3518ORDINANCE NO. 3518 AN ORDINANCE OF THE CITY OF ANAHEI14 AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 75�j- ,88 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of Section 12, Township 4 South, Range 9 West, in the Rancho Santiago de Santa Ana, being also a portion of the land allotted to Paula Peralta de Dominguez, as described in the final decree of partition of the Rancho Santiago de Santa Ana, which was entered September 12, 1868 in Book "B", page 410 of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California, described as follows: Parcel 1 as shown on a Map filed in Book 57, pages 6 and 7 of Parcel 'Maps, records of Orange County, California. now is "RS -A-43,000" (SC) RESIDENTIAL/AGRICULTURAL, SCENIC CORRIDOR OVERLAY ZONE, and that it be changed to and incorporated in "CO" (SC) COMMERCIAL, OFFICE AND PROFESSIONAL, SCENIC CORRIDOR OVERLAY ZONE, subject to the following conditions: -1- ATTY-28 74-75-40 1. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structur- al framing. 3. That subject property shall be served by under- ground utilities. 4. That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer. If, in the preparation of the site, sufficient grading is required to necessitate a grading permit, no work on grading will be permitted between October 15th and April 15th unless all required off-site drainage facilities have been installed and are operative. Positive assurance shall be provided the City that such drainage facilities will be completed prior to October 15th. Necessary right-of-way for off-site drainage facilities shall be dedicated to the City, or the City Council shall have initiated condemna- tion proceedings therefor (the costs of which shall be borne by the developer) prior to commencement of grading operations. The required drainage facilities shall be of a size and type suffi- cient to carry runoff waters originating from higher properties through said property to ultimate disposal as approved by the City Engineer. Said drainage facilities shall be the first item of construction and shall be completed and be functional throughout the tract and from the downstream boundary of the property to the ultimate point of disposal prior to the issuance of any final building inspections or occupancy permits. Drainage district reimbursement agreements may be made available to the developers of said property upon their request. 5. That grading, excavation, and all other construction activities shall be conducted in such a manner so as to minimize the possibility of any silt originating from this project being carried into the Santa Ana River by storm water originating from or flowing through this project. 6. That appropriate water assessment fees, as determined by the Director of Public Utilities, shall be paid to the City of Anaheim prior to the issuance of a building permit. 7. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1. and 2; provided, however, that the proposed structures shall be constructed with Spanish tile roofs, as stipulated to by the petitioner, and that no left turns shall be allowed into the proposed employee parking lot off Nohl Ranch Road unless a left -turn pocket to facilitate left turns shall be provided in accordance with a design approved by the City Engineer. -2- 8. That the construction of the block wall along the northerly property line is not necessary or desirable due to conditions of topography. 9. That Conditions Nos. 1, 2, 3, 4, 5, 6, 7 and 8, above-mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed'to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
