RESOLUTION NO. 3~44
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING VARIANCE NO.653.
I*'" WHEREAS, the City Planning CO~ission of' the City of'
Anaheim did receive a petition f'rom the owner of' certain real
property situated in the City of' Anaheim, County of' Orange,
State of' Galif'ornia, described as f'ollows:
Lot 41 of' Tract No. 14. Said p'roperty is
located at 833 South Philade;I.phia Street.
AND WHEREAS, the City Planning Commission did~hold a
public hearing at the City Hall in the City of' Anaheim on Nov-
ember 19, 19:>6, notices of' which said Pllbl1c,hearing were duly
given, as required by law and the provisions of' Section 9200.17
of the Anaheim Mtulielp~l Code; and
WHEREAS, said City Planning. Qommission, af'ter due in-
spection, investigation and studies made by itself' and in its
behal!', and af'ter due considerationo!'all:evidence and reports
off'ered at said hearing, did adopt Resolution No. 94, Series
1956-57, recommending that Variance No. 653 be granted; and
. WHEREAS, thereaf'ter, within twenty (20) d~ys f'rom the
date of' the adoption of' said resolution, the City Council did
elect, upon its own motion, to r~view the action taken by the
City Planning Commission in granting said variance and did set
a public h,earing thereon to be held on the 8th day of' January,
1957, at 7:00 o'clock P.M. in the City Hall in the City of' Ana-
heim, and notice of' such public hearing was duly given as re-
quired by law and the provisions of' Section 9200.17 of' the Ana-
heim Municpal Code; and
WHEREAS, af'ter due investigation and studies made by
itself' and in its behalf', and after due consideration of all the
evidence and reports off'ered at said hearings, the City Council
does find that:
1. There "is no substantial property right
possessed by other property in the same
vicinity and zone and denied the sub-
ject property.
2. It appears that the subject property
can be adequately developed and used
under the present zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council of'
the City of Anaheim that the action of the City Planning Commis-
sion granting Variance No. 653 requesting that the property here-
inabove described be reclassif'ied as R-3, Multiple-Family Resi-
dential Zone, to permit the erection of' a duplex dwelling thereon,
be, and the same is hereby disapproved, and that Variance No. 653
be, and the same is hereby, denied.
