3457ORDINANCE NO. 3457 AN ORDINANCE OF THE CITY OF ANAHFIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 75R-377 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF A14AHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of the South half of the North half of the Southwest quarter of the Northeast quarter of Section 12, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, as said Section is shown on a map recorded in Book 51, page 10, of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: Beginning at the Southwest corner of said South half; thence South 890 34' 32t1 East, along the Southerly line of said North half, a distance of 257.00 feet; thence North 00 41' 30" East a distance of 167.80 feet; thence North 89° 18' 30" West a distance of 100.00 feet; thence North 0° 41' 30t1 East a distance of 72.00 feet; thence North 890 18' 3011 West a distance of 157.00 feet to a point on the. Westerly line of said Northeast quarter distant thereon 241.00 feet from said Southwest corner of said South half; thence South 00 41' 30" West, along said Westerly line, a distance of 241.00 feet to the point of beginning. -1- ATTY-28 74-75-37 now is "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONE, and that it be changed to and incorporated in "RS -7200" RESIDENTIAL, SINGLE- FAMILY ZONE, subject to the following conditions: 1. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 2. That subject property shall be served by underground utilities. 3. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 4. In the event that subject property is to be divided for the purpose of sale, lease, or financing, a parcel map to record the approved division of subject property shall be submitted to and approved by the City of Anaheim and then be recorded in the Office of the Orange County Recorder. 5. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees, as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 6. That appropriate water assessment fees, as determined by the Director of Public Utilities, shall be paid to the City of Anaheim prior to the issuance of a building permit. 7. That the building setbacks shall have,a minimum depth of forty (40) feet adjacent to Sunkist Street, per City Council Policy No. 538, unless the City Council grants relief from said policy and permits 25 -foot setbacks for those lots proposed to front on Sunkist Street. 8. That Conditions Nos. 1, 2, 3, 4, 5, 6 and 7, above- mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fif- teen (15) days after its adoption in the Anaheim Bulletin, a news- paper of general circulation, printed, published and circulated in -2- said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
