RESOLUTION NO. 4282
A RESOLUTION OF THE CITY COWNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 869.

WHEREAS, the City Planning ~omm1ssion of the City of
Anaheim did reoeive a petition from the owner of oertain real
property situated in the City of Anah$im, County of Orange, State
of Oal1fornia, desoribed as follows:
That portion of the Northeast qu~ter of the Southwest
quarter of Seotion 20, Township 4 South, Range 10 West,
in the Rancho Los Coyotes, County of Orange, State of
California, as per map recorded in Book 51, Page 10 of
Miscellaneous Maps, in the Office of the County Reoorder
of said County, described as follows:
Beginning at the northeast oorner of said southwest
quarter; thence southerly 638.38 feet along the easterly
line of said southwest quarter; thence westerly 1327.69
feet parallel with the north line of the Southern Pacific
Railroad Company, right of way through said southwest
quarter, to the west line of said northeast quarter;
thenoe northerly 626.62 feet alo.g said west 11ne to the
north line of said southwest quarter; thence easterly
1329.43 feet to the pOint of beginning.
EXCEPT that portion thereof included within Traot 3247
as per map recorded in Book 98, ~ages 4, 5 and 6 of
Miscellaneous Maps, in the Office of the Oounty Recorder
of said Oounty.
AND WHEREAS, the City Planning Commission did hold a
pUblic hearing at the City Hall in the City of Anaheim upon said
petition on November 18, 1957, notices of which said public hearing
were duly given as required by law and the provisions of Section
9200.17 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due in-
speotion, investigation and studies made by itself and in its behalf,
and after due consideration of all evidence and reports offered at
said hearing, did adopt Resolution No. 111 -- Series 1957-58, recom-
mending that Variance No. 869 be denied; and
WHEREAS, thereafter, within twenty (20) days from the
date of the adoption of said resolution, a written appeal was filed
with the City Council of the City of Anaheim protesting the aotion
of the City Planning Commission denying said varianoe, and said
appeal was set for public hearing on the 17th day of December, 1957,
at 7:00 o'clock P.M., in the City Hall in the City of Anaheim, and
notioe of such public hearing was duly given as required by law and
the provisions of Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, at the time and plaoe fixed for said public hear-
ing, the City Council did duly hold and conduct such public hearing
and did give all persons interested therein an opportunity to be
heard; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council does
find that:

1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preserva-
tion and enjoyment of a substantial property right
possessed by other pt:'operty in the same vicinity and
zone and denied to the property in questior.
3. That th,e gr;mting, of such a variance W;ill not be
materially detrimental to the public welfare or
injurious to the p~operty.or improvements in such
vicinity and zone in which the property is located.

4. That the granting of such variance will not ad-
versely affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the ,City Council
of the City of Anaheim that the action of the City Planning
Commission denying Variance No. 869 be, and the same is hereby
disapproved, and that a conditional zoning variance be, and
the same is hereby granted to MOORE BUILT HOMES, I~C., P.O.
Box 2067, Anaheim, California, to build one-family dwellings,
each containing a minimum floor space area of 1,125 square
feet, on the 12 lots comprising the property hereinabove
described, su~ect to the following condition:
That all engineering requirements of the City of
Anaheim be complied with as required by the City
Engineer.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner,
its successors or assigns, to comply withfue Anaheim Municipal
Code and regulations and the conditions herein. Said Variance
No. 869 is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 17th day of December, 1957.
