3441ORDINANCE NO. 3441 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MU141CIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 74R-114 determining that'a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1: The East 5.00 acres of the West 10.00 acres of the South half of the southeast quarter of the northeast quarter of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as shown on a map recorded in Book 51 page 11 of Miscellaneous Maps in the Office of the County Recorder of said County. Except a strip of land 30.00 feet wide, lying south- easterly from the following described line: Beginning at the centerline intersection of Orange Avenue and Western Avenue as shown on Tract No. 7241 recorded in Book 275 pages 13 and 14 of said Miscellaneous Maps; thence South 00 33' 45" East 199.71 feet along said center- line of Western Avenue to the true point of beginning; said point being on a non -tangent curve concave northwesterly having a radius of 1600.00 feet, a radial to said point bears South 21° 27' 45" East; thence northeasterly 27.96 feet along said curve through a central angle of 1° 00' -1- 73-74-38 051; thence North 670 32' 10" East 2073.61 feet to the beginning of a curve concave northwesterly having a radius of 1800.00 feet; thence Northeasterly 313.55 feet along said curve through a central angle of 9° 58' 50". Also excepting all that land lying northwesterly from the following described line: Beginning at the centerline intersection of Orange Avenue and Western Avenue as shown on Tract No. 7241 recorded in Book 275 pages 13 and 14 of said Miscellaneous Maps; thence South 00 33' 45" East 199.71 feet along said centerline of Western Avenue to the true point of begin- ning, said point being on a non -tangent curve concave northwesterly having a radius of 1600.00 feet, a radial to said point bears South 210 27' 45" East; thence north- easterly 27.96 feet along said curve through a central angle of 1° 00' 05"; thence North 670 32' 10" East 2073.61 feet to the beginning of a curve concave northwesterly having a radius of 1800.00 feet; thence northeasterly 313.55 feet along said curve through a central angle of 90 58' 50". now is "RS -A-43,000" RESIDENTIAL/AGRICULTUR.AL ZONE, and that it be changed to and incorporated in "C -O" COMMERCIAL, OFFICE and PROFESSIONAL ZONE, subject to the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 3. That subject property shall be served by underground utilities. 4. That a 6 -foot masonry wall shall be constructed along the north and west property lines. 5. That any parking area lighting proposed shall be down -lighting from a maximum height of 6 feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. 6. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer and the Orange County Flood Control District. 7. That the final parking plan shall be approved by the Development Services Department, and any landscaped areas in the parking areas shall be protected with 6 -inch high, concrete curbs, and concrete wheel stops shall be provided for parking spaces. 8. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2, 3, 4 and 5. 9. That Conditions Nos. 1, 3, 4, 5, 6, 7 and 8, above mentioned, shall be complied with prior to final building and zoning inspections. -2- SECTION 2. The City Zoning Map shall be, and the same is hereby amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City�Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
