AN ORDINANCE OF THE CITY OF ANAHEIM
CREATING A PUBLIC UTILITIES BOARD.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
AS FOLLOWS:
SECTION 1.
That Title 1 of the Anaheim Municipal Code be, and the
same is hereby amended by adding thereto to Chapter 1.04,
Sections 1.04.700, 1.04.710, 1.04.720, 1.04.730 and 1.04.740 to
read as follows:
"1.04.700 PUBLIC UTILITIES BOARD.
A Public Utilities Board is hereby established
in accordance with the provisions of Section
900 of the Charter of the City of Anaheim.
1.04.710 COMMISSION MEMBERSHIP AND TERMS.
.010 The Public Utilities Board shall
consist of seven members, none of whom shall hold any
paid office or employment in the City Government.
.020 The members of the Public
Utilities Board shall be appointed by the City Council
from the qualified electors of the City and shall be
subject to removal by motion of the City Council
adopted by the affirmative votes of the majority thereof.
.030 Each member of the Board shall
serve for a term of four years until their respective
successors are appointed and qualified, provided
however, that the terms of the Board members first
appointed shall be as designated by the City Council at
the time of their appointments as follows:
three on the thirtieth day of June of the first
year following appointment;
two on the thirtieth day of June of the second
year following; appointment; and
two on the thirtieth day of June of the third
year following appointment.
.040 A vacancy occuring before the
expiration of a term of a Board member shall be filled
by appointment by the City Council for the remainder of
the term.
1.04.720 ORGANIZATION AND MEETINGS.
.010 The Board shall, as soon as
practical after its organization and each year there-
after, elect a Chairman and Vice Chairman in accordance
with the provisions of Section 904 of the Anaheim City
Charter.

.020 Meetings of the Board shall be
conducted in accordance with Section 904 of the Anaheim
City Charter; Provided however, that the Board shall
meet at least four times during each calendar year. A
regular meeting time may be established by the Board.
A majority of the members of the Board shall constitute
a quorum.
1.04.730 POWERS AND DUTIES
The Public Utilities Board shall
have the power and duty to:
.010 Make recommendations to the City
Council for the operation and conduct of the Electric
and Water Utilities of the City.
.020 Make recommendations to the City
Council concerning the establishment of rules and
regulations and rates for the operation of the Electrical
and Water Utilities of the City.
.030 Make recommendations to the City
Council concerning the duties and qualifications of the
Public Utilities Director and other employees of the
Public Utilities Department.
.040 Make recommendations to the City
Council concerning the acquisition, construction,
improvement, extension, enlargement, diminution, or
curtailment of all or any part of the Electric and
Water Utilities of the City.
.050 Consider the annual budget of the
Public Utilities Department during the process of its
preparation and make recommendations with respect thereto
to the City Council and the City Manager.
.060 Make recommendations to the City
Council concerning financing including the issuance of
bonds for the electric and water utilities.
.070 Exercise such other powers and
duties as may be prescribed by ordinance not inconsistent
with the provisions of the Charter.
SECTION 2.
The City Clerk shall certify to the passage of this
Ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption in the Anaheim Bulletin, a
newspaper of general circulation, printed, published and circu-
lated in said City, and thirty (30) days from and after its final
passage, it shall take effect and be in full force.
