AN ORDINANCE OF THE CITY OF ANAHEIM ADDING
TO TITLE 18, CHAPTER 18.02, SECTIONS 18.02.045,
18.02.046, 18.02.047, 18.02.048 AND 18.02.04.9
OF THE ANAHEIM MUNICIPAL CODE PERTAINING TO THE
TRANSFER OF REAL PROPERTY IN THE CITY OF ANAHEIM
PLANNING AREA "B."
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
AS FOLLOWS:
SECTION 1.
That Title 18, Chapter 18.02, of the Anaheim Municipal
Code be, and the same is hereby, amended by adding thereto new
Sections 18.02.045, 18.02.046, 18.02.047, 18.02.048 and
18.02.049 to read as follows:
1118.02.045 Intent and Purpose
The City Council finds that in the sales of new
residential homes in the City of Anaheim Planning
Area "B" as shown on the City's General Plan,
certain problems arise which affect the buyers of
said property. Among these problems are lack of
reliable information as to development of property
adjacent to and in the vicinity of the buyer's
property, public improvements and related public
facilities planned for the area, including parks,
roads and other public facilities. It is the
intent of the City Council to require that buyers
of new residential property in Planning Area "B"
be informed of existing zoning laws, traffic
circulation plans, and general land use designa-
tions in the area of such real property.
18.02.046 New Residential Home Defined
A building or structure designed for a single
family which has not been previously occupied as
a residence by human beings.
18.02.047 Transfer of Real Property
In transactions for the sale of new residential
homes located in the City of Anaheim Planning
Area "B", it shall be unlawful to consummate
said sale without informing the buyer or transferee
of each of the following items in writing:
1. Land use element of the City of Anaheim
General Plan.
2. Circulation element of the City of Anaheim
General Plan.
3. Existing zoning (including conditional use
permits, variances and resolutions of intent
to rezone) within 300 feet of the boundaries
of any new residential tract.

18.02.048 Required Copy to Buyer
A receipt for the items furnished to buyer of
residential real property required by Section
18.02.046 shall be signed by the seller and the
buyer, and be furnished to thebuyer prior to
entering into an agreement of sale of any new
residential home. A signed copy of the receipt
furnished to buyer or transferee shall be kept
and maintained by the seller for a period of
one year.
18.02.049 Title
The provisions of Sections 18.02.045 through
18.02.048 shall not affect the title to real
property, nor the validity of any sale of real
property."
SECTION 2.
SEVERABILITY. The City Council of the City of Anaheim
hereby declares that should any section, paragraph, sentence or
word of this chapter of the Code hereby adopted be declared for
any reason to be invalid, it is the intent of the Council that
it would have passed all other portions of this chapter indepen-
dent of the elimination herefrom of any such portion as may be
declared invalid.
SECTION 3.
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption, in the Anaheim Bulletin,
a newspaper of general circulation, printed, published and cir-
culated in said City, and thirty (30) days from and after its
final passage it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and signed by me
this 5th day of August , 1975.

AND I FURTHER CERTIFY that the Mayor Pro Tem of the City
of Anaheim approved and signed said Ordinance No. 3.452 on the 5th
day of August, 1975.
