ORDINANCE NO. 3507
AN ORDINANCE OF THE CITY OF ANAHEIM REPEALING
SECTIONS 18.01.090 AND 18.02.052.040 OF THE
ANAHEIM MUNICIPAL CODE AND ADDING NEW SECTIONS
18.01.090 AND 18.02.052.040 IN THEIR PLACE.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That Sections 18.01.090 and 18.02.052.040 of the Anaheim
Municipal Code be, and the same are hereby, repealed.
SECTION 2.
That Sections 18.01.090 and 18.02.052.040 of the Anaheim
Municipal Code be, and the same are hereby, added to the Anaheim
Municipal Code to read as follows:
"Section 18.01.090 'H' WORDS, TERMS AND PHRASES
'Home Occupations' An occupation
incidental to and subordinate to the principal residential
use and located on the same lot with such residential use.
'Hotel' A building in which there
are six or more guest rooms where lodging with or without
meals is provided for compensation, and where no provision
is made for cooking in any individual room or suite. Jails,
hospitals, asylums, sanitariums or orphanages, prisons, de-
tention homes or similar buildings where human beings are
housed and detained under legal restraint are specifically
not included. All of the accommodations in a hotel shall be
for the use of tourists or transients. Tourists or trans-
ients shall be defined as persons renting accommodations for
one or more periods of time, any single time period not ex-
ceeding one week or seven days. Nothing contained herein
shall preclude any person or persons from renting any accom-
modations described herein for as many successive weekly or
seven-day time periods as said person or persons may choose."
"Section 18.02.052.040 Home occupations, as defined in
Section 18.01.090 where permitted in a residential zone.
Violations of the provisions of Subsections .0401 through
.0409 infra shall be grounds for the termination of a home
occupation permit and shall constitute a misdemeanor as de-
fined in Section 1.01.0370 of the Anaheim Municipal Code:
.0401 No persons other than members of
the resident family shall engage in the home occupation.
.0402 No sales of products or services
on the premises shall be permitted.
.0403 No increased pedestrian or vehicu-
lar traffic shall be generated.

.0404 No commercial vehicles shall be used
for delivery of home occupation -related materials to or from
the premises.
.0405 No outdoor storage of materials
and/or supplies or other outdoor activity related to the
home occupation shall be permitted.
.0406 No exterior aspect of the residen-
tial structure shall allow the home occupation to be reason-
ably recognized as a nonresidential use.
.0407 No noise, odor, dust, vibration,
fumes or smoke caused by a home occupation shall be readily
discernible at the lot boundaries.
.0408 No home occupation shall cause an
electrical disturbance that shall adversely affect the prop-
perty of another person.
.0409 Prior to the issuance of a business
license under this Section, the application shall be submitted
immediately to the Planning Department for determination of
conformance and compliance with the foregoing definition and
limitations. Anyone not satisfied with the Planning Depart-
ment's determination has the right of appeal to the City
Council."
SECTION 3. SEVERABILITY.
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this chap-
ter of the Code, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this chapter independent of the elimination
herefrom of any such portion as may be declared invalid.
SECTION 4.
The City Clerk shall certify to the passage of this or-
dinance and shall cause the same to be printed once within fifteen
(15) days after its adoption in the Anaheim Bulletin, a newspaper
of general circulation, printed, published and circulated in said
City, and thirty (30) days from and after its final passage, it
shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and signed by me
