A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO, 1558
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from
IVAN J. SCOTT owner
o cer an rea property situated Th o Anah a m, ounty
of Orange, State of California, described as follows:
That portion of the West one -half of the Southwest quarter of
the Southeast quarter of Section 13, in Township 4 South, Range
11 West, Rancho Los Coyotes, as shown on a map thereof recorded
in book 51, page 11, Official Records, described as follows:
Commencing at the Southwest corner of said West one -half of the
Southwest quarter of the Southeast quarter, running thence East
along the Southerly line of said West half 214.5 feet to a point
450 feet West of the East line of said West one -half; said point
being the true point of beginning of the land herein described;
thence Northerly parallel with said East line 365 feet; thence
Westerly parallel with said Southerly line 79.5 feet to a point
135 feet East of the West line of said West one -half; thence
Southerly parallel with said West line 365 feet, more or less,
to the Southerly line of said West half; thence East along
said Southerly line 79.5 feet, more or less, to the true point
of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim on
April 1 s 19_63 notice of which said public hearing was
duly given as requ red by law and the provisions of.Title 18,.
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission after due
inspection, investigation.and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No, 707 Series
19 62 denyingVariance No. 1558 and
WHEREAS, thereafter within twentymtwo:(22) days from
the date of the adoption of said resolution, the City Council did
elect, upon its own motion, to review the action taken by the City
Planning Commission in denying said variance and did set a
public hearing thereon to be held on the 7th day of May
1963 at 7:00 o'clock P.M. in the City Hall in the CIty zri
Anaheim, and notice of such public hearing was duly given as
required by law and the provisions of Title 18,_.Chapter 18.76 of
the Anaheim Municipal Code; and
WHEREAS, the City Council does find that:
1. There is no substantial property right „possessed
by other property in the same vicin_ ity_and zone
and denied the subject property.
2. It appears that the subject property can be
adequately developed and used under the present
zone,
NOW, THEREFORE,.BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commission
denying Variance No. 1558 be, and the same is hereby sustained,
and that the petition of Ivan J. Scott, 141 13th Street, Seal
Beach, California, for a variance permitting a waiver of the
Anaheim Municipal Code one -story height limitation restriction
and the construction of carports in lieu of garages on the property
hereinabove described, to allow construction of a two -story apart-
ment building with carports, be, and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
