57R-4306 - r- RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING A CONTRACT BETWEEN THE CITY OF ANAHEIM AND 'WARREN W. JAYCOX, BY IN- CREASING THE COMPENSATION PAYABLE, AND BY COMBINING TWO SEPARATE CONTRACTS DEALING WITH THE COLLECTION OF GARBAGE AND THE COLLECTION OF RUBBISH INTO A SINGLE CONTRACT. 4306 WHEREAS, the City of Anaheim did enter into a oontraot with Warren W. Jayoox on the 1st day of April, 1957 for the oolleotion of garbage in the City of Anaheim, suoh oontract to terminate :March 31, 19.58; and WHEREAS, the City of Anaheim did enter into a contraot with Warren W. Jaycox on the 2nd day of February, 1957 for the col- lection of rubbish and waste material in the City of Anaheim, such oontract to terminate May 31, 19.58; and WHEREAS, a review of both contracts by the City of Anaheim with said contractor indicates that the compensation payable under both of said contraots is inadequate by reason of the annexation of sparsely populated areas to the City of Anaheim and the oonsequent increased oost to the contraotor, and that in order to adequately servioe the City of Anaheim in garbage and rubbish pick-up and dis- posal, 'the compensation to the oontractor under the oontraot should be increased; and WHEREAS, the City Counoil of the City of Anaheim deems that the expansion of the area covered by the oontracts and the in- creased oosts involved is suoh an extraordinary oiroumstanoe as to warrant an inorease in the oompensation to be paid to the oontraotor; and r WHEREAS, it is deemed in the best interests of the Oity of Anaheim for simplioity of aooounting and other administrative pro- cedures that the two oontraots with Warren W. Jayoox, oovering garbage oolleotion and oolleotion of rubbish and waste material, be oombined into one contraot to expire on the same date and for which one single oompensation shall be payable; and WHEREAS, it is deemed in the beet interests of the City of Anaheim that the compensation payable under the oontraot be set forth as a stated monthly oompensation rather than a variable rate of compensation based upon so much per unit served; and WHEREAS, in connection with the contraot it is deemed in the best interests of the City of Anaheim to modify the contract to make the contractor responsible for oolleotion of service chargee in those areas not served water or eleotricity by the City of Anaheim; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the contract entered into with Warren W. Jaycox on the 1st day of April, 19.57, for the oollection and disposal of garbage, and the contract entered into with Warren W. Jayoox on the 2nd day of February, 19.57, for the collection and disposal of rubbish and waste material, be combined into one oontraot embodying the terms of the contract entered into on the 2nd day of February, 19.57, and that such last mentioned oontract be modified to include the ool- leotion and disposal of garbage, rubbish and waste material in the City of Anaheim, and that the oontract shall expire May 31, 19.58. -1- - - r AND BE IT FURTHER RESOLVED, that the compensation payable to Warren W. Jaycox under said oombined oontraot be the sum of #15,500.00 per month, plus 80 oents per month from all residenoes in the City of Anaheim served by the oontraotor for the oolleotion and disposal of garbage, rubbish, and waste material in areas not served by the Anaheim Public Service Department with either water. or electricity, it being specifically provided that the 80 cents per month allowed the contractor from residences in areas not served by the Anaheim Public Service Department shall be collected by the contractor at his own cost and expense of collection; and that the City of Anaheim with regard to this portion of the contractor1s payment shall not be liable nor responsible for the collection of suoh service charge and shall not be responsible to the oontraotor for any such service charges which are not paid by the users. AND BE IT FURTHER RESOLVED, that all of the terms and oonditions, regulations and restrictions set forth in the contract of February 2, 1957, by and between the City of Anaheim and Warren W. Jaycox, exoept as before ohanged, altered and modified, shall be in full force and effect and incorporated in the revised oontraot, and that the increased compensation before set forth shall be payable to the contractor beginning January 1, 1958. AND BE IT FURTHER RESOLVED, that the Mayor and the City Clerk be, and they are hereby, authorized and directed to execute an amended contract for and on behalf of the City of Anaheim with the said Warren W. Jaycox, embodying the changes before set forth.
