 114.50 feet; thence South 890 43' 35" West 30 feet to the West- erly line of said land; thence along said Westerly line North 00 16' 25" West, 360 feet to the point of beginning. Also excepting that portion described as follows: Beginning at the Southerwesterly corner of said land; thence along the Southerly line thereof North 890 57' East 661.30 feet to the Southeast- erly corner of said land; thence along the East- erly line thereof North 00 16' 25" West 42 feet to a line parallel with and distant Northerly 42 feet, measured at right angles from said South- erly line; thence along said parallel line South 89° 57' West, 586.30 feet; thence North 45° 09' 52" West 63.76 feet to the Easterly line of said Harbor Boulevard; thence South 89° 43' 35" West 30 feet to the Westerly line of said land; thence along said Westerly line South 00 16' 25" East 86.88 feet to the point of beginning. Also excepting therefrom that portion included within the following described land: Beginning at a point in a line parallel with and distant 30.00 feet Southwesterly measured at right angles, from the Southwesterly line of the 100 -foot strip of land described in Parcel 3 of Final Order of Condemnation rendered in Case No. 33172 in the Superior Court of the State of California, in and for the County of Orange, a certified copy of which Order is recorded in Book 931, Page 41 of Official Records, in the office of the County Recorder of said County, said point being distant along said parallel line South 400 52' 20" East, 102.67 feet from the Westerly line of said Northeast one-fourth, said point also being the most Westerly corner of that certain parcel of land described in Certificate of Title No. 10336, on file in the office of the Registrar of Land Titles of said County; thence along the Northwesterly line of said certain parcel of land North 490 07' 40" East, 30.00 feet to said Southwesterly line of said 100 -foot strip of land; thence along said Southwesterly line, South 400 52' 20" East, 12.78 feet; thence South 50 01' 20" West, -2- 410.68 feet; thence South 8° 15' 26" West, 202.24 feet to the Easterly line of Harbor Boulevard, 60.00 feet wide; thence at right angles to said Easterly line, South 89° 43' 35" West, 30.00 feet to said Westerly line of the Northeast one-fourth; thence along said Westerly line, North 0° 16' 25" West to the Southwesterly corner of that certain parcel of land described in Parcel 2 of Deed to the State of California filed October 28, 1944 as Document No. 11911 in the office of said Registrar; thence along the Southerly line of said certain parcel of land, North 890 43' 35" East, 30.00 feet to said East- erly line of Harbor Boulevard; thence along said Easterly line, North 00 16' 25" West, 114.50 feet to the Southerly terminus of that certain course described in said Parcel 2 as having a length of 246.54 feet; thence along said certain course and the Northerly prolongation thereof, North 50 30' 00" East, 365.96 feet to said point of beginning. Parcel 2: That portion of the Northeast one- fourth of Section 22, Township 4 South, Range 1C West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a point distant South 00 16' 25" East, 1320.00 feet and North 89° 56' 40" East 54.80 feet from the Northwest corner of said Northeast quarter of Section 22, said point being in the North line of the land described in Certificate of Title No. 13,900; thence North 5° 30' 00" East, 119.42 feet to a point, said point being distant South 400 52' 20" East, 102.67 feet from the West line of the Northeast quarter of said Section 22; thence North 490 07' 40" East, 30.00 feet to the most Northerly corner of the land described in Certificate of Title No. 10,336; thence South 400 52' 20" East, 182.97 feet to a point in the North line of the land described in Title Certificate No. 13,900; thence South 89° 56' 40" West along said North line 153.86 feet to the point of beginning. That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer, and in accordance with standard plans and specifications on file in the Office of the City Engineer, at the time the property is developed. 2. That the owner(s) of the subject property shall install street lighting as required by the Utilities Director except when the Utilities Director shall permit the payment of street lighting fees in the amount of $2.00 per front foot. 3. That the owner(s) of subject property shall pay to the City of Anaheim the sum of sixty cents per front foot for tree planting purposes, said amount to be paid at the time the prop- erty is developed. 4. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Pub- lic Works and Superintendent of Streets prior to final building inspections. 5. That all air conditioning facilities shall be properly shielded from view and shall be in architectural conformance with the structure. -4- SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
