JHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general circulation,
printed, published and circulated in the City of Anaheim, to \111 t:

furnishing the ollowing:
~l plant, labor, services, materials and equipment,
and all utilities and transportation, including power,
fuel and water, and performing all work necessary to
oonstruct and complete, in a good and workmanlike manner,
in strict aocordance with the plans and specifications OR
file in the office of the City Clerk of the City of Anaheim,
the following public improvement, to wit: The La Palma-
Brookhurst street Improvement, on La Palma Avenue trom 708
feet East of Brookhurst Street to Brookhurst Street, and on
Brookhurst street from 750 feet North of La Palma Avenue to
La Palma Avenue, consisting of excavation, paving with 4
inches of plant-mix paving, construction of Type "B" curb and
gutter, adjusting existing manhole to grade, and appurtenant
work, as indicated on the plans, Job No. 132.
In accordance with the designs, plans, profiles and specifications
of said public improvement on file in the OffS ~e of the City Clerk
of the City of Anaheim; and

)~blic improvement did provide that sealed pro; osals would be re-
c8ived by the City Council of the City of Anah,im at the Office of
the City Clerk of the City of Anaheim up to th6 hour of 7:00 o'clock

of all plant, labor, services, materials and equipment, all utili-

forming all work necessary to construct and complete, in a good and
"orkmanlike manner, the public improvement hereinabove more pa!'ticu-
larly mentioned and described and which notice did state and declare
th&t 2ursuant to the provisions of Section 1770 Of the Labor Code,
the City Council of the City of Anaheim had ascertained the prevailing
rate of ':rages in the locality in which this type of labor is to be pel-
formed for each craft or tYlJe of Horkman or mechanic needed to execute
the cODtract and clid set forth the prevailing hourly "rage scale so
ascertained; and

WHERIAS, the Oity Oounoil did thereupon refer 8aid bid. to
the Oity E~~~eer for examination, tabulation
and report to t e City Counoil, and said City E~ineer

WHEREAS, the Oity Oounoil finds that the sealed proposal sub-
mUted by R. J. NOBLE COMPANY. P. O. BOX 620, ORANGE, OALIFORNIA
i. the lowest responsible proposal submitted for the furnishing of all
plant, labor, servioes, materials and equipment, all utilities and
transportation, inoluding power, fuel and water ana performing all work
neoessary to oonstruct and complete 1n a good and workmanlike manner
in striot acoordance with the specifications, plans and drawings
therefor on :file in the office of the City Clerk of the City of Ana-
heim of the publiC improvement hereinabove mentioned and desoribed,
together with the appurtenances thereto, and as speoified in the
notioe inviting sealed proposals, and tr~t said proposal of said
above named bidder should be acoepted and a contraot awarded to sald
bidder in aooordanoe therewith; and
WHEREAS, the City Council finds that the above mentioned
sealed proposal is the lowest responsible proposal reoeived and that
the person, firm or corporation submitting said proposal is a
responSible person, firm or corporation and that the proposal sub-
mitted is the best suited and fitted for the publio improvement to
be oonstructed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM, that the sealed proposal submitted by
B.. J. NOBLE COMPANY. P. O. BOX 620. ORANGE. CALIFORNIA

for the furnishing of all plant, labor, services, materials and
equipment, all utilities and transportation, inoluding power, fuel
and water and performing all work necessary to oonstruot and oomplete
in a good and workmanlike manner, in strict accordanoe with the
speoifioations, plans, and drawings therefor on file in the offioe
ot the City Olerk of the City of Anaheim and the notice inviting
sealed proposals, the public works and improvements hereinabove more
partioularly mentioned and desoribed, together with the appurtenanoes
thereto, be, and the same is hereby, aocepted, and that a contraot
for the construction and completion of said pUblic improvement be,
and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the suooessful bidder or
bidders upon each contract awarded as hereinabove set forth shall
be, and they are hereby reqUired to execute a contraot in the required

form with the City of Anaheim upon the terms and oonditions speoified
in the notioe inviting sealed proposals and the proposal submitted
by said sucoessful bidder or bidders and in accordance with the plans
and specifications for said public impro,vement hereinabove desoribed
and in accordanoe with the terms, conditions and provisions of this
resolution, and that said successful bidaer or bidders to whom eaoh
contraot is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (100%) of the contract price for
all labor, materials and equipment to be 'furnished and performed as
set forth in the sealed proposals submitted by said bidder for the
construotion of said pUblio improvement together with the appurtenances
thereto or such portion thereof as is covered by said oontract as
seourity for the faithful performanoe of said oontract and a separate
surety bond in an amount equal to one hundred per cent (100%) of the
construction cost of said public improvement covered by said oontract
as security for the payment of all persons performing labor and furn-
ishing material for said project.
AND BE'IT FURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby required to furnish to the City of
Anaheim in companies satisfactory to the CitY of Anaheim publio
liability, property damage, compensation, and other insuranoe in
the amounts and for the purposes as set forth and specified in the
notice inviting sealed proposals and subJeot to the approval of the
City Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk
of the City of Anaheim be, and they are hereby, authorized and directed
to make, execute and enter into fOr and on behalf of the City of Ana-
heim a written contract with said successful bidder or bidders for the
furnlshingof all plant, labor, materials, and equipment and performing
all work as hereinabove more particularly desoribed for the construc-
tion, installation and completion of said public improvement herein-
above desoribed upon the teras and oonditions as speoified in the
notice inviting sealed proposals, the detailed design, plans, profiles,
drawings and general specifications and detailed specifioations and
drawings and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the office
of the Oi ty Olerk of the City of Anaheim and in striot' accordanoe with
the terms, oonditions and prOVisions of this Resolution, and in accord-
ance with all the contract documents herein specified.
