AN ORDIFAivCE OF THE CITY OF ANAHEII11I
REPEALING SECTIONS 1.04.600, 1.04.610,
1.04.620, 1.04.630 AND 1.04.640 OF THE
ANAHEIM IUNICIPAL CODE AND ADDING SECTIONS
1.04.600, 1.04.610, 1.04.620, 1.04.630 AND
1.04.640 OF THE ANAHEIM MUNICIPAL CODE.
WHEREAS, the City Council of the City of Anaheim
has, pursuant to Section 34240 of the Health and Safety
Code, previously declared the need for a Housing Authority
Lo function in the City of Anaheim; and
'^%T!Ta.REAS , the City Council of the City of Anaheim
has, ?pursuant to Section 34290, declared itself to be the
commissioners of the Housing Authority; and
WHEREAS, the City Council of the City of Anaheim
has, by ordinance, created a housing cor.imission to advise
the City Council on housing matters as permitted by Section
31.1291; and
T,yT;RrAS, Section 34290 of the Health and Safety
Code has been amended to permit the appointment of tenant
commissioners to the housing commission as an alternative
to appointment of tenant commissioners to the Housing
Authority; and
WH,=EAS, Sections 1.04.600 to 1.04.640 of the
Anaheim ?unicipal Code, which sections create a Housing
Commission, do not presently provide for tenant commission-
ers; and
;THEREAS, it is hereby determined to be necessary
to repeal said sections and to enact new sections to
provide for and permit tenant commissioners; and
WHEREAS, Section 34291 further permits the City
Council to determine by ordinance the members of a housing
commission, their terms of office, their qualifications
and the method of their appointment and removal.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ANAHEIM AS FOLLOWS:
SECTI0I4 1.
That Sections 1.04.600, 1.014.610, 1.04.620,
1.04.630 and 1.04.640 of the Anaheim Municipal Code be, and
the same are hereby, repealed.

That the following Sections are hereby added to
the Anaheim Municipal Code to read as follows:

"1.04.600 HOUSING COFT4TSSIO d
+'here is hereby established a ;Housing Commis-
sion pursuant to Section 34291 of the Health
and Safety Code of the State of California.
1.04.610 HOUSING COMMISSION MEMBERSHIP AND TERMS
.010 The Housing Commission shall consist of
seven (7) members, none of whom shall
hold any paid office or employment in the
City government.

.020 The members of the Housing Commission
shall be appointed by the City Council
from the qualified electors of the City
and shall be subject to removal by
motion of the City Council adopted by the
affirmative vote of the majority thereof.
.030 Two seats on the Housing Commission shall
be filled by tenant commissioners, which
tenant commissioners shall lawfully reside
in housing; provided by and through the
Anaheim ?lousing Authority, including
leased housing as defined in Section 34219
of the Health and Safety Code. At least
one of the tenant commissioners shall be
over 62 years of age if the Anaheim Housing
Authority has tenants of such age.
.040 each member, except tenant commissioners,
shall serve for a term of four years and
until their respective successors are
appointed and qualified; provided, however,
that the terms of the Commission members
first appointed shall expire as designated
by the City Council at the time of their
appointments as follows:
One on the thirtieth day of June of
the first year following appointment;
two on the thirtieth day of June of
the second near following; appointment
and two on the thirtieth day of June
of the third year following appointment.
.050 Each tenant commissioner shall serve for a
term of two years and until their respective
successors are appointed and qualified;
provided, hoTfrever, that the terms of the
tenant commissioners first appointed shall
expire as designated by the City Council at
the time of their appointments as follows:
One on the thirtieth day of June of
the first year following appointment;
one on the thirtieth dal of June of
the second year following; appointri.ent .

.060 Subject to the foregoing provisions, a
commissioner may continue in office so long
as he is a qualified elector of the City;
provided, however, that should a tenant
coz-I,Lr.issioner cease to be a tenant of the
Anaheim.Iousi_ng Authority, he shall imme-
diatelml be disqualified as a commissioner
and his office shall be vacant.
.070 A vacancy occuring before the expiration of
a term of a Commission member shall be filled
by appointment by the City Council for the
remainder of the term; provided further,
that a vacancy occuring before the expiration
of a term of a tenant commissioner shall be
filled by appointment of a tenant of the
"naheim.Iousing Authority.
1.04.620 ORGAIIIZATION AND 1`-'IEETINGS
.010 The ;lousing Commission shall, as
soon as practicable after its
organization, and each year there-
after, elect a chairman and vice-
chairman in accordance with the
provisions of Section 90L4 of the
Charter of the City of. Anaheim.
.020 T.leetings of the Housing Commission shall
be conducted in accordance with Section
904 of the Charter of the City of Anaheim.;
provided, however, that the Housing
Commission shall meet at least four times
during each calendar year. A majority of
the members of the Housing Commission shall
consititute a, quorum.
1.04.630 POi•TERS AND DUTIES
The Housing Commission is an advisory body, and
as such, shall have the power and duty to:
.010 Act in an advisory capacity to the City
Council and the Anaheim Dousing Authority
in all matters pertaining to the exercise
of the powers of the Anaheim Housing
Authority.
.020 Perform such additional functions as may,
by resolution, be required from time to
time by the City Council or the Anaheim
Housing Authority.
1.04.640 EXPENSE ALL01dANCE - HOUSING COMMISSION MEMBERS

City Council may, by resolution, determine what
sum, if any, is to be allowed pursuant to this
paragraph. The allowance authorized by this

recipient, but no other expenses shall be allowed
except upon specific authorization therefor by
the City Council."
SECTION 3.
SEVERABILITY. The City Council of the City of Anaheim
hereby declares that should any section, paragraph, sentence or
word of this chapter of the Code hereby adopted be declared for
any reason to be invalid, it is the intent of the Council that
it would have passed all other portions of this chapter indepen-
dent of the elimination herefrom of any such portion as may be
declared invalid.
SECTION 4.
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption in the Anaheim Bulletin,
a newspaper of general circulation, printed, published and
circulated in said City, and thirty (30) days from and after
its final passage, it shall take effect and be in full force.
