That Title 13, Chapter 13.34 be, and the same is her -by,
amended by addinJ thereto Section 13.34.035 to read as follows:
11.035 TREE PRESERVATIOT
Preservation of significant stands and sin, -le s-leci-
fied trees in the Scenic Corridor is intended to
preserve the natural beauty of the Santa :^na. Can,7on
environrrLent, increase the visual identity and nu -1 -
it,,, of the area, and protect the remaininf natural
amenities from premature removal or destruction.
.010 Definitions
In the context of this ordinance, the folloT-ring
vrords shall have the rneaninl- respectively ascribes:

"Specimen Tree" is hereby defined as Eucalyptus
varieties (Eucalyptus), ` uercus varieties (Oak) ,
Schinus varieties (Pepper), or Platanus varieties
(Sycamore) tree with a trunk ;�easurinM eir7ht (2)

found by the City of Anaheir to be of hir= value
because of its type and/or historic association.

It shall be unlawful to cut down, destroy, or ?-e-
move any Stand of Eucalyptus Specimen Trees or any

in.- within the boundaries of the Scenic Corridor
Zone, unless prior approval has been r -ranted by the
Develo??nent Services _%epartment.
.021 Criteria for Approval
In deternininp; whether or not to !,;rant approval "or
removal or destruction of a Stand of ~,ucalyptus Spec -
men Trees or any single Cal:, Pepper, or ,Sycamore
Specimen Tree, the decision shall be based on both
of the followinf,;:

of present danger of falling in respect to existinf
or proposed structures, and interference with Utility
service.
.02123 Trees so weakened by age, disease, storm, fire, exca-
vation., removal of adjacent trees, or any injury so
as to cause imminent dan7er to persons or property.

Any decision jade re ardina approval for removal or
destruction of any Stant. of Specimen Trees clay be an -
pealed by the property owner of affected resident or
nroner' `r owner in the City of Anaheim to the City
Council.
SIE]CTION 2. SZ VIE EZA13ILITY
The City Council of the City of Anaheim hereby declares
that should any section, para=rash, sentence or word of this cha.)-
ter of the Code hereby adopted be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other nortions of this chanter independent of the elimination
herefrom of any such portion as may be declared invalid.
SECTION 3.
The City Clerk shall certify to the passable of this or-
dinance and shall cause the same to be printed once within fifteen
(15) days after its adoption in the Anaheim 3ulletin, a newspaper
of general circulation, printed, published and circulated in said
City, and thirty (30) days from and after its final nassaz,;e, it
shall take effect and be in full force.
