A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING CONDITIONAL USE PERMIT
NO. 405.
WHEREAS, the City Planning Coituaission of the City of
Anaheim did receive an application from KIYOSHI NAKAMURA, 11618
Santa Monica Boulevard, Santa Monica, California, for a Condi-
tional Use Permit to construct a multiple- family planned resi-
dential development with carports, on the following described
property situated in the City of Anaheim, County of Orange, State
of California, to wit:
The East half of the Northwest quarter of the South-
west quarter of Section 13, Township 4 South, Range 11
West, in the Rancho Los Coyotes, City of Anaheim, as
per map recorded in Book 51, page 11, Miscellaneous
Maps, in the office of the county recorder of said
county.
EXCEPTING THEREFROM that portion lying Southerly of
the following described line:
Beginning at the Northwesterly corner of Tract 2875, as
shown on a map recorded in Book 87, pages 43 to 45,
Miscellaneous Maps, records of said Orange County, being
a point on the Easterly line of said East half; thence
South 89 59' 49' West along the Westerly prolongation
of the Northerly line of said tract to the Westerly line
of said East half.
ALSO EXCEPTING THEREFROM the East 172 feet of the North
159 feet measured from the center line of Orange Avenue.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
application on April 15, 1963, notices of which said public hear-
ing were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code.
WHEREAS, said Commission, after due inspection, investi-
gation and studies made by itself and in its behalf and after due
consideration of all evidence and reports offered at said hearing
did adopt its Resolution No. 723, Series 1962 -63, denying Condi-
tional Use Permit No. 405; and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, the City Council did
elect, upon its own motion, to review the action of the City
Planning Commission in denying said Conditional Use Permit and did
thereupon fix the 14th day of May, 1963, as the time and the
Council Chamber in the City Hall of the City of Anaheim as the
place for a public hearing upon said Conditional Use Permit, and
notices of such public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to
be heard and did receive evidence and reports; and

WHEREAS, the City Council finds, after careful con-
sideration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, that Condi-
tional Use Permit No. 405 should be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion denying said Conditional Use Permit be, and the same is
hereby sustained, and that the petition of KIYOSHI NAKAMURA, 11618
Santa Monica Boulevard, Santa Monica, California, for a Conditional
Use Permit to construct a multiple family planned residential
development with carports on the property hereinabove described,
be and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
this 14th day of May, 1963.

adopted at a regular meeting of the City Council held on the 14th

AYES: COUNCILMEN: Dutton, Chandler, Krein and
Coons.
AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said resolution on the 14th day of May,
1963.
